This open access book critically analyses a wide range of consumer law issues generated or exacerbated by the Internet of Things. The Internet of Things challenges many of the dichotomies which have shaped current laws: goods-services, hardware-software, tangible-intangible, online-offline. The book focuses on 4 specific challenges: things-as-service, liability, bricking of physical devices through software control, and the potential for enhanced personalisation, especially for digital assistants. The chapters analyse specific applications such as smart homes, connected cars, and consumer wearables with a view to providing innovative solutions to the new challenges posed by the Internet of Things, and to steer the development of the Internet of Things in a fairer direction. As well as offering an important analysis of the potential for smart consumer laws in the Internet of Things, the book also provides important insights into the growing divergence between Germany's and the UK's consumer laws since Brexit. Hart Monographs in Transnational and International Law

This book delves into the legal and labour history of the Hashemite Kingdom of Iraq to explore the role international law and its institutions played in Iraq's state formation. Focusing on a turbulent period in global and Middle East history, it shows how the case of Iraq became a laboratory for experimentation with the concept of sovereignty by the Permanent Mandates Commission of the League of Nations in Geneva. This resulted in the development of a doctrine of 'semiperipheral sovereignty' to justify Iraq's independence from the Mandate process. This novel doctrine and its operation within the provisions of the 1930 Anglo- Iraq Treaty ensured the maintenance of British dominance over Iraq, especially to safeguard the extraction and transportation of its valuable oil resources to Western markets. The book traces how this legal doctrine impacted the everyday lives of working class Iraqis. It explores the governance of the extraterritorial spaces of capitalist accumulation and labour exploitation, in particular the Iraq Petroleum Company oil fi elds, the Iraq State Railways and the Port of Basra. It goes on to detail how the oil, railway and port workers led by the Iraqi Communist Party effectively organised themselves into a nationalist revolutionary labour movement. They waged an anti-colonial struggle against these imperial legal structures to improve their lot, leading up to the 1948 Wathba, the 1953 Intifada, and ultimately the July Revolution of 1958, which upended the British-sponsored monarchy. Spanning various international archives and Arabic primary source materials, this book offers an example of a social, legal and labour history written from below, centering ordinary working peoples' agency in the historiography of international law. Drawing on Third World Approaches to International Law (TWAIL) and Marxist methodologies, it emphasises the signifi cance of the semi-periphery in the making of the international legal order.

Jaimie Morse traces how this assemblage was championed as a rights project in medicine, moving from the margins to the center of health care responses to sexual violence through new clinical standards of care, first in the United States and then in global humanitarian medicine. This book offers a fresh feminist perspective on prostitution. It challenges the 'sex work' perspective, drawing on experience from rape law and #MeToo campaigns in Ireland and elsewhere to develop a new legal concept of 'compromised consent'. This concept justifies the introduction of Nordic Model laws banning the purchase of sex. It recognises that an individual consent to sell sex is necessarily compromised by structural exploitation within the vastly profitable global sex industry. While 'sex work' proponents increasingly dominate academic discourse on prostitution, this book asserts that they have co-opted the language of feminism to mask the immense power and patriarchal control exerted by the industry. Their view of 'consent' is based on a dangerous premise. They cannot say that those who sell sex do so out of mutual desire; rather consent is portrayed as an expression of individual choice, thus ignoring the intersectional gendered collective context within which commercial sex transactions take place worldwide. By contrast, this book argues that presumptions of 'consent' in prostitution directly undermine the legal principles of affirmative consent and contemporary law reforms hard-won by feminist activists on rape and gender-based violence. A view of consent as 'compromised' within the sex trade derives from socialist theorising, as well as from legal re-conceptualisations of consent in other settings. It also reflects the reality of conditions within the sex industry. This book will be of great interest to students, academics, policy makers and feminist activists. It makes a significant contribution in challenging the dominant thinking within a highly polarised literature.
