Die Verhältnismäßigkeit von Umweltschutzmaßnahmen nach Art. XX GATT

'Proportionality of Environmental Protection Measures under Article XX GATT': Article XX of the General Agreement on Tariffs and Trade (GATT) allows a member of the World Trade Organization (WTO) to deviate from its trade-liberalization obligations for environmental reasons. This study demonstrates that Article XX GATT establishes a bright-line rule for assessing the proportionality of unilateral environmental measures adopted by a WTO Member. This rule derives from the provisions of Article XX GATT, taking into account the doctrinal nature of proportionality analysis.
