Know Your Rights

Always plead the 5th but you must say it. Because justice is blind

This collective work provides a chronological and up-to-date reconstruction of the three-round debate between Robert Alexy and Ralf Poscher. The debate represents the German development of an enduring jurisprudential controversy over the concept and adjudicatory role of legal principles, classically addressed by HLA Hart and Ronald Dworkin. Alexy's principles theory, which has initially defined 'legal principles' as optimisation requirements, currently argues that they express an 'ideal ought'. Poscher's critique challenges the soundness of Alexy's principles theory by questioning its ontological and epistemological commitments. As legal principles are directly related to constitutional rights, the Alexy-Poscher debate has significant implications for constitutional adjudication. For instance, proportionality analysis - which incorporates a highly controversial balancing test - and the legitimate boundaries of judicial power, hinge on the debate's two opposing views. Yet despite the centrality and pervasiveness of this topic, German contributions to the theoretical and practical impact of legal principles remain generally overlooked by English-speaking scholars. Concluding with David Duarte's critical and meticulous assessment of the debate, this collection bridges that important scholarly gap. Whether or not conversant in the debate on legal principles, legal researchers and advanced law students with interdisciplinary interests in jurisprudence and constitutional law will find in this book a timely and distinctive introduction to leading developments in German legal thinking.

Horizontal Rights: An Institutional Approach brings a fresh perspective to these age-old, yet fraught issues. This book argues that constitutional scholarship and doctrine, across jurisdictions, has proceeded from an inarticulate premise called 'default verticality.' This is based on a set of underlying philosophical assumptions, which presumes that constitutional rights are presumptively applicable against the State, and need special justification to be applied against private parties.

Departing from default verticality and its assumptions, this book argues that constitutional rights should apply horizontally between private parties where the existence of an economic, social, or cultural institution creates a difference in power between the parties, and allows one to violate the rights of the other. The institutional approach aims to be both theoretically convincing, as well as a providing a workable model for constitutional adjudication. It applies both to classic issues such as restrictive covenants, as well as cutting-edge contemporary legal problems around the regulation of platform work and the distribution of property upon divorce. This promises to be an exciting new contribution to the global conversation around constitutional rights and private power.

Masterarbeit aus dem Jahr 2024 im Fachbereich BWL - Rechnungswesen, Bilanzierung, Steuern, Note: 1,0, Martin-Luther-Universität Halle-Wittenberg (Externes Rechnungswesen und Wirtschaftsprüfung), Sprache: Deutsch, Abstract: Die vorliegende Masterarbeit setzt sich mit aktuellen Fragestellungen der Bilanzierung von Reverse-Factoring-Transaktionen und damit verbundenen Problembereichen auseinander. Diese sind vor allen Dingen in der ausweisbezogenen Klassifizierung einer Verbindlichkeit und in der Darstellung innerhalb der Kapitalflussrechnung zu sehen. In diesem Zusammenhang werden aktuelle Fragestellungen analysiert und gewürdigt. 

Ziel dieser Arbeit ist es, die Bilanzierung von RF-Transaktionen nach IFRS unter besonderer Berücksichtigung des rechtlichen Rahmens entsprechender Vereinbarungen zu erläutern und insbesondere die aktuellen Änderungen an IFRS 7 und IAS 7 durch das IASB vor dem Hintergrund der Zielsetzung der Vermittlung entscheidungsnützlicher Informationen zu würdigen.

Der Hauptteil dieser Arbeit befasst sich zunächst mit der bilanziellen Abbildung von RF-Transaktionen beim Kunden (Abschnitt I). Hierbei bildet ein Schwerpunkt der Ausführungen die Bilanzierung von RF-Transaktionen nach IFRS 9 i.V.m. IAS 1 hinsichtlich Ansatz, Bewertung und Ausweis des "klassischen" Falls und dem ausweisbestimmenden Sonderfall bei Bestehen eines abstrakten Schuldanerkenntnisses (Abschnitt I.2). Im Anschluss daran wird auf die Abbildung vorgenannter Transaktionen in der Kapitalflussrechnung (KFR) gem. IAS 7 Bezug genommen und die Standardänderungen vor dem Gesichtspunkt der Informationsfunktion der KFR analysiert (Abschnitt I.3). Zum Schluss des Kapitels der kundenseitigen Bilanzierung widmet sich die vorliegende Arbeit den Anhangangaben nach IFRS 7 und IAS 7 im Zusammenhang mit RF-Transaktionen (Abschnitt I.4). Danach wird die bilanzielle Abbildung beim Lieferanten in Betracht genommen (Abschnitt II).
