Die gestörte Option

'The Disrupted Option Right. Acomparative Law Study on the Subsequent Disruption of Equivalence of Option Rights': This thesis provides a comparative legal analysis of whether option rights can be adjusted or terminated due to changes in value that occur after the option right has been granted. It concludes that a corrective intervention is generally not feasible under both German law with regard to sec. 313 German Civil Code (BGB) and Austrian law in terms of sec. 934 Austrian Civil Code (ABGB) and the collapse of the basis of the transaction (Störung der Geschäftsgrundlage) which follows from the underlying risk allocation and the inherent legal principles of option rights.
