This cutting-edge collection is a riposte to the deep assumption that law should be written exclusively for and by the reasonable person, as the person to whom law is addressed and by reference to whom laws are designed and calibrated. The book looks at how the social dimension of the human experience is central to human existence: connections with other people shape our lives in profound ways. While law confers formal status on certain relationships and intervenes to remedy serious injustices that occur, it does not generally concern itself with the individual as a person formed through those and other relationships. It is most often addressed to the individual, on the assumption that individuals are rational autonomous agents. It poses a deep challenge to that assumption. First, the collection opens space for conversation on the social dimension of the human experience in the context of law by critically considering existing conceptual tools that could support such a conversation, e.g., community, solidarity, associations,collective rights, and cosmopolitan law. Second, the collection takes an inventory of the extent to which law currently takes the social dimension of personhood into account in fields as diverse as criminal culpability, natural resources law, human rights, company lawand administrative justice. In moving beyond the fields that have already been the subject of post-individualist and post-autonomy discourse, such as family law and medical law, this collection is a vital contribution to igniting a broader conversation about the relationship between the sociable person and the law.

Mediation and Justice

By exploring the historic development of marriage laws and changing relationship norms in England, Qatar and Australia; the legal treatment of religious-only unions in light of the family law regime in each country, and the impact of non-recognition, this book reveals the complexities of the law reform needed to tackle these issues. This examination of the differing outcomes for couples who live in England/Wales where cohabitants have no legal rights, Australia where cohabitants do benefit from some legal protections, and Qatar, a Muslim majority state with a modern family law regime which ordinarily recognises religious marriages provides a broad canvas for exploring this issue in depth. The book looks at this very complex issue from a range of perspectives including autonomy, cultural transitions and legal pluralism. It examines the issue of religious-only marriages in order to convey the complex and interwoven narrative which signifies how multifaceted law reform must be in order to adequately respond to these transitioning relationship norms in any given jurisdiction. Of course, relationship norms are not static and they continue to evolve. In light of changing norms and practices, the theoretical framework for this book focuses on the concept of 'liminality' or transition, which is being witnessed in the processes and formalities by which Muslims are entering their marriages.

Obwohl erbrechtliche Konflikte häufig sind und oft mit gravierenden Folgen für die familiären Beziehungen einhergehen, beschäftigen sich künftige Erblasser selten aktiv mit der Planung ihres Nachlasses. Das Mediationsverfahren wird vor Eintritt des Erbfalls daher aktuell kaum genutzt. Dabei bieten sich Mediationen gerade im Erbrecht als Idealmodell der Konfliktlösung an. Die Arbeit zeigt auf, dass neben klassischen Mediationen auch dort ein mediationsanaloges Setting gewinnbringend eingesetzt werden kann, wo eine herkömmliche Mediation nicht in Betracht kommt, da etwa kein Konflikt vorliegt oder es infolge einer gewünschten Testamentserrichtung durch den Erblasser an Mitwirkungsmöglichkeiten der Erben fehlt. In diesem Zusammenhang werden verschiedene Möglichkeiten für die konkrete Ausgestaltung dieser Verfahren beschrieben. Da der Erblasser zudem durch die Aufnahme einer Mediationsklausel in der Verfügung von Todes wegen die Nutzung von Mediationen im Konfliktfall regeln und mithin eine effektive Konfliktvorsorge betreiben kann, werden schließlich unter Nennung von Formulierungsvorschlägen verschiedene Optionen für die Gestaltung von Mediationsklauseln analysiert.
