Legal Responses to Space Resource Utilisation

This book analyses the ways in which Article 9 of the Aarhus Convention enables environmental access to justice in the Balkans, a region at the epicentre of extreme climate change events. Adopting a law-in-context approach, the chapters explore national cultures and driving forces shaping the implementation of Aarhus standards in Albania, Croatia, North Macedonia, Romania, Slovenia and Serbia, paving the way for their comparative assessment. The book combines EU law and the case law of the European Court of Human Rights with the bottom-up Europeanisation brought about by rising environmental protests and the activism of civil society organisations in the region. Globalization has created a new reality in the image of the new-age truth—the reality of pluralism which has transformed the way human relations have been organized. There has been a surge of new values and new ideas. All these have collectively formed a new consciousness. This book captures the said consciousness in its totality through its various manifestations in various domains on human socialization. The authors of the book provide broader generalizations on globalization, situating it through various standpoints, and particular analyses of how globalization has impacted particular domains. Administrative procedure is often perceived as a nuisance by those involved: by individuals seeking an action, service or permission from the state as well as by members of the administration wanting to pursue an action against an individual or refusing to act in her favour. Both sides may view administrative procedure as an unwelcome hurdle on their way to reach their objectives. This perception, however, clouds the value and importance of administrative procedure for the individual in modern legal systems. It is not an end in itself but protects individuals against arbitrary state action.
This book explores the connection between international human rights law and administrative procedure. In particular, it discusses potential justifications for obligations of administrative procedure under international human rights law, their doctrinal construction, and their implementation as well as the scope of review of courts.
