Das koreanische Rechtssystem enthält einen nichtendlichen, amorphen Aspekt, der sich nicht klar identifizieren lässt - und dennoch Teil jeder Rechtsordnung ist. Jurist:innen sollten ihn nicht verdrängen, sondern als integralen Bestandteil des Rechts verstehen und in ihre Praxis integrieren. Es reicht nicht, objektive Bedeutungen aus Gesetzen zu extrahieren - wichtig ist, das Gesetz aktiv und bewusst zu gestalten. Ein ausgewogener Rechtsansatz berücksichtigt sowohl geschriebenes als auch ungeschriebenes Recht. Er eröffnet einen demokratischen Diskurs darüber, welches Recht im Einzelfall als grundlegend gelten soll - besonders dort, wo Unterdrückung droht.
