Hart Studies in Constitutional Theory

This is the second part of a 2-volume set which presents an in-depth investigation into the canon of constitutionally conforming interpretation. This second volume builds upon the insights of the first volume, which includes national reports on the use of constitutional interpretation. In Volume 2, the analysis is extended beyond the national context, discussing its application in the supranational and international contexts, including in EU law and the domestic use of international law. It presents several critical perspectives, challenging the legitimacy of constitutionally conforming interpretation, and looks at the invisible constitution, constitutional amendments, and the impact of legalism. The volume is rounded off by three comparative analyses, which formulate universally applicable insights. Together with Volume 1, this book fills an important gap in legal scholarship and sets the stage for cross-national discourse on this critical legal method.

Constitutionally Conforming Interpretation – Comparative Perspectives

Late medieval Bruges was a commercial hub that connected Hanseatic, English, Scottish, Portuguese, Spanish, Aragonese, and Italian traders. This book focuses on the conflict resolution of the aldermen and how merchants operated within this legal framework. The key question being whether Bruges was a city of justice. Although this was sometimes claimed by travellers, a lot of merchants confronted with the practicalities of conflict resolution in Bruges, disagreed. Fieremans analyses how customary law, institutional frameworks, and commerce intersected and were challenged by the aldermen's pursuit of justice. By clarifying the working of the aldermen, it advances our knowledge of the basic mechanisms of a late medieval law court and the evolution of the law courts of late medieval Flanders. Taking an interdisciplinary approach, the book focuses on the interplay between commerce and justice, explores the diverse merchant communities, and considers the potential lessons it offers for understanding both historical and modern markets. It sheds light on the pragmatic legal culture of Bruges and the legal mechanisms that partially regulate commerce.

Law, Leverage, and Litigation in Late Medieval Bruges

What does it take for someone-or something-to count as a legal person? Is it a matter of biology, ideology, or both? This book explores how societies determine who or what qualifies as a legal person, from individual humans to corporations, from nation-states to environmental entities. The author argues that legal personhood is not grounded in fixed, mind-independent properties or logical entailments. Instead, it develops from how humans experience their physical and cultural worlds through embodied cognition. Mapping these experiences onto seemingly discrete (legal) concepts yields a categorisation process that is creative yet patterned by culturally entrenched models and institutional aims. The book introduces the "radial conception," which posits that legal personhood is a flexible, context-dependent category centred around a core case. The core case - often, in many legal systems, the adult citizen of sound mind - is a mental model that helps define the category and influences how we think about it. This makes the most typical features of a category the default ones we think of when encountering it. As new situations arise or social needs evolve, legal personhood expands outward from the core case to include a diverse range of entities. However, this expansion does not follow rigid rules; rather, it relies on conceptual mappings that derive much of their persuasive power from cognitive tools like metaphors, metonymies, and image schemas. Of interest to students engaged in legal philosophy, academics exploring the interplay between cognitive science and law, practitioners aiming to deepen their knowledge of legal personhood, or anyone intrigued by the merging of legal concepts and psychological insights, this book charts new territory in understanding law's persons.

The Concept of Legal Personhood

In 1532, James V instituted the College of Justice, an incorporated group of expert lawyers and administrators who were to exercise supreme Scottish civil jurisdiction. Why did he decide to do that? This book argues that the scheme was informed by a powerful sense of the role that an incorporated body of expert lawyers might serve in articulating a just law for the realm. The new institution also more fully defined the relationship between the king and his supreme judges, reflecting contemporary European thought. Furthermore, the new College of Justice was meant to have a significant role in connection with the government of the Scottish Catholic Church on the eve of the Reformation. ​​​​​​​ This account of the institution of the College of Justice serves as a case study of the powerful role of lawyers in state formation during the Renaissance. This volume informs readers of the present state of constitutional democracy throughout the world and provides them with a framework for maintaining and improving constitutional governance.

The health of constitutional democracy has not improved substantially since the publication of Constitutional Democracy in Crisis? I. Widespread concern exists about the decline of constitutional democracy around the world, a phenomenon often referred to as 'democratic recession', 'democratic failure' or 'democratic backsliding.' The United States is hurtling toward competitive authoritarianism if not at that destination. The United Kingdom, France, Germany, and Italy confront powerful authoritarian movements. Eastern European countries struggle to maintain fragile democracies, while democratic efforts in the Global South confront the legacy of colonialism. Several "feel-good" cases remain: New Zealand and Australia continue as robust constitutional democracies; Poland and possibly Hungary are undergoing democratic "U-turns" after an authoritarian turn; constitutional reform failures have not dampened democratic momentum in Chile; and Brazil's strong democratic culture enabled resistance to and ultimately the conviction of Jair Bolsonaro.

Struggles to establish, sustain, and restore constitutional democracy have not only persisted but accelerated over the past eight years, increasingly blurring the line between "episodic turbulence" and "structural rupture." Global developments now demand not just updated examples, but a re-examination of core assumptions, about what constitutes a constitutional crisis, how rapidly constitutional-democratic systems can be reoriented, which institutions matter most under stress, and what effective repair looks like once democratic injury is normalized. This book discusses the 'theory of dematerialised property', a constructivist property theory that applies to tangible and intangible property alike. It explains the way in which this theory regards 'property' as a creation of the law, whereby the property object (res) is a normative conception brought into existence by the property rights in it, and an actual corporeal thing is merely a practical incidence of the abstract-normative idea of the property object. The discussion of dematerialised property is founded on a theoretical examination of definitions, terminologies and concepts of property, particularly ownership and possession, and restricted real rights, as well as a comparative law overview of concepts of ownership and the acquisition and transfer of property rights in the different Common law and Civil law property systems. The concept of dematerialised property serves as a good theoretical basis for explaining and defining forms of tangible and particularly intangible property, like debts, money and shares, and modern forms of property, such as electronic money, non-fungible tokens or data. The book also features the ideas of property theorists in law and in political philosophy, such as the classical theories by Grotius, Pufendorf, Locke and Hegel, and it revisits modern legal theories of property. It then deals with economic, sociological and psychological dimensions of property which are behind the legal concept of property, aspects that are generally disregarded in traditional texts on property theory.
