'Guarantee and Litigation': The study uses the guarantee to analyse the extent to which judgements can have an effect on third parties. Whilst the recognised benefit of the guarantor by a final judgement which rejects the creditor's action for performance against the principal debtor can be put on a substantive legal basis (reflex effect of res judicata), a conviction of the principal debtor does not in principle affect the guarantor either procedurally or substantively.
