Inter-American Yearbook on Human Rights

Inter-American Yearbook on Human Rights / Anuario Interamericano de Derechos Humanos, Volume 40 (2024) (4 Vols. Set)

Studies in International Law

This book offers a foundational rethinking of how international law engages with non-state effective territorial entities - territories that, while legally part of a recognised state, are de facto governed by non-state actors or other states. These entities - ranging from ISIL-controlled areas in Syria to the contested territory of Crimea, the autonomous Somaliland, and Taiwan - occupy an increasingly prominent place in global politics, yet remain inadequately addressed in legal doctrine. Rather than assessing these territories through the binary lens of statehood, the book begins by assuming their non-state status and asks: what legal capacity and responsibilities do such entities hold under international law? It considers their obligations toward both other states and the populations under their control, and explores the broader implications for concepts like sovereignty, territorial integrity, and recognition. Drawing on four case studies across a spectrum of state-likeness, the book moves beyond isolated analyses of conflict or self-determination to offer a more holistic account of what these entities reveal about the limits and possibilities of the current international legal framework. It argues for a more functional, capacity-based understanding of legal responsibility that acknowledges the realities of territorial control without forgoing the notion and role of statehood. Combining doctrinal clarity with pragmatic ambition, this book challenges the state-centric foundations of international law and offers a roadmap for engaging with one of its most pressing contemporary challenges: the legal accommodation of non-state territorial authority in a world still structured around states.

Re-Thinking Capacity and Responsibility in International Law

Non-State Effective Territorial Entities

This book honours a remarkable legal thinker, David Feldman, whose influence on public law and on multiple generations of legal scholars and practitioners has been profound. It provides a unique set of insights into some of the most topical and enduring questions in public law (broadly conceived), through the reflections of a stellar line-up of contributors on key dimensions of David Feldman's rich body of work. Each chapter constitutes an original and important contribution to the field, taking David Feldman's seminal writings as a starting-point and developing contemporary, distinctive analytical perspectives. Like David Feldman's work itself, the book ranges across - and acknowledges and explores the porous relationships between - constitutional law, administrative law and human rights and civil liberties.

Settling a Loved One's Estate or Trust

Alabama Water-Resources Law is first truly comprehensive study examining the structure and shortcomings of Alabama's water law. This prodigious treatise provides a necessary tool to help the state and its people understand and prepare for the wise use of its water resources. Part I provides a clear and critical statement of Alabama's current water law in eleven chapters. Part II expands on the criticisms of existing Alabama law, recounts the history of previous efforts at addressing those criticisms, and makes recommendations for change, taking lessons from other southeastern states. This is a must-read for all Alabama policy-makers, attorneys, and concerned citizens to answer water-law questions and to make proactive laws to bring Alabama into twenty-first-century practices.

A Critical Treatise

Alabama Water-Resources Law

Routledge Research in Asylum, Migration and Refugee Law

The Refugee Convention of 1951 did not categorically provide for the socio-economic rights of asylum seekers. While the United Nations High Commissioner for Refugees Executive Committee has subsequently attempted to address these shortcomings, they have not categorically stated whether those seeking asylum still enjoy socio-economic rights recognised under human rights treaties provisions. This book explores the tensions between seemingly universal socio-economic rights and the justification or legitimisation of differences in meeting these rights between citizens and those claiming asylum. The book provides an examination of the normative content of a number of core socio-economic rights for asylum seekers, in particular the right to food, water and shelter, right to health and the right to a decent standard of living. The book analyses the socio-economic rights of asylum seekers under internationalised legal mechanisms including the UN system of human rights protection, the European Union, and the Council of Europe. It questions the legitimacy of differentiation towards the socio-economic of asylum seekers that has been adopted by many states, and presents a persuasive argument as to the inclusivity of socio-economic rights for asylum seekers, while recognising the limits of human rights in this regard.

Choosing tenants, raising the rent, returning deposits, and maintaining rental property--these are just a few of the things landlords do that are strictly regulated by California law. To avoid problems and hefty legal fees, rental property owners and managers need to know and comply with federal, state, and local rules, and use the proper legal forms. Fortunately, everything you need is in this book. Rent control and eviction protections are blossoming throughout California; alongside statewide protections, even small municipalities are enacting local ordinances that affect rent, terminations, and notices. This book contains a unique rent control chart that explains key provisions and gives information on how to learn more. No California landlord can afford to do business without checking for local ordinances and following them.

This classic textbook provides a thorough overview of European private international law. It is essential reading for students and practitioners of private international law and transnational litigation, wherever they may be located: the European rules extend beyond European shores. Opening with foundational questions, the book clearly explains the subject's central tenets: the Brussels I, Rome I and Rome II Regulations (jurisdiction, applicable law for contracts and tort). Additional chapters explore private international law and insolvency, freedom of establishment, and the impact of private international law on corporate social responsibility. The relevant Hague instruments, and the impact of Brexit, are fully integrated in the various chapters. Drawing on the author's rich experience, the new edition retains the book's hallmarks of insight and clarity of expression, ensuring it maintains its position as the leading textbook in the field.

Modern Studies in European Law

Structural Principles of EU Law

This book clarifies all legal aspects of the good neighbourliness principle in international and EU law. It elaborates on the most acute infringements of the principle of good neighbourliness in both international relations and EU enlargement policy. Taking a two-part approach, it offers the international law and EU law perspectives. Over five chapters, it sets out the legal framework and the practical application of the principle, before setting out conclusions on the effectiveness of that application. Given the current focus on enlargement and accession to the EU this is a timely and topical study in an under-researched field.

The Principle of Good Neighbourliness in International Law and EU Law

This book argues that the pursuit of universal norms remains a worthwhile endeavour for the international legal discipline. It does this while also engaging with the very active imperialist critique of such norms. The study has 4 aims; firstly to illustrate the role that the idea and debate around norms have in developing international law, and secondly to address the philosophical concerns around identifying such norms. It moves on to explore whether a legal/practical instantiation of the universal can be done without taking a particular position/perspective. And finally, it turns to the impact the universal has on the development of international human rights law. Public international law, human rights and legal philosophy scholars will welcome this original theoretical-philosophical perspective on an enduring debate in the field of international law.
