Stabilization and Transformation of Law (16th-19th Centuries)

Diese Studie untersucht die Idee des "Schuldnerschutzes" im Hinblick auf ihre römischen Wurzeln und ihre Weiterentwicklung in modernen Rechtsystemen. Sie konzentriert sich auf den Begriff "favor debitoris" in den antiken Quellen selbst - bzw. auf seine Abwesenheit in denselben - und vergleicht ihn mit anderen "favores", die in den juristischen Texten nachweisbar sind. Igor Adamczyk kommt zu dem Ergebnis, dass die Römer sich von einem Prinzip des Schuldnerschutzes nicht leiten ließen. Das bedeutet aber nicht, dass sie dem Schuldner den Schutz immer absprachen, es waren vielmehr situative Rechtsmaßnahmen. 
Der Autor untersucht Beispiele solcher schutzwirkenden Rechtsinstitute in den europäischen Rechtsystemen. Dabei nimmt er vor allem die Entstehung des vereinheitlichten polnischen Schuldrechts in den Blick, das unter den Einflüssen v.a. des französischen, österreichischen und deutschen Rechts entstanden ist, die ihrerseits jeweils auf das römische Recht zurückgeführt werden können.

Favor debitoris

Mit der Eingliederung Deutsch-Westungarns als Burgenland in die Republik Österreich im Jahr 1921 entstand ein einzigartiger rechtlicher Übergangsraum. Über Jahre hinweg galt in der neuen österreichischen Region weiterhin ungarisches Recht, während zugleich eine schrittweise Angleichung an die österreichische Rechtsordnung erfolgte. Der Band beleuchtet diese außergewöhnliche Konstellation aus unterschiedlichen Perspektiven der Rechts- und Zeitgeschichte. Die Beiträge untersuchen unter anderem die internationalen Friedensverträge nach dem Ersten Weltkrieg, die politischen und rechtlichen Auseinandersetzungen um die Zugehörigkeit Westungarns sowie die praktischen Herausforderungen der Rechtsübernahme und der erstrebten Rechtsangleichung. Auf der Grundlage aktueller Forschungsergebnisse und bislang wenig erschlossener Quellen entsteht ein facettenreiches Bild einer Region zwischen zwei Rechtsordnungen und politischen Systemen.

The work presents a legal biography of the former Federal Constitutional Court justice Ernst Friesenhahn, offering for the first time a comprehensive assessment of his life and work. To this end, the study evaluates, among other sources, Friesenhahn's papers held in the Federal Archives in Koblenz as well as case files of the Federal Constitutional Court relating to proceedings in which Friesenhahn participated during his tenure from 1951 to 1963. This reveals the portrait of a constitutional lawyer who - having earned his doctorate under Carl Schmitt in 1928 and later breaking with him - emerged from the National Socialist period largely unscathed as a devout Catholic. Friesenhahn belongs to those figures who exerted considerable influence on the development of German constitutional law scholarship in the postwar era - especially in the field of constitutional procedural law - and who helped ensure that the prominent goal of establishing a rule-of-law state, as enshrined in the Basic Law, did not remain an empty promise. He advocated a form of legal positivism that was neither sterile nor ahistorical, but consistently oriented toward reality and practical life. At the Federal Constitutional Court, in his role as a "professor-judge," he ensured that the judgments of the Second Senate were coherent and rigorously reasoned. He played a key role in major cases of the Adenauer era, such as those concerning the European Defence Community Treaty, the Reich Concordat, and the "Deutschland-Fernsehen" case. As President of the German Jurists' Conference (1962-1966) and as Chairman of the Association of German Constitutional Law Teachers (1968 and 1969), he shaped constitutional law debates in the Federal Republic and, drawing on his own life experiences, credibly advocated for confronting the injustices of the National Socialist regime. As a co-founder of the Institute for Church-State Law of the Dioceses of Germany, he earned lasting merit in this field of law.

This book is a continuation of the prestigious series investigating current tax policy debates in an historical context. The authors are a mix of senior tax professionals from academia, the judiciary, and practice, with representatives from 9 countries. The chapters fall within 3 basic categories: 1. UK tax, looking at a variety of topics ranging from income tax (introduction and deduction at source), tax administration (Scotland), cases and judges (Lord Wilberforce), to the Peasants' Revolt, indirect taxation (tonnage tax and excise), and tax concepts (beneficial ownership). 2. International taxation, with chapters on the origins of the international income tax order, the UN (1950s and 60s), and VAT (origins and procedure). 3. Non-UK tax systems, including chapters on income tax in Singapore and early developments in Japan, South Africa (GAAR), an influential Canadian report (Carter Commission), taxation in classical Athens, and in the medieval Italian city-states. The first history of US federal law enforcement from the nation's founding to the creation of the Justice Department in 1870, showing how federal prosecutions have always been shaped by local institutions and interests. The public imagines the Department of Justice and its agencies as mighty juggernauts. The reality is strikingly different. The FBI is barely larger than the Chicago Police Department, federal courts handle far fewer cases than state courts do, and federal prosecutors rely heavily on state and municipal authorities. The feds cannot function without local support, which means that the projects on which DOJ intervention is most needed-the ones that local communities oppose or don't care about-are also those least likely to succeed. This is no accident. Fragile Authority shows that this weakness is built into the structure of federal enforcement. To understand why, Daniel Richman traces the present-day workings of the DOJ all the way back to the nation's founding. The system was so circumscribed at the start that districts went years without a single conviction; enforcement efforts were often just performances of sovereignty for foreign audiences. And while a stronger enforcement apparatus emerged from the 1850 Fugitive Slave Act, its protection of Black civil rights during Reconstruction lasted only a few years before the federal retreat. After its creation in 1870, the Justice Department concealed its limitations by turning the agendas of local police-such as prosecuting gangsters, car thefts, and prostitution-into ostensibly national priorities. For better and for worse, federal law enforcement missions without local buy-in remain rare and difficult to sustain. The resistance to President Trump's immigration enforcement surge in sanctuary jurisdictions showed yet again that this norm is not easily broken.

This volume explores the various intellectual property dynamics that emerged during the Cold War, circa 1946-1980. This period brought about some of the most poignant moments in the development of twentieth-century international intellectual property rights, when competing economic systems recognised the value in innovation, human creativity, cinema, and international intellectual property norms and institutions. Examining these developments from a Cold War approach can say much more as it allows for the examination of processes and norms that cater to strong domestic intellectual property rules in Western capitalism while yielding to 'universal' or 'common' property norms in copyright in socialist states. This volume connects some of the different advances made in the international emergence of these competing developments regarding intellectual property rights and emphasises the role of intellectual property institutions, processes, and universalism that helped keep Cold War rivals on the same normative, foundational street for intellectual property rights.
