Spinoza is generally recognized as one of the most important philosophers of the early modern period; less well known are his observations regarding private ethical conduct, social control including state intervention in the market, and public policy including welfare.This book explores these political economy dimensions of Spinoza's thought setting them in the context of his own wider work and the broader intellectual history landscape. The discussion in the book takes account of Spinoza's relation with his contemporary Thomas Hobbes regarding constitutional matters as well as public policy; compares his stance respecting ethical conduct with that of Immanuel Kant, who came a century later, and with utilitarianism; and examines the objections to Spinozan doctrine by the seventeenth-century philosopher Pierre Bayle and thereafter by David Hume, and the nineteenth-century critics G.W.F. Hegel and J.S. Mill. More specifically, this book points to a hitherto unnoticed adjustment by Spinoza himself to his contrast between 'substance' and 'mode' thereby weakening the foundations of his philosophical-theological position. It also demonstrates the on-going relevance in civil society of the State of Nature for both Hobbes and Spinoza and underscores a divergence from Kant regarding private ethical conduct. The book also explores Spinoza's position on public policy, with emphasis on working-class welfare, a matter displaying a typically 'mercantilist' stance.The book will be of great interest to readers of the histories of political economy, philosophy, and political science in particular, and intellectual history more broadly.

Der Autor weist nach, dass dies keine Inkonsistenz, sondern eine werkübergreifende Konstante in Kants kritischem Denken darstellt. Durch die Analyse der Interaktion der Vernunftvermögen rehabilitiert das Buch die systematische Funktion des höchsten Guts und eröffnet zugleich Perspektiven auf den Deutschen Idealismus.&nbsp;Der Autor&nbsp;Sung-Yeop Jo promovierte an der Ludwig-Maximilians-Universität München. Derzeit forscht und lehrt er als SNU Philosophy Fellow am Department of Philosophy der Seoul National University. Im Zentrum seiner Arbeit steht die Ethik Immanuel Kants, insbesondere mit Blick auf ihre Relevanz und Anwendung für aktuelle gesellschaftliche und philosophische Fragestellungen.p&gt;

Kant hält die philosophischen Patentrechte am Begriff der Autonomie. Die Befreiung des aufgeklärten Subjekts aus allen Abhängigkeitsverhältnissen bedeutet auch: Eine in reiner praktischer Vernunft fundierte Moral emanzipiert sich begründungslogisch von jeglicher Religion. Gleichwohl erklärt Kant diese nicht einfach für obsolet. Vielmehr beharrt er auf einer eigentümlichen Ergänzungsbedürftigkeit unseres selbstbestimmten Wollens, wodurch Religion zur Konsequenz moralischer Freiheit wird. Moral und Religion stehen nach Kant in einem irreversiblen Implikationsverhältnis: Letztere ist für Erstere nicht notwendig, wird aber ihrerseits durch diese unausweichlich.
Eine unverkürzte Kantdeutung hat daher dem asymmetrischen Verweisungszusammenhang nachzuforschen, der aufgespannt wird durch die drei Zentralbegriffe: Freiheit - Moral - Religion.

Die vorliegende Arbeit untersucht die aporetischen Strukturen einer von Schiller entworfenen Politik des Schönen. In Auseinandersetzung mit Hobbes, Rousseau und Kant analysiert sie die Problematik und Krise der Repräsentation und leitet anschließend aus Schillers später Tragödientheorie eine idealistische Überspannung des Erhabenen ab, die das Scheitern einer im Grunde aussichtslosen Anthropopoiesis bezeugt - ein Scheitern, das Adorno erneut produktiv zu machen versucht. Obwohl Adorno eine positive Anthropologie verweigert, halten seine aporetischen Konstruktionen an Schillers Frage nach dem Menschen im "vollen Sinn des Wortes" negativ fest.

The international order of the post-WW II period is in disarray. The sounds of war can be heard all around us, from Ukraine to Gaza, from Darfur to the Congo, and there is growing skepticism towards human rights and democracy, the rule of law and peace among peoples. Facile expressions such as "Eurocentrism" and "demise of the West and the rise of the rest" miss the real challenge in this situation: how to extend moral, legal and political universalism to address the experiences of the multitude of humanity for whom western modernity has brought not only equality but also subordination, not only emancipation but also domination. Benhabib argues that rethinking this universalist project and participating in world-building together can be achieved by reconstructing and retrieving the best insights of critical social theory in the Frankfurt tradition and the liberal Kantianism of Rawls and Dworkin. In that spirit, this volume addresses state and popular sovereignty, Third World approaches to International Law, the 1951 Refugee Convention, and climate change legislation, while focusing on the changing fortunes of the European Union and cosmopolitanism. Benhabib engages with postcolonial thinkers and argues that, although validity claims and relations of domination and inequality are often intermixed, it is possible to reconstruct the insights of international law to serve a more inclusive universalism and world-building.&nbsp;This vibrant defense of human rights and universal norms in an age of political skepticism and extremism will appeal to a wide readership and will be of particular interest to students and scholars in political theory, critical theory and law.

This book challenges the view that legal positivism should be reduced to a conceptual analysis of legal validity. Instead, Elena Namli reclaims legal positivism as a theory of the relationship between law, morality, and politics. Presenting novel interpretations of the classical works of Herbert L. A. Hart, Joseph Raz, and Jürgen Habermas, Namli frames legal positivism as a theory that makes possible a moral and political critique of valid law. Moreover, this book defends the dialectical relationship between law, politics, and morality by combining a positivist approach to legal validity with a constructivist ethical theory which strengthens the critical potential of legal positivism. Legally valid norms may not always be morally justified, but understanding the moral quality of legal regulations is essential for comprehending modern law.

Kelsen's Conception of the Judicial Function versus Classical Positivism estudia la concepción kelseniana de la función judicial en contraste con el positivismo clásico. Sostiene que la actividad jurisdiccional no es una mera aplicación mecánica de normas, sino un proceso que exige interpretación y, en determinados márgenes, creación normativa. El análisis muestra cómo la teoría pura del derecho reconoce la indeterminación del lenguaje jurídico y la necesidad de decisiones que otorgan sentido al ordenamiento, sin abandonar el marco normativista. El libro examina críticamente la tensión entre formalismo y creatividad judicial, así como los límites institucionales y dogmáticos de la discrecionalidad.
