Constitutional Systems of the World

This book provides a critical introduction to Chile's constitutional system, covering its key elements.

It provides:
 - an account of its historical origins;
- the structure of the different branches of government;
- the way the fundamental rights are recognised and guaranteed; 
- the recent judicialisation of politics experienced by the country. 

Furthermore, the volume addresses three crucial themes of Chile's constitutionalism that have received little scholarly attention. First, the early development of a constitutional state, toward the mid-19th century, in a region then plagued with state-formation problems, civil war, and authoritarian regimes. Second, the irruption of a military dictatorship that lasted 17 years (1973-1990) in a country that had achieved a decades-old constitutional democracy. And third, the persistent lack of legitimacy of the Constitution of 1980, after more than a quarter of a century during which it governed what was generally considered to be a successful transition to democracy, following the dictatorial regime of General Augusto Pinochet.

This book introduces resilience-based concepts and high reliability organization (HRO) principles—adapted from disruption-prone industries—to improve risk management for tail or extreme events in U.S. globally systemically important banks (G-SIBs). HROs thrive in volatile environments by prioritizing adaptability, vigilance, resilience, and safety. Given that both G-SIBs and disruption-prone companies operate in increasingly uncertain and complex settings, there is a shared need for risk management techniques centered on resilience engineering to anticipate and mitigate unexpected extreme events. While G-SIBs are “too big to fail” and provide valuable insights into resilience in high-stakes scenarios, these approaches can benefit banks of all sizes facing similar risks.
The book explores the social world of banking and management, emphasizing the subjective nature of risk as people interpret events differently. Through surveys, interviews, and case studies, the research identifies growing interest in non-predictive risk methods for bank resilience. It recommends supplementing existing quantitative risk models with a transdisciplinary approach focused on non-predictive HRO principles to help banks prevent and mitigate extreme risks. The study finds that current G-SIB risk methods rely heavily on quantitative models, which may create a false sense of security. Additionally, extreme events are increasingly compound and often driven by human behavior. The book targets scholars and professionals seeking advances in resilience engineering within banking.
Pascal vander Straeten has extensive experience in risk management across institutional and corporate banking, project finance, commercial real estate, and emerging markets, working successfully in the US, UK, Germany, Italy, Spain, France, Luxembourg, and Belgium. Dreimal ist Jörg Brüggemann nach Chile und Südamerika gereist. Die drei Reisen - im Buch gibt es drei Kapitel - sind in ihrer Bildsprache weit mehr Traum- und Empfindungsreisen - vielleicht auch auf der Suche nach sich selbst, als dokumentarische Bilder von Orten, Personen oder politischen Gegebenheiten. Die drei Kapitel, die sich in ihrer Gestaltung und Materialität wunderbar voneinander absetzen und gleichzeitig verschränkt bleiben, lesen sich wie Erzählstränge, die sich nicht sofort erklären lassen, denn sie lassen Raum für eigene Entdeckungen und Fantasien. Ein kurzer persönlicher Text des Autors führt diese Erzählweise in Worten weiter. Auch interessant ist, dass der Fotograf, der in seinem letzten Buch über mehrere Jahre ein nüchternes Thema wie die deutsche Autobahn verfolgte, nun zeigt, dass eine Reiseerzählung vielleicht auch eine Heilung der eigenen Person sein kann und dass innere Bilder einen ganze eigenen, nicht immer erklärbaren Zugang zur Welt ermöglichen.
