Comparative Law Considerations on the Norwegian Wealth Tax

Tax practitioners are unfamiliar with tax theory. Tax economists remain unfamiliar with tax law and tax administration. Most textbooks relate mainly to the US, UK or European experiences. Students in emerging economies remain unfamiliar with their own taxation history. This textbook fills those gaps. It covers the concept of taxes in regards to their rationale, principles, design, and common errors. It addresses distortions in consumer choices and production decisions caused by tax and redressals. The main principles of taxation¿efficiency, equity, stabilization, revenue productivity, administrative feasibility, international neutrality¿are presented and discussed. The efficiency principle requires the minimisation of distortions in the market caused by tax. Equity in taxation is another principle that is maintained through progressivity in the tax structure. Similarly, other principles have their own ramifications that are also addressed. 


A country¿s constitutionalspecification of tax assignment to different levels of government¿central, state, municipal¿are elaborated. The UK is more centralised than the US and India. India has amended its constitution to introduce a goods and services tax (GST) covering both central and state governments. Drafting of tax law is crucial for clarity and this aspect is addressed. Furthermore, the author illustrates different types of taxes such as individual income tax, corporate income tax, wealth tax, retail sales/value added/goods and services tax, selective excises, property tax, minimum taxes such as the minimum alternate tax (MAT), cash-flow tax, financial transactions tax, fringe benefits tax, customs duties and export taxes, environment tax and global carbon tax, and user charges. An emerging concern regarding the inadequacy of international taxation of multinational corporations is covered in some detail. Structural aspects of tax administration are given particular attention.

Das Multilaterale Instrument verheißt als mehrseitiges Umsetzungsabkommen des BEPS-Projekts einen Epochenumbruch im internationalen Steuerrecht. Zunächst widmet sich das Werk der Konzeption, Funktionsweise und den Herausforderungen des internationalen Steuerrechtssystems. Nach eingehender Beschäftigung mit der Struktur des Multilateralen Instruments werden dessen Auswirkungen auf das bestehende System beschrieben. Dabei wird beleuchtet, inwiefern sich das Multilaterale Instrument als neue Koordinationsebene in das bilateral geprägte System des internationalen Steuerrechts einfügt.

The study of the Polish tax system and policy which enriches knowledge of developments in one of the largest and most rapidly changing states in Europe. It is the result of cooperation of academics and practitioners from major tax advisory firms as well as in-house tax experts.Political changes in Poland (electoral victory of the right-wing PiS party) coincided with changes on the global tax scene, which were associated with the BEPS project (Base Erosion and Profit Shifting), implemented by the OECD. The struggle to rebuild countries' tax revenues began. The ambitious social policy in Poland, which involved substantial transfers of funds to the less well-off, required an increase in budget revenues. Thus, the Polish government quickly became an ardent supporter of BEPS. The radicalism of the tax policy changes raised many doubts among practitioners, who accused the authorities of excessive fiscalism. On the other hand, the legal rules previously in force did indeed poorly protect the fiscal interests of the state.The study of the Polish tax system and Polish tax policy based on the contributions collected in this volume enriches knowledge of developments in one of the largest and most rapidly changing states in Europe.

Polish tax law in the post-BEPS era

Fair taxes or budget revenues at any price?

This book analyses the founding years of consumer law and consumer policy in Europe. It combines two dimensions: the making of national consumer law and the making of European consumer law, and how both are intertwined. The chapters on Germany, Italy, the Nordic countries and the United Kingdom serve to explain the economic and the political background which led to different legal and policy approaches in the then old Member States from the 1960s onwards. The chapter on Poland adds a different layer, the one of a former socialist country with its own consumer law and how joining the EU affected consumer law at the national level. The making of European consumer law started in the 1970s rather cautiously, but gradually the European Commission took an ever stronger position in promoting not only European consumer law but also in supporting the building of the European Consumer Organisation (BEUC), the umbrella organisation of the national consumer bodies. The book unites the early protagonists who were involved in the making of consumer law in Europe: Guido Alpa, Ludwig Krämer, Ewa Letowska, Hans-W Micklitz, Klaus Tonner, Iain Ramsay, and Thomas Wilhelmsson, supported by the younger generation Aneta Wiewiórowska Domagalska, Mateusz Grochowski, and Koen Docter, who reconstructs the history of BEUC. Niklas Olsen and Thomas Roethe analyse the construction of this policy field from a historical and sociological perspective. This book offers a unique opportunity to understand a legal and political field, that of consumer law and policy, which plays a fundamental role in our contemporary societies.

Studienarbeit aus dem Jahr 2021 im Fachbereich Jura - Steuerrecht, Note: 13, Albert-Ludwigs-Universität Freiburg, Veranstaltung: Seminar Steuerrecht für Jurist*innen, Sprache: Deutsch, Abstract: Diese Arbeit gibt zunächst einen Überblick über die Grundlagen der bisher geltenden Rechtslage zur Hinzurechnungsbesteuerung im AStG a.F. und den Grundfreiheiten der Niederlassungs- und Kapitalverkehrsfreiheit sowie deren Einschränkung und Rechtfertigung. Anschließend werden die wichtigsten Änderungen in der neuen Rechtslage dargestellt und diese jeweils auf mögliche Probleme in Hinblick auf das Europarecht untersucht. Dabei wird insbesondere auf die Frage eingegangen, woran die Hinzurechnungsbesteuerung zukünftig zu messen sein wird.Das Thema der Steuervermeidung durch internationale Konzerne ist immer wieder in den Medien zu finden.  Es wird geschätzt, dass dem deutschen Staat im Jahr 2018 mehr als 24 Mrd. Euro durch Steuervermeidung entgingen, dies entspricht etwa 29 % des Körperschaftssteueraufkommens.  Vor diesem Hintergrund ist der Gesetzgeber seit Jahrzehnten bemüht, die Steuervermeidung zu bekämpfen. Dazu wurde erstmals 1972 in Deutschland durch Inkrafttreten des AStG die Hinzurechnungsbesteuerung eingeführt. Sie enthält Regelungen zur Verhinderung der Verlagerung von passiven Einkünften ins niedrig besteuerte Ausland, welche rein aus steuerlichen Gründen erfolgen.  Mit dem Inkrafttreten des ATADUmsG am 01.07.2021 hat Deutschland fast genau fünf Jahre nach der Veröffentlichung der Anti Tax Avoidance Directive am 12.07.2016 die darin enthalten europäischen Vorgaben zur Steuervermeidung in nationales Recht umgesetzt. Dabei steht Deutschland als Mitglied der EU in einem Spannungsfeld zwischen der nationalen Steuerhoheit und europäischen Vorgaben.

Das Programme for the International Assessment of Adult Competencies (PIAAC) liefert erstmals international vergleichende Daten zur adaptiven Problemlösekompetenz Erwachsener in insgesamt 31 Ländern weltweit. Die adaptive Problemlösekompetenz ist entscheidend für die kontinuierliche Aneignung neuer Kenntnisse und gewinnt in einer Welt geprägt durch technologischen Fortschritt und zunehmender Komplexität an Bedeutung.
 

 Dieser Bericht untersucht die adaptive Problemlösekompetenz Erwachsener in Deutschland im internationalen Vergleich und setzt sie in Relation zur Lese- und alltagsmathematischen Kompetenz. Zudem werden Unterschiede zwischen verschiedenen Bevölkerungsgruppen - etwa zwischen Altersgruppen - beleuchtet sowie der Zusammenhang zwischen adaptiver Problemlösekompetenz und zentralen Merkmalen des Arbeitsmarktes betrachtet.
 

 PIAAC ist eine Studie der Organisation für wirtschaftliche Zusammenarbeit und Entwicklung (OECD), die grundlegende Kompetenzen Erwachsener im internationalen Vergleich untersucht. PIAAC wurde in Deutschland vom Bundesministerium für Bildung, Familie, Senioren, Frauen und Jugend (BMBFSFJ) unter Beteiligung des Bundesministeriums für Arbeit und Soziales (BMAS) gefördert. GESIS - Leibniz-Institut für Sozialwissenschaften verantwortete die Durchführung und Auswertung der Studie in Deutschland.
