The law codes in the Middle East North Africa (MENA) region are a well-crafted blend of civil and Islamic law in which civil law principles do not violate Islamic provisions. Yet, common law principles derived either from English common law or Islamic customary usages remain unidentified and thus ignored. Here, this complex scenario is rectified through a comparative analysis of the primary data (e.g. cases, statutes and arbitral award decisions), adding common law and uncodified Islamic custom to MENA law codes. The purpose of this comparative analysis is to allow common legal principles found in civil, common and Islamic law to be distilled in order to create a new, harmonised international commercial arbitration law code (HICALC) or uniform Arab arbitration law (UAAL) for adoption in the MENA region, where these principles already greatly influence the legal systems and can be readily assimilated into a harmonised or uniform code. The work demonstrates that this new code would lead to improved arbitral award enforcement in the MENA.

A Model Harmonised International Arbitration Law Code for the Middle East and North Africa

This open access book examines the role of international law in Central Asian affairs and sheds new light on human rights issues in Central Asian politics. It provides various case studies on Central Asian countries, including Kazakhstan, Kyrgyzstan, Tajikistan, Turkmenistan, and Uzbekistan. The book is divided into eight parts: Part I sets the context, and places the subsequent chapters in a broader context of decolonisation and development. Part II offers an overview of the role of international law in Central Asia, its relationship with domestic law, and the role of international organisations in its development in the region. Part III discusses selected issues pertaining to regional security. Part IV discusses some human rights developments in Central Asia, including social and economic, labour, digital, and family rights. Part V is devoted to international criminal law, and offers an overview of Uzbekistan´s experience in combating money laundering. Part VI on international trade and investment law discussed the WTO rules on fisheries subsidies, taxation in Central Asia, and stabilisation clauses in mining contracts. Part VII deals with international legal standards of animal welfare, and discusses several environmental case studies in Central Asia. Finally, Part VIII discusses the role of international law as an academic discipline in the region.

This book examines the self-help in contemporary society. The aim is to demonstrate the misconception of associating self-help only with physical violence, illegality or seeing it as a mere instrument for the stronger to overpower the weaker. For some years now, the subject has been receiving a significant&nbsp; attention, with with the emphasis being placed on the need to protect rights unilaterally&nbsp;. To give the reader an idea of its importance, it is difficult for anyone not to suffer or fail to practice self-help in their daily lives, often without realizing it. Several examples could explain not only this reality, but above all the relevance of studying the subject. However, one is enough: the growth of self-regulated environments, notably social networks and digital platforms, has brought about intense transformation in the lives of people, companies and public institutions, and much of the governance of these environments depends on self-help, such as restricting speech freedom, blocking profiles that disseminate illegal content or false information, etc. The growing concern with the means of conflicts resolution highlights the need to understand the role of self-help&nbsp; in contemporary times, especially in order to overcome many myths that still surround it and to define its limits within the Rule of Law. &nbsp;

Adopting a multidisciplinary approach to climate adjudication, this open access book addresses how adjudicators decide cases by considering the influence of psychology, philosophy, legal education, film, literature, political economy, political ecology, judicial appointments, history, and climate science on their decision-making and ultimately on the (inconsistent) outcomes in climate cases. Drawing upon the humanities, science of climate change and/or social sciences to identify extra-legal factors that may drive the decision-making processes and outcomes of climate cases, this book uses case studies from different jurisdictions across the globe, addressing climate cases decided or pending in Africa, Asia, Europe, Latin and North America, and Oceania. Should deep seabed mining (DSM) stop or proceed? The international community is now facing a difficult choice. No matter what decision is made, environmental consideration is the core of the issue. This book tackles the compelling question of how to secure the marine environmental protection in DSM from an international law perspective. It deals with two major research questions: What are the international environmental requirements of participants - the contractor, the sponsoring State and the International Seabed Authority (ISA)? What are the legal consequences for them when environmental damage occurs? In doing so, it analyses the international DSM legal regime and general international environmental principles, observes the functioning of the ISA, and draws on law and practice of various environmental treaty mechanisms.
