This book presents a unique account of the social and political impacts of the German Basic Law on the German Republic from 1949 to the present day. It considers the way in which the history of the Federal Republic of Germany has been decisively influenced by its Constitution, the Basic Law of 1949, and by the jurisprudence of the Federal Constitutional Court. The book argues that the historiography of the Federal Republic does little to reflect this influence. The Basic Law is mentioned and so occasionally rulings of the Federal Constitutional Court. But the reader does not get the impression that they were of specific importance in Germany before and after reunification. Legal scholars, on the other hand, are concerned about the legal consequences of the Basic Law, but do not analyse its impact in the real world. There is, thus, a gap between the two disciplines - one not being familiar with social reality, the other not familiar with the normativity of the law. The history of the effectiveness of the constitution falls into this gap. In this book, Dieter Grimm, himself a Justice of the Federal Constitutional Court from 1987 to 1999 and an expert on interdisciplinary research in law, history and political science, guides the reader through important developments and events that were determined or influenced by the constitution and its judicial interpretation.

This book examines the persistence of blasphemy provisions, their increasing use in post-authoritarian Indonesia and the extent to which religion has been instrumentalised for political ends justified by law.Based on empirical research and an analysis of more than a hundred court decisions that connects evidence to theoretical discussions, this book traces the evolution and dynamics of capitalism in relation to the nature of legal order and the operation of laws, particularly those related to religion. Using an interdisciplinary approach, the author offers a rich analysis of the competing discourses on blasphemy in Indonesia. The work bridges the literatures of law and other social sciences. Providing an updated analysis of Indonesian blasphemy laws, this book also aims to shed light on the dynamics of legal order that affect how and why such laws exist. Rather than merely documenting regulations on and cases of blasphemy, the study aims to further understand the operation of law as a reflection of power relations. Specifically, the book reveals that the persistence of blasphemy laws has more to do with the illiberal nature of Indonesia's legal order, which renders laws that privilege religious orthodoxy a practical instrument for religious mobilisation for political purposes, than with the cultural distinctiveness of Indonesian society or the lack of modern bureaucratic and legal institutions supporting secularisation, as many scholars have argued.Offering original contribution to scholarship on blasphemy, the politicisation of religion and illiberalism in democracies, this book will be of interest to academics in the field of Asian politics, law and Southeast Asia studies.

Why socially responsible investment promises to make investors richer and the world better—but fails at both. Wall Street thrives by telling investors that clever financial strategies can reverse the trade-off between corporate profits and social progress. But the link between greater corporate social responsibility and improved financial performance is an illusion. Profit vs. Progress dissects the massive $30 trillion “socially responsible” or “sustainable” finance industry—and finds the emperor has no clothes. At best, sustainable investing typically delivers average rates of financial and social returns. But it makes social and environmental crises harder to overcome, by using financial gimmickry to distract our attention from real solutions. Author Brad Swanson argues that corporations in competitive markets act without moral values, and ethical investment can’t prod them to take greater social responsibility. The only way to change the outcome of the game is to change the rules. The solutions will have to come from legislatures, not corporate boardrooms. Swanson calls for public policies to make businesses better serve all of society, not just their shareholders—without blunting their edge. His recommendations include breaking up the cartel of large asset managers, rebuilding the influence of organized labor, curbing the rapacious behavior of the private equity industry, and eliminating the conflict of interest that pits corporate directors against the greater good of the community.
