While mainstream international legal scholarship has long treated race as a peripheral concern-or a historic injustice to be remembered but not redressed-this volume argues that racialisation is foundational to the discipline, underpinning its doctrines, epistemes, and interlocutors. Emancipating International Law explores the many ways racial hierarchy, systemic oppression, and global white supremacy shape international law. Bringing together leading and emerging scholars, the collection moves beyond qualifying whether international law is racist to explore how racial hierarchies are embedded in its structures and continue to evolve through legal and institutional practice. Divided into five sections, the book begins by situating international law's racialised boundaries within its colonial, capitalist, and chauvinist afterlives, exposing how white ignorance and race-thinking underpin legal norms, from sovereignty to jus cogens. It then examines racial stratification across legal institutions, including investment law, refugee law, and the Genocide Convention. The third section extends this critique to human rights, revealing the ways in which even an emancipatory paradigm can bolster racial injustices. The penultimate section unpacks racial hierarchies in disparate societies, including Brazil, India, and Japan, as well as the frontiers of nation-states. The volume concludes with a powerful discussion of the role of activism and alternative epistemologies in racial justice struggles, and the limits of international law's capacity for anti-racist transformation. Aimed at scholars, practitioners, and students of international law, critical legal studies, and anti-colonial theory, this book advances an understanding of international law that is aimed at dismantling its racialised structures. This book explores the relationship between copyright law, online anonymity, and creative user-generated content (CUGC). Presenting original empirical findings, the book evaluates the co-existence of copyright law and normative systems regulating a CUGC landscape made up of artists, photographers, and writers, and makes novel recommendations for copyright reform. It takes a multi-jurisdictional approach across Anglo-American and EU legal systems, using the UK, USA, and Germany as representative jurisdictions for legal analysis. Qualitative findings are drawn from creators and communities on Reddit and 4chan. Copyright subsists in much CUGC, but pervasive anonymity makes it difficult for the law to regulate it effectively. Simultaneously, anonymity offers creative benefits in a way that highlights flaws in traditional justifications of copyright. Comparisons between community norms and copyright law identify practical differences but also fundamental compatibilities in terms of ownership expectations. However, the simultaneous existence of legal and normative enforcement mechanisms complicates matters for creators and potential users, with negative implications for creativity and copyright law. While existing reform efforts have made suggestions to create a UGC exception, these overlook and undermine the role of CUGC creators as copyright holders. This can be addressed through the consideration of a framework of supplementary CUGC guidelines when developing such reforms. This valuable resource for researchers and students provides a distinct perspective in framing CUGC creators as copyright holders, examining online anonymity as a pivotal factor influencing regulation.

This book analyzes the legal tensions that exist in the economy that purports to "reanimate" the dead using postmortem digital technologies. Technological reanimation has proven to be big business, with many notable commercial entities investing in this "afterlife economy". Postmortem technologies convincingly replicate the appearance, physiognomy, conversation styles, and thought patterns of a deceased individual by generating digital copies that act in their stead. In the entertainment industry, new works can be created with dead celebrities through a postmortem copy that is managed by their representatives. The result is an economy in which the dead are offered as a product or service to consumers, with some having their artistic legacies extended past death through an "afterlife career". Many stakeholders stand to benefit from such a lucrative afterlife economy, but the law is simply not prepared for the issues that will arise with this exploitation of the dead. Reanimation requires the exploitation of one's reputation, persona, artistic works, and personal data. However, the corresponding legal protections are either nonexistent, inapplicable, or inconsistent across borders - depending on which posthumous interest is analyzed. In response, and by studying the contours of the existing legal protections in the afterlife economy, this book proposes a system rooted in the "shared ownership" of one's postmortem copy and the responsible "stewardship" of legacies through fiduciary duties.Law and the Digital Reanimation of the Dead will be of considerable interest to scholars working in the areas of entertainment law, intellectual property, and law and technology, as well as others with professional interests in the area.
