For centuries, the Latin notarial system has evolved in response to society's growing demand for legal certainty. Yet the increasing complexity of economic relations calls for a new stage in that evolution: a notarial system capable not only of ensuring legal certainty but also of realizing its full institutional potential to promote economic efficiency in private legal relationships through enhanced governance, conflict prevention, and the preservation of the contractual rationale built throughout the notarial process, so that disputes, when unavoidable, may be resolved consistently with the parties' legitimate choices, interests, and objectives.
 
 This book argues that such evolution requires neither abandoning nor replacing the historical foundations of the Latin notariat, but reinterpreting them in light of contemporary economic challenges. It introduces the Law-and-Economics Notary as the central institutional figure of the Law-and-Economics Notarial Paradigm, a new theoretical framework explaining how the civil-law notarial system can meet growing demands for economic efficiency while preserving the principles that have historically defined its identity.
 
 The book demonstrates that the Law-and-Economics Notary represents a new understanding of the notarial function. Public faith is conceived not only as an instrument of documentary authentication but also as a mechanism of private governance capable of structuring incentives, reducing transaction costs, mitigating information asymmetries and behavioral biases, strengthening trust among economic actors, and fostering more efficient, predictable, and socially beneficial legal relationships.
 
 Developed independently through the integration of law, economics, and notarial practice, the Law-and-Economics Notarial Paradigm later proved to converge with the evolutionary direction reflected in the studies and institutional agenda of the International Union of Notaries. This independent convergence confirms its capacity to explain and operationalize institutional transformations already emerging across the modern civil-law notariat.
 
 By integrating law, economics, and contractual governance, this book offers a new understanding of the notarial function and a coherent paradigm for the evolution of the Latin notarial system. Rather than replacing its traditional foundations, it demonstrates how they can be reinterpreted and further developed, thereby contributing to legal certainty, economic efficiency, preventive justice, and, ultimately, to economic development.

A Paradigm Shift in the Latin Notarial System

The Law-and-Economics Notary

This open access book brings together leading European labour law scholars to explore how workers' representatives' rights are evolving in the context of the digital transformation of work. Rooted in EU and national legal frameworks, the book examines how information and consultation (I&amp;C) rights must adapt to the challenges posed by platform work, algorithmic management, cross-border telework, and digitalisation more broadly. Structured around 4 key themes-Who is entitled to I&amp;C rights; Where these rights apply in transnational and virtual workplaces; How they are exercised in the context of AI, occupational safety, and industrial democracy; and What new rights are emerging in response to digital risks-the book offers a comprehensive and comparative analysis of labour law in the digital age. It pays particular attention to the role of workers' representatives in shaping and implementing emerging rights such as the right to disconnect. Drawing on the findings of the DIGILARE research project (EU grant 101126503), the volume provides actionable legal and policy insights for EU institutions, national lawmakers, social partners, and practitioners. It proposes reforms to strengthen democratic participation, enhance transparency in algorithmic decision-making, and safeguard workers' autonomy in increasingly fragmented and remote work environments. This open access book investigates the role played by copyright on the digitisation of cultural heritage from three angles: the theoretical differences between cultural property law and copyright; a comparative analysis of the EU, UK, and US; and analysis of current practices and concerns, based on empirical research. As heritage digitisation projects become increasingly common for purposes such as preservation and access, the impact of copyright is also becoming more problematic. In order to provide a full and current picture of the copyright problem, the book first introduces the reader to the debates on the scope and ownership of cultural heritage and provides an overview of the copyright implications of the digitisation process and newer uses, including 2D and 3D scanning; virtual and augmented reality; text and data mining; and artificial intelligence. The author then divides the main critical analysis into three parts, referred to as the 'clashes with copyright'. The first, clash in theory, lies between cultural property law and copyright justification theories. The second clash is in the different legal approaches to digitising in-copyright, public domain, orphan, out-of-commerce and unpublished works in the chosen jurisdictions, focusing on the relevant rights and defences. The third clash is in the interests of stakeholders, based on public reactions to existing projects and cases, supported by interviews with heritage professionals engaging in digitisation. By placing itself in this particular intersection of law, heritage, and technology, the book will be of interest to both intellectual property academics and cultural heritage professionals. This open access book critically analyses a wide range of consumer law issues generated or exacerbated by the Internet of Things. The Internet of Things challenges many of the dichotomies which have shaped current laws: goods-services, hardware-software, tangible-intangible, online-offline. The book focuses on 4 specific challenges: things-as-service, liability, bricking of physical devices through software control, and the potential for enhanced personalisation, especially for digital assistants. The chapters analyse specific applications such as smart homes, connected cars, and consumer wearables with a view to providing innovative solutions to the new challenges posed by the Internet of Things, and to steer the development of the Internet of Things in a fairer direction. As well as offering an important analysis of the potential for smart consumer laws in the Internet of Things, the book also provides important insights into the growing divergence between Germany's and the UK's consumer laws since Brexit.
