How the Law Shapes the Perception of Music

This book articulates and defends a sceptical general account of parliamentary sovereignty.

It challenges the orthodox approach to this fundamental doctrine by making three key heretical claims. First, there are some laws that Parliament cannot make. Second, there are several ways in which primary legislation can be overridden or set aside by institutions other than Parliament. And third, Parliament has the power to bind itself as to the substance of future legislation. All three positions are developed using arguments which depend on existing legal materials and are compatible with the normative underpinnings of the doctrine of parliamentary sovereignty. 

The book combines theoretical and doctrinal analysis. The theoretical part of the book situates Parliament's authority to legislate in the broader context of an examination of constitutional and political authority. It develops a conception of the ways in which competing views on the scope of Parliament's legislative authority are mediated into law. The doctrinal part of the book reconsiders Parliament's legal position. It proposes a novel conception of Parliament's power to bind itself, rooted in the idea of commitments. It defends the existence of a judicial power to impose narrowly conceived freestanding limits on Parliament's law-making authority, rooted in the rule of law. Finally, the book examines the challenges posed to parliamentary sovereignty by both its internal procedures and the devolved legislatures.

This open access book proposes slow memory as a new framework for understanding how remembrance operates across time, urging scholars and practitioners to resist the acceleration that characterizes both contemporary scholarship and public memory cultures. The authors explore the theoretical foundations of slow memory in relation to environmental humanities and Indigenous studies, emphasizing themes of deep time, intergenerational justice, and contested memory regimes. The collection focuses on the fields of environment, (de)industrialization, welfare, politics, and conflict to examine how gradual transformations impact the present through remembrance practices at different tempos. It advocates for a deceleration of scholarly and commemorative practices to develop ethical, sustainable, and inclusive engagements with the past. By foregrounding slowness as a conceptual and methodological tool, and slow memory as a "connective concept," this book offers a vital framework for scholars, policymakers, and practitioners seeking to rethink the temporalities of remembrance in an era of rapid transformation. This book provides the first comprehensive comparative and empirical analysis of the state of harmonisation in EU copyright law in the 27 Member States, and the UK, at the level of national courts. For 3 decades, the EU has harmonised many aspects of copyright law via EU legislation and the case law of the Court of Justice of the EU (CJEU). However, it is not known whether national courts actually comply with it, as a comprehensive analysis of the national case law has not yet been done. This book addresses this major gap in the literature. In the book, a lawyer and a statistician analyse some of the most recent decisions on EU copyright law issued by the 27 Member States and the UK (pre- and post-Brexit), using doctrinal and quantitative methodologies. The main research question addressed is whether there is disharmony in the national case law and whether this is owed to Members States' misimplementing EU copyright legislation, lack of clarity of EU legislation and/or case law, or national courts being unaware, misinterpreting or resisting CJEU case law. The book provides detailed legal analyses and descriptive statistics per topic, per type of work, per country, across countries and over time supported by statistical analysis. Its findings and in-depth reflections on the law and how to improve it are of crucial relevance for policymakers and the judiciary at EU and national level and will interest scholarly audiences in the UK, EU, EEA and beyond.

Characteristics of Japanese visual narratives are depicted in this book, shedding light on cultural, institutional, and industrial aspects of reproducible contents. The book consists of three parts which deal with the Japanese contents industry, the hypervariety industry revolution, and related case studies, respectively. The first part proposes points of view for organizing research on the Japanese contents industry. The authors explain characteristics of the industry from the standpoint of cultural, institutional, and industrial strata. The second part explains the system of revolution in the industry as a hypervariety industry. The Japanese contents industry implicitly predicts the next innovation system, which will be hypervarietal but not top-down or Hollywood style as in the Western economy. The third part provides case studies on phenomena such as the comics market, Akihabara: a cross-cultural town, Cool Japan, and animation.

This open access book presents an all-encompassing way to understand lobbying: the 'Diversion Guide'. This shows that lobbying is problematic when institutions are diverted from acting in the public interest. It reveals why diversions happen, how they are linked together, and what can be done to prevent them. The reader can use the 'Diversion Guide' to identify any problem about lobbying, and test when an officeholder has been diverted from acting in the public interest. The book examines how lobbying can encourage citizen participation and lead to informed law and policy, but is not always fair. It considers the way in which wealthy and influential people can gain greater access to the United Kingdom's political system than most to shape the laws that govern everyone. Scandals are often reported in the media surrounding unequal access, corruption, the revolving door, and more. Unchecked, such lobbying corrodes trust in public institutions. It is vital that the problems surrounding lobbying are clearly understood to avoid a system of weak regulations and to ensure that better regulations are created to restore public trust in politics. More than four hundred years have passed since the Statute of Charitable Uses of 1601, whose Preamble set out a list of charitable purposes which has formed the basis of the modern legal definition of charity. This book explores the substantial body of judge-made rules and principles developed since then, highlighting a carefully curated selection of the landmark cases which have shaped charity law. Each chapter analyses one or more judicial decisions, setting them in their historical context, explaining their contemporary importance, and considering their future relevance. The selected cases cover a broad range of topics. Some go to the heart of what it means to be a charity, elucidating charity's legal definition and public benefit requirement. This open access book investigates the role played by copyright on the digitisation of cultural heritage from three angles: the theoretical differences between cultural property law and copyright; a comparative analysis of the EU, UK, and US; and analysis of current practices and concerns, based on empirical research. As heritage digitisation projects become increasingly common for purposes such as preservation and access, the impact of copyright is also becoming more problematic. In order to provide a full and current picture of the copyright problem, the book first introduces the reader to the debates on the scope and ownership of cultural heritage and provides an overview of the copyright implications of the digitisation process and newer uses, including 2D and 3D scanning; virtual and augmented reality; text and data mining; and artificial intelligence. The author then divides the main critical analysis into three parts, referred to as the 'clashes with copyright'. The first, clash in theory, lies between cultural property law and copyright justification theories. The second clash is in the different legal approaches to digitising in-copyright, public domain, orphan, out-of-commerce and unpublished works in the chosen jurisdictions, focusing on the relevant rights and defences. The third clash is in the interests of stakeholders, based on public reactions to existing projects and cases, supported by interviews with heritage professionals engaging in digitisation. By placing itself in this particular intersection of law, heritage, and technology, the book will be of interest to both intellectual property academics and cultural heritage professionals.
