Can Europe Survive?

The Story of a Continent in a Fractured World

Die 1941 gegründete Kontinentale Öl AG sollte die Ölquellen des Kaukasus ausbeuten und damit die Grundlage für den von den Nazis erträumten Endsieg legen.

Der Zweite Weltkrieg war ein Krieg der Panzer, Lastkraftwagen und Flugzeuge. Öl bildete die unverzichtbare Grundlage für die Feldzüge. Das Deutsche Reich verfügte nur über geringe Vorkommen und war deshalb auf die Eroberung einer Ölbasis angewiesen. Die 1941 gegründete Kontinentale Öl AG sollte ein Gegengewicht zu den großen alliierten Ölkonzernen bilden und vor allem die reichen Erdölquellen des Kaukasus ausbeuten. Da dieses Gebiet jedoch nicht dauerhaft besetzt werden konnte, mussten sich die Nationalsozialisten mit anderen europäischen Regionen - Rumänien, Galizien, Estland - begnügen.
Das halb staatliche, halb privatwirtschaftliche Unternehmen band alle relevanten wirtschaftlichen, staatlichen, politischen und militärischen Interessengruppen ein. Die 'Konti' bildete so ein Modell für künftige, 'kontinental' orientierte Konzerne. Die hochfliegenden Zukunftspläne standen im Kontrast zum operativen Scheitern der Kontinentalen Öl AG. Insgesamt eröffnet die Geschichte dieses Unternehmens einen neuen Blick auf die NS-Wirtschaft, die herrschende Klasse des Regimes, also die hochrangigen Vertreter aus Wirtschaft, Partei, Militär und Staatsbürokratie, und die politisch-militärischen Entscheidungen. Er ist dazu geeignet, vermeintlich gesicherte Erkenntnisse über das Verhältnis von Politik und Ökonomie infrage zu stellen.

Cornerstone on Gangs

This book analyses recent developments in English corporate restructuring law from a range of comparative and theoretical perspectives, exploring some of the most difficult aspects of the design of domestic restructuring laws and their application in cross-border cases. Recent reforms to English law took place against the backdrop of corporate restructuring law reform initiatives in Europe and in many other regions of the world. These reforms reflect an emerging consensus as to the importance of such laws, both as a complement to macroeconomic stabilisation tools in times of extraordinary crisis, and as a determinant of investment conditions in more ordinary times. But it is one thing to recognise the importance of such laws in the abstract, and quite another to work out precisely how corporate restructuring rules should be designed. This book explores some of the most complex aspects of designing such rules. It does so primarily through the close analysis of the changes made by the enactment of the Corporate Insolvency and Governance Act 2020 (UK), and the interpretation of the new statutory provisions by the courts, although chapter authors draw extensively on examples from other jurisdictions to critically analyse choices made in the UK, and in some cases offer separate evaluation of restructuring law reform processes outside the UK, including in select jurisdictions in the EU and in Africa, and in the US. By drawing on experiences in other jurisdictions, and on insights from theory, the book casts new light on recent developments in English law, suggesting many avenues for further research and a range of implications for policymakers. These implications are brought out in an introductory chapter by the editors introducing the landmark 2020 reforms. This chapter provides a detailed synopsis of each chapter of the book, drawing out connections between them, and articulates some themes that run through the chapters that are salient for policymakers.

Corporate Restructuring Law in Flux

This book fills a gap in the existing literature by providing a thorough assessment of EU regulations as a source of secondary legislation and their application in all twenty-seven Member States. It also explores that application in neighbouring countries. EU regulations are perceived as the strongest and the most effective sources of EU secondary legislation and it is well-established by the Court of Justice of the European Union that their provisions have vertical and horizontal direct effect. Part 1 of this book examines these points, providing a backdrop to the analysis in the remaining chapters. This shows that lobbying is problematic when institutions are diverted from acting in the public interest. It reveals why diversions happen, how they are linked together, and what can be done to prevent them. The reader can use the 'Diversion Guide' to identify any problem about lobbying, and test when an officeholder has been diverted from acting in the public interest. The book examines how lobbying can encourage citizen participation and lead to informed law and policy, but is not always fair. It considers the way in which wealthy and influential people can gain greater access to the United Kingdom's political system than most to shape the laws that govern everyone. Scandals are often reported in the media surrounding unequal access, corruption, the revolving door, and more. Unchecked, such lobbying corrodes trust in public institutions. It is vital that the problems surrounding lobbying are clearly understood to avoid a system of weak regulations and to ensure that better regulations are created to restore public trust in politics. Governments around the world are privatizing everything, with dramatic but largely ignored negative consequences for human rights. This open access book outlines the response that is urgently needed. Corporations are being given control over water, healthcare, housing, public transportation, child welfare services, aged care, and much else. Privatization is promoted by international financial institutions, consulting firms, and development actors as the answer to public finances devastated by the very tax cuts insistently pushed by these groups. Their pitch is based upon a mythology that extols the virtues of an idealized market while ignoring the heavy human rights costs incurred. Building on the latest evidence and on specially commissioned case studies, this book shows how the touted 'efficiency' of the private sector is often predicated on higher charges and/or reduced services, destructive employment practices, and the highly predictable exclusion of many users. Privatization generally costs states more money, marginalizes democratic decision-making, and transforms citizens from rights-holders into customers while sidelining accountability. The authors develop an approach designed to enable human rights actors, including courts, UN treaty monitoring bodies, and NGOs to move beyond their longstanding agnosticism towards privatization. It starts with a presumption that privatization is inherently retrogressive in human rights terms. Whatever mix of public and private is reflected in any given arrangement, governments must retain the degree of control necessary to ensure respect for rights, and the legal, financial and administrative ability to do so. The book charts a new direction for responding to the ever-growing threat that privatization poses to human rights.
