Rügemer W: Broken USA

Broken USA

Nils Minkmar

Das Camembert-Diagramm

The first history of US federal law enforcement from the nation's founding to the creation of the Justice Department in 1870, showing how federal prosecutions have always been shaped by local institutions and interests. The public imagines the Department of Justice and its agencies as mighty juggernauts. The reality is strikingly different. The FBI is barely larger than the Chicago Police Department, federal courts handle far fewer cases than state courts do, and federal prosecutors rely heavily on state and municipal authorities. The feds cannot function without local support, which means that the projects on which DOJ intervention is most needed-the ones that local communities oppose or don't care about-are also those least likely to succeed. This is no accident. Fragile Authority shows that this weakness is built into the structure of federal enforcement. To understand why, Daniel Richman traces the present-day workings of the DOJ all the way back to the nation's founding. The system was so circumscribed at the start that districts went years without a single conviction; enforcement efforts were often just performances of sovereignty for foreign audiences. And while a stronger enforcement apparatus emerged from the 1850 Fugitive Slave Act, its protection of Black civil rights during Reconstruction lasted only a few years before the federal retreat. After its creation in 1870, the Justice Department concealed its limitations by turning the agendas of local police-such as prosecuting gangsters, car thefts, and prostitution-into ostensibly national priorities. For better and for worse, federal law enforcement missions without local buy-in remain rare and difficult to sustain. The resistance to President Trump's immigration enforcement surge in sanctuary jurisdictions showed yet again that this norm is not easily broken.

Fragile Authority

From a renowned legal scholar, a new vision of how the judiciary has reconfigured rights and power. Ambitious and erudite, The Power Revolution is a new challenge to conventional wisdom from one of our most prominent constitutional scholars. Philip Hamburger's prior scholarship initiated the current judicial reconsideration of the administrative state. Here, he makes the broader point that the acclaimed rights revolution has been accompanied by a much more substantial power revolution-a vast judicial expansion of government power and a corresponding judicial erosion of rights. The slant toward power goes much further than has been understood, and because it cuts across much of the Constitution, its effects are sobering. It threatens both our freedom and our government. It even undermines the nation's stability. It's therefore important to understand the contemporary realities of unconstitutional power, not just our old constitutional ideals. In observing the judiciary's responsibility for how we are governed now, The Power Revolution calls upon Americans to push back against unconstitutional power and urges the judges to reconsider what they have done. After so much damage to the Constitution, it is time for repair.

Previously known as Drafting Agreements in the Biotechnology and Pharmaceutical Industries, this title provides precedent agreements for the main types of commercial transaction encountered in the life sciences, biotechnology and pharmaceutical industries. In addition to the print version, each precedent is available via an accompanying website in a format which can be easily downloaded and edited. Detailed commentary on legal, commercial and practice issues accompanies every precedent. Provided by specialist lawyers from across Europe, this commentary also highlights important differences between English law and that of other key EU jurisdictions: Germany, France, the Netherlands, Spain and Sweden. Commentary on specific considerations for the US is also provided. In addition to precedent commentaries, the book also contains detailed commentary and discussion of legal issues common to the life sciences, biotechnology and pharmaceutical industries, as well as links to relevant materials (eg regulatory materials on clinical trials). This title is included in Bloomsbury Professional's Intellectual Property and IT online service.

Information Technology and Global Governance

AI has moved from science fiction to the core of modern governance. It has become increasingly integrated into city governance, public services, policymaking, and crisis management, leaving public managers to navigate efficiency gains alongside accountability gaps and algorithmic bias.
AI for Better Government
—
Essential Insights for Academics and Practitioners
addresses this tension by treating AI governance as a living ecosystem. It also takes an innovative, interdisciplinary, and international approach to explore the rapidly evolving role of AI in public policy and management worldwide.

Written from a pracademic perspective, this book brings together global leading academics and practitioners. Drawing on case studies and real-world examples, it equips readers with tools needed to navigate the complexities of AI adoption for better government outcomes. Each chapter ends with “Questions for Reflection” to fuel active learning and organizational readiness audits. Whether you are a student entering public service, a policymaker weighing decisions, or a researcher mapping digital governance, this book meets you wherever you are.

Essential Insights for Academics and Practitioners

Artificial Intelligence for Better Government

This book examines how digital transformation, flexible work arrangements, and institutional change are reshaping organizations in the public sector and beyond. Drawing on transaction cost economics, institutional theory, public management scholarship, organizational theory, and research on virtual and hybrid work, the book analyzes the opportunities and challenges associated with new forms of work in the digital age.

Moving beyond debates over whether telework and flexible work arrangements are beneficial, the author investigates the organizational and institutional conditions under which smart work programs can enhance productivity, employee well-being, inclusion, and organizational resilience. Particular attention is given to the managerial and institutional challenges associated with remote and hybrid work, including trust, accountability, collaboration, organizational culture, leadership, fairness, and social isolation. The author identifies often-overlooked coordination and governance costs that emerge in digitally enabled workplaces and explores strategies for reducing these barriers through effective organizational design and institutional support.

Combining theoretical analysis with empirical evidence and illustrative cases from government and industry, the book develops a framework for understanding how organizations can adapt to technological, social, and environmental change while maintaining effective workforce management. As such, it will be of interest to researchers and students in public administration, public management, organizational studies, human resource management, and digital governance, as well as practitioners responsible for leading and managing hybrid and remote workforces.

American Studies Now: Critical Histories of the Present

How policing has fundamentally shaped the Latinx experience. The history of Latinx groups in the United States has been marked, from the beginning, by experiences of criminalization and violence at the hands of law enforcement. Marisol LeBrón argues that policing has left an indelible mark on Latinx communities across the country and has come to shape our understanding of what it means to be Latinx. Spanning the nineteenth century to the present, Policed examines how policing became a key component in the formation of Latinx identity and political consciousness, and still lies at the heart of many pressing issues confronting Latinx communities today, including immigration, employment, health, and housing. More than simply telling a story of police brutality and harassment, LeBrón powerfully shows that Latinx people have continually resisted state violence and worked to build a more liberated future.
