The 'fresh start' that is afforded individual debtors through the discharge doctrines of American bankruptcy law has, to date, defied justification by a single normative principle or theoretical paradigm. The justificatory accounts that have been advanced either fail to explain core doctrines that have long defined the right of discharge or invite theoretical challenges that suggest that their descriptive virtues are swamped by their normative or conceptual shortcomings. This book presents a taxonomy of traditional justifications of bankruptcy and subjects them to critical evaluation. It then seeks to offer a new justification of bankruptcy's 'fresh start' doctrines-one that takes its inspiration from a quite different moral tradition than those that have informed past efforts to justify and explain our enduring societal willingness to release people from onerous financial obligations. The book argues that personal debt relief is fully vindicated not by a utilitarian theory, nor by a distributive justice theory, nor by a retributive theory, nor by any other rights- or duties-based theory that is preoccupied with moral claims that particular creditors or debtors might proffer. Rather, the long-standing institution of discharge in bankruptcy is best explained by an aretaic, or virtue-based, theory that concerns itself with the obligations that the rest of us have to be charitable towards those who are unable to repay their debts. The fresh start that bankruptcy gives to those who have been shackled by overwhelming debt is justified not by its effects on creditors, debtors, or future market actors, but by its satisfaction of the demands of individual charity to which all citizens are subject. Bankruptcy's discharge of the debts of those who have become financially desperate is best thought to be an institution that aggregates others' demands of good character so as to permit citizens for whom debt-forgiveness is a personal virtue to live in a society that fulfils that virtue.

Christian Wolff (1679-1754) war ohne Zweifel der historisch bedeutendste und sowohl national wie international - bis in die seinerzeit gerade erst entstehenden Vereinigten Staaten von Amerika - einflussreichste Philosoph der deutschen Aufklärung, ja vielleicht der Aufklärung überhaupt. Seine konsequent durchgeführte, auf der mathematischen Methode samt (soweit nur möglich) empirischer Bestätigung der Resultate beruhende Systematik umfasst alle akademischen Wissensgebiete und Disziplinen, inklusive von Mathematik und Theologie, und berücksichtigt ebenso ihre praktische bzw. technische Anwendung.<div>Wolffs einheitliches und durchaus enzyklopädisch angelegtes System des Wissens basiert auf klar und deutlich erkannten, d. h. vollständig analysierten und beweisbaren, Prinzipien in Logik, Metaphysik und Moral. Aus ihnen werden deduktiv durch gültige Schlüsse alle wahren Sätze abgeleitet, und zwar sowohl die notwendigen als auch die kontingenten. Da letztere allerdings widerspruchsfrei verneint werden können, macht ihr Beweis darüberhinaus auch eine empirische Bestätigung nötig. Schon deswegen bemüht sich Wolff um die Integration aller seinerzeit vorliegenden naturwissenschaftlichen Erkenntnisse (Newton) und ihrer technischen Anwendungen. Was derart für die theoretische Philosophie von der Ontologie über Kosmologie (Physik) und Psychologie bis zur Theologie gilt, gilt ebenso für die praktische Philosophie: Aus unabänderlichen moralischen Prinzipien, die auch für Gott selbst gelten und die auch Er nicht hätte anders machten können, entwickelt Wolff auf der irdischen Basis der Goldenen Regel seine Ethik aus dem Begriff des Glücks, während er sein - erstaunlich liberales - System des (Natur)Rechts unter Gebrauch desselben Prinzips auf die Begriffe von Eigentum und subjektiven Rechten gründet. Dieser universalistische Anspruch Wolffs bei gleichzeitiger Säkularität seines Systems alles möglichen Wissens führen neben allerhand philosophischen Einwänden, wie sie v.a. A.G. Baumgarten und Kant artikulieren, zu heftigen Auseinandersetzungen mit der Kirche im allgemeinen und dem Pietismus im besonderen, die zwar unterdrückt, jedoch nie aufgelöst werden konnten.</div><div>Trotz Wolffs überragender Bedeutung und trotz der Tatsache, dass sein kaum überschaubares Riesenwerk eine solche besonders wünschenswert macht, liegt bislang keine kurze und einem breiten Publikum von Studierenden, Fachleuten und philosophisch, historisch bzw. kulturell interessierten Lesern allgemein zugängliche, auf ca. 150 Seiten angelegte Einführung in seine Philosophie vor. Sie könnte innerhalb eines Jahres ab Beginn der Arbeit hergestellt werden.</div><div>

While his work speaks very powerfully to the contemporary age, the language of Emmanuel Levinas can seem difficult to approach. This dictionary gives you access to terms he used to build his overall argument, including those he employed idiosyncratically and invented.
