Routledge Research in Tax Law

This book elaborates on the issue of tax avoidance in the light of domestic case-law of the European Union Member States and the case-law of the Court of Justice of the European Union (CJEU).Analysing the most common tax avoidance instruments in European case-law, the book discusses transfer pricing, double taxation treaties, and the anti-avoidance clause. Using eight countries as case studies, Poland, Spain, Portugal, the Netherlands, Sweden, Germany, France and Italy, the book compares their different approaches to tax avoidance from the perspective of both the tax policy of the state and the strategies used by international holding companies. Additionally, the book analyses the case-law of the CJEU, widening the approach to cover tax avoidance across EU countries. Gentile Food Bans: Halakhah and the Fear of Intermarriage challenges long-standing rabbinic and scholarly assumptions about the origins of dietary restrictions in Jewish law.Re-examining halakhic texts across centuries, this book argues that the early prohibitions against consuming Gentile bread and certain cooked foods were originally rooted in concerns over forbidden ingredients - not intermarriage. It was only later, in Babylonia, that the rationale of preventing intermarriage, mišum ¿atnut (mishum hatnut), was introduced, particularly regarding Gentile bread, even when prepared under rabbinic supervision. Drawing on a wide range of sources - including biblical texts, Second Temple writings, tannaitic literature, and the Palestinian Talmud - this study shows that intermarriage was not a major societal concern or halakhic foundation in ¿Ere¿ Israel, whereas the Babylonian context likely prompted the shift in rationale. The book presents a compelling socio-historical argument for how evolving communal realities shaped halakhic interpretation and enforcement.This work will appeal to scholars and students of Jewish studies, halakhah, rabbinics, and ancient Near Eastern history, as well as anyone interested in how legal traditions adapt to shifting cultural landscapes. Building upon AI scholarship in science and technology studies, technology law, business ethics, and computer science, it documents potential risks and actual harms associated with AI, lists proposed solutions to AI-related problems around the world, and assesses their impact. The book presents a vast range of theoretical debates and empirical evidence to document how and how well technical solutions, business self-regulation, and legal regulation work. It is a call to think inside and outside the box. Technical solutions, business self-regulation, and especially legal regulation can mitigate and even eliminate some of the potential risks and actual harms arising from the development and use of AI. This open access book investigates the role played by copyright on the digitisation of cultural heritage from three angles: the theoretical differences between cultural property law and copyright; a comparative analysis of the EU, UK, and US; and analysis of current practices and concerns, based on empirical research. As heritage digitisation projects become increasingly common for purposes such as preservation and access, the impact of copyright is also becoming more problematic. In order to provide a full and current picture of the copyright problem, the book first introduces the reader to the debates on the scope and ownership of cultural heritage and provides an overview of the copyright implications of the digitisation process and newer uses, including 2D and 3D scanning; virtual and augmented reality; text and data mining; and artificial intelligence. The author then divides the main critical analysis into three parts, referred to as the 'clashes with copyright'. The first, clash in theory, lies between cultural property law and copyright justification theories. The second clash is in the different legal approaches to digitising in-copyright, public domain, orphan, out-of-commerce and unpublished works in the chosen jurisdictions, focusing on the relevant rights and defences. The third clash is in the interests of stakeholders, based on public reactions to existing projects and cases, supported by interviews with heritage professionals engaging in digitisation. By placing itself in this particular intersection of law, heritage, and technology, the book will be of interest to both intellectual property academics and cultural heritage professionals. Reshaping EU Copyright Law to Support Creativity Online

This book is the first investigation of the relationship between EU digital sovereignty and sustainability strategies. It maps the ambitions and limitations of EU digital strategic autonomy and explores the structural challenges underlying its relationship with its green transition objectives in the context of the ongoing wars in neighbouring European countries and the consequent tensions in the EU energy sector. The EU is racing to achieve technological independence from third countries and foreign multinational companies to protect its digital sovereignty and preserve its fundamental rights. In the EU, digitalisation and the green transformation are seen as twin transitions. Yet, EU digital sovereignty strategies have a significant environmental cost. Reaching a status of strategic autonomy of the EU at the level of digital infrastructures, products, services and data implies higher energy consumption and exploitation of natural resources. Moreover, the geopolitical tensions following the Russian invasion of Ukraine have provoked an unprecedented energy crisis, which is affecting EU economies and impacting objectives of the twin transitions. The book offers an interdisciplinary analysis of the major EU regulatory and policy instruments in this field, providing an invaluable guide for academics, practitioners, and policymakers navigating the complex issues of preserving digital sovereignty and addressing climate change in times of war and energy crisis.

This book analyses the extent to which the common law can accommodate the new issues arising from the AI revolution, and where legislation may instead be necessary. In doing so, the book takes into account not only doctrinal principles but also conceptual and theoretical foundations of common law. Over the next few decades, the use of AI in commercial and other transactions is likely to be one of the most disruptive influences ever to affect private law. Its impact will be wide and deep, affecting not simply the traditional areas of contract and tort but also agency, trusts, fiduciary relations and a great deal besides. The common law is known to be extremely flexible, and to some extent rules can be organically stretched and manipulated to respond to disruption of this kind. However, there is equally no doubt that such organic development is not enough on its own, and will have to be supplemented by legislative alterations and at times serious changes of thinking. The book therefore discusses how established legal doctrines and principles in private law need to be reconsidered in view of the increasing pervasiveness of intelligent machines capable of taking decisions. The analysis contained in this book provides a key contribution to ongoing debates regarding potential law reform, not only in England and Wales but also in other common law jurisdictions.
