This book considers whether Parliament recognises a constitutional right to property. Parliament is supreme: in theory, there is nothing to stop it from passing laws to confiscate property. Nevertheless, MPs often argue that a proposed law would be unconstitutional. What does this mean in a system without a written constitution? What counts as a sound argument about constitutional rights? And what influence do constitutional arguments have on the legislative process? The book takes a close look at these questions. It reviews legislation and debates from the Middle Ages through to more recent legislation, and covers a wide range of topics, such as land reform, nationalisation, taxation, regulatory laws and retrospection. It also looks at the most recent debates and considers the relevance of constitutional thinking to election manifestos of the main political parties.

Parliament, the Constitution, and Property in the United Kingdom

Rescission is the principal mechanism by which voluntarily assumed obligations and transactions are unwound. It is important to a range of commercial and non-commercial transactions and is raised regularly before courts at all levels. Despite this prevalence, the law on rescission remains poorly understood and riddled with controversies. Issues in the Law of Rescission brings together leading academics to tackle some of the most challenging and pressing issues facing the law of rescission. Across 11 chapters, it addresses theoretical issues, such as the proper structure of rescission, the justification for powers to rescind, and rescission's relationship to the law of unjust enrichment. The various chapters also offer guidance on specific doctrinal issues, ranging from the grounds of rescission to practical difficulties in establishing the grounds, bars to rescission, rescission in the context of corporate transacting, fiduciary relationships, and gift-giving, and the proprietary consequences of rescission. This book examines the origins, deployment, and legacy of Order 1305, a measure introduced in 1940 to make it a criminal offence to take part in a strike. Surprisingly, the prohibition on the right to strike was retained by the Attlee administration after the Second World War, and was transformed to become a weapon of government during the Cold War to deal with what were wrongly claimed by ministers to be Communist-inspired strikes engineered for subversive purposes. In a deep analysis of Order 1305, the authors provide a reassessment of the role of the State in industrial relations. Challenging much contemporary learning in labour law, the book is informed by a very detailed engagement with Cabinet and ministerial papers, which highlight the contradictions on the part of government in simultaneously promoting and containing trade union power. These sources also highlight the extent to which trade unions both relied on and were co-opted by the State. The main focus of the book, however, is the role of Order 1305 in the control of trade union activists, with the continuing presence of the criminal law and allegations of communist inspired strikes ensuring an important role for MI5 and Special Branch in post-war industrial relations. Material unearthed at the National Archives demonstrates unequivocally not only that trade unions were deeply penetrated, but also that trade union activists were the subject of extensive surveillance, as the authors fully reveal.

Although information generally is not property, private information now appears to be treated by English law as a form of property, giving the owner of the information rights of exclusion, exploitation and transfer. 


Balancing philosophical discussion of the fundamentals with a detailed analysis of the practical difficulties of "propertising" information, the books suggests that English law has evolved a powerful tool for the protection of privacy in this data-driven world.
