How the social organization of Europe and China shaped their divergent economic and political trajectories over the past millennium In the eleventh century, when Europe was still backward and poor, China was a rich and sophisticated civilization. Yet Europe became the birthplace of democracy and the Industrial Revolution, driving the Great Enrichment, while China stagnated until the end of the twentieth century and was always ruled by autocracies. Two Paths to Prosperity traces the emergence of two very different social organizations in premodern China and Europe--the clan and the corporation--showing how they were key factors in the economic and political divergence of these two great civilizations. In this landmark book, three leading economists offer a bold new account of why Europe and China evolved along such different trajectories. In the early Middle Ages, public goods like risk sharing, religious worship, education, and conflict resolution were provided by nonstate organizations in both societies. China increasingly relied on kin-based cooperation within clans, while weaker kinship ties in Europe gave rise to corporations such as guilds, universities, and self-governing towns. Despite performing similar functions, clans and corporations were built on very different principles--with lasting consequences until today. Providing a novel answer to a fundamental question in economic and political history, Two Paths to Prosperity shows how extended kinship in Chinese society facilitated the consolidation of autocracy and hindered innovation and economic development, and how corporations in Europe influenced emerging state institutions and set the stage for the Industrial Revolution.

Das Lehrbuch richtet sich in erster Linie an Studierende, die sich im Rahmen ihrer universitären Ausbildung mit dem Bereich des Wirtschaftsstrafrechts befassen möchten. Deshalb wird verstärkt mit didaktischen Elementen wie Fällen aus der Praxis und Schlagwörtern gearbeitet, die einen Ausblick auf weiterführende Fragestellungen geben sollen. Um ein besseres Verständnis zu ermöglichen, werden nicht nur die für das Studium relevanten Normen dargestellt. Vielmehr werden auch die Ursprünge des Wirtschaftsstrafrechts und dessen Besonderheiten im Bereich des Allgemeinen Teils beleuchtet. Einen Schwerpunkt setzt das Lehrbuch bei den mit dem Wirtschaftsstrafrecht verknüpften unternehmensinternen Präventionsmaßnahmen, die unter dem Begriff Compliance zusammengefasst werden können.

Zum Werk Die Datenschutz-Grundverordnung (DS-GVO) ist in allen EU-Mitgliedstaaten unmittelbar geltendes europäisches Datenschutzrecht für Unternehmen, Privatpersonen und die öffentliche Verwaltung ein. Auch ein Jahrzehnt nach ihrem Inkrafttreten ist das dadurch notwendige grundlegende rechtliche Umdenken nur zum Teil bewältigt. Die Regelungen der DS-GVO müssen aus dem Kontext des gesamten Europarechts eigenständig interpretiert werden. Die Verankerung aller wesentlichen Datenschutz-Grundsätze in der Europäischen Grundrechte-Charta (GRCh) hat gerade angesichts aktueller Diskussionen um Vorschläge zur Reform der DS-GVO besondere Bedeutung. Denn jede denkbare Änderung muss sich an den Vorgaben der GRCh messen lassen. Die ungebremst anwachsende Rechtsprechung des Europäischen Gerichtshofs zum Datenschutz beeinflusst die Datenschutzpraxis bis in Details hinein. Sie erzwingt eine ständige kritische Revision vorhandener Datenschutzkonzepte -eine Aufgabe, die auch für oberste nationale Gerichte weiterhin eine große Herausforderung ist. Die 2025 vom EU-Gesetzgeber verabschiedete DS-GVO-Verfahrensverordnung (Verordnung (EU) 2025/2518) soll bei grenzüberschreitenden Beschwerdefällen, die inzwischen in der Praxis der Regelfall sind, die Rechtsposition betroffener Personen deutlich stärken. "Omnibus"-Vorschläge)</li></ul> Zur Neuauflage Die Neuauflage berücksichtigt die umfangreiche Rechtsprechung des EuGH zur DS-GVO und geht perspektivisch auf demnächst anstehende Entscheidungen ein. Die Leitlinien, Empfehlungen und Stellungnahmen des Europäischen Datenschutzausschusses (EDSA) sind intensiv berücksichtigt. Zu den zahlreichen europarechtlich strittigen Fragen bezieht der Kommentar eigenständige Positionen auf der Basis europarechtlicher Auslegungsmethoden.
