The book provides a comprehensive overview of how transparency is addressed within EU law, with a particular focus on EU food law. This contribution is especially relevant in light of Regulation (EU) 2019/1381 on the transparency and sustainability of the EU risk assessment in the food chain. In recent years, growing public concern over a perceived lack of transparency, further highlighted by the results of the ‘Fitness Check’ of the General Food Law, has sparked interest in this issue. Beyond this focus, the book adopts a broader approach by examining transparency as a multifaceted concept closely tied to democracy, accountability and other values. Recognising that transparency obligations may extend beyond public authorities, it further explores whether transparency can be applied to the private sector and identifies potential constraints on private actors. Through a conceptualisation of transparency in law and with an innovative analytical approach to legal texts and case law, the book provides researchers, private organisations and institutions with an extensive and nuanced understanding of transparency.

This book analyses the roots and evolution of the concept of sustainability in Europe and the&nbsp;European Union.&nbsp;As sustainability has always mirrored certain value judgments on justice and priorities, it is suitable for functionalist, analytical, contextual and historical comparisons via multidisciplinary studies combining various branches of the social sciences, law, philosophy, and economics.

The aim of this book is to explore the roots and evolution of sustainability, so as to reveal how a European style of sustainability has emerged, one that is inextricably linked to our civilization and history. It identifies linear and cyclical phases with clear trends toward expanding the reach of sustainability, its subjects and their duties. The book offers a&nbsp;multidisciplinary, chronological and contextual overview of the evolution of sustainability until the 21st century, while also addressing its legal regime. Sustainability has many faces and needs to be approached in a dynamic manner through the lens of sustainable development or via a multi-stakeholder model that includes private subjects and corporate social responsibility.

Although primarily intended for an audience with an advanced background in law, economics and philosophy, the book will also benefit a more general audience, particularly those who want to learn where the current sustainability concerns and legal regime actually came from.

This book presents a comprehensive analysis of causation in climate change litigation across a range of regional, national and international legal jurisdictions.&nbsp;By doing so, it offers clarity and potential solutions for legal professionals, scholars and courts navigating the complex legal terrain of climate change litigation.Constructing causal chains in climate litigation poses significant difficulties for the judicial system. Factual challenges range from causal overdetermination to the vast spatial and temporal scale of climate-related cause-and-effect relationships. Normative obstacles are posed inter alia by the multitude of greenhouse-gas emitters and the wide range of climate-influencing practices.&nbsp;Drawing on diverse understandings of causation from various legal perspectives, as well as from other disciplines such as computer science, metaphysics and philosophy, this book provides a fundamental understanding of climatic causation in law. Further, it lays the groundwork and clarifies the requirements for the use and development of continuous causal chains in climate change litigation.

The Aarhus Convention

For the last seventy years, upstream petroleum concessions have been granted worldwide by states to investors, in order to facilitate petroleum exploration and production for the state's benefit, but at the investor's risk and expense. This process has had to evolve in order to accomodate the increasing transition to net zero carbon forms of energy. This book examines the use of petroleum concessions, provides a guide to how they are granted, and how they could develop to accomodate the energy transition. The book is split into three parts. Part A focuses on the relationship between the existing forms of concessions and the transition to net zero carbon emissions. It considers the logic from nation states for the use of concessions by states, as well as the form and mechanics for awarding them. Later chapters assess the impact of the transistion to net zero carbon emissions, the risks which it presents to states and investors, alongside examples of state-sponsored withdrawals from future petroleum exploration and production. Part B offers a guide to the typical content of concessions. It examines the concession's scope, duration, area and how it is modified. The obligations and required standards of both the investor and the state are considered, as well as the fiscal terms (including taxation) and non-fiscal benefits which can accrue to the state under any deal, before considering any constitutional provisions included within the concession. Part C concludes by theorising how the mechanics and award of current and future concessions could be modified by a state, how clean gas commercialisation could be better promote, and how the role of the state's national oil company could be utilised to better position the state to manage the energy transition.
