Corruption and anti-corruption have long been central public concerns in China, yet the organizational mechanisms through which corruption and anti-corruption operate remain poorly understood. This book takes bribery-offering by unit as its analytical entry point and combines a systematic analysis of 3,886 publicly released court records with in-depth interviews with judges, prosecutors, disciplinary and supervisory officials, and lawyers.
Focusing on visible court records, the book shows how corruption is produced and normalized at the organizational level, moving beyond explanations that reduce bribery to individual moral failure or market exchange. It introduces the perspective of “invisible corruption” to explore why certain bribery practices never enter judicial proceedings. By reconstructing the cognitive frameworks and professional reasoning of legal practitioners, it analyzes how organizational bribery is understood, categorized, and processed in judicial practice, and how legal decision-making is shaped by institutional constraints, political pressures, and organizational contexts. Situated at the intersection of sociology of law, organizational studies, and corruption research, this book offers new empirical and theoretical insights into China’s anti-corruption system.

Ius Gentium: Comparative Perspectives on Law and Justice

This book traces, assesses and compares the history of conscientious objection – in the cultural context of eight developed democratic nations – from refusal of military service and a range of similar moral dilemmas, to objecting to abortion, to vaccination hesitancy and contemporary warfare. It considers the impact of this form of dissent in relation to social movements, social activists and whistle blowers. It reflects on the relationships between the sacred and the secular, the state and the citizen, in order to better understand the responsibilities of citizenship in our increasingly secular societies. It analyses what defines the conscientiousness of an objection from both legal and ethical standpoints. It explores the increased reliance on “grounds of religion, belief or conscience” as providing justification for excusing some citizens from complying with certain responsibilities – mandated by equality and non-discrimination legislation – that are binding for all others. By conducting a comparative evaluation of national law and judicial rulings on a fixed agenda of issues, this book identifies key jurisdictional differences concerning conscientious objection. In so doing, it highlights the importance of cultural context and constructs a jurisdiction-specific overview of legislation, policies and case law. By tracking policy developments and highlighting crucial judicial rulings – particularly in the US – it provides insights into the probable future direction of developments in national law relating to conscientious objection. Lastly, the book draws attention to some of the potential consequences of manifesting dissent by opting out of performing public services: the possible local breakdown of specific service availability (e.g. abortion); prompting population movements as established democratic civil rights are locally negated; fragmenting society into a geographic patchwork of regions in which some citizens are branded as conservative/reactionary and others as progressive. Conscientious objections carry profound implications for a coherent democratic society.

This volume brings together the revised and peer reviewed scientific contributions presented at the 5th Conference on Comparative and International Law (27 June 2025), jointly organized by the Law Center of the Catholic University of Petrópolis (Brazil) and the Society of Juridical and Administrative Sciences.
The book explores the intersections between law, ethics, and human vulnerability through a transnational and comparative lens, addressing some of the most pressing challenges of our time: technological risks, equality and responsibility in evolving legal frameworks, and the pursuit of justice in the fields of human rights and international criminal law.
The volume is structured into three thematic parts: (1) Technology, Risks and Global Governance – examining how global administrative law, artificial intelligence, and medical innovations such as xenotransplantation generate both opportunities and existential risks, thereby calling for renewed forms of international regulation and ethical responsibility. (2) Responsibility, Equality and Comparative Legal Perspectives – engaging with philosophical and legal perspectives on responsibility, analysing authority and social hierarchies within civil law traditions, and evaluating the principle of equal opportunities between women and men in electoral law from comparative angles. (3) Justice, Human Rights and International Criminal Law – addressing forgotten or ongoing struggles for justice, the contested authority of the International Criminal Court, and the strengths and limitations of climate change litigation as a mechanism for advancing environmental justice.
The central theme of the book is how legal and governance frameworks can address human vulnerability in a rapidly changing global context, where ethical dilemmas, technological disruptions, and structural inequalities converge. Its relevance lies in its ability to connect theoretical insights (legal philosophy, comparative analysis, ethics) with practical challenges (international justice, technological governance, gender equality), thereby offering both critical reflection and policy oriented perspectives.
The volume aims to contribute to addressing the tension between global responsibility and local governance by providing comparative knowledge and highlighting pathways toward more equitable and accountable systems of law and regulation. The target readership includes academics, researchers, PhD candidates, practitioners in international and comparative law, and policymakers interested in the evolving interplay of ethics, vulnerability, and governance in shaping law’s response to contemporary global challenges.

Corina Giacomello is Professor of Sociology of Law at the Institute of Judicial Studies of the Autonomous University of Chiapas, Mexico. She is an academic and international consultant with expertise in gender studies, children’s rights, criminal justice and prison systems and drug policies. She has 20 years of experience in advocacy-oriented research and development of legal, judicial and public policy proposals at the national and international level.

Adopting a multidisciplinary approach to climate adjudication, this book addresses how adjudicators decide cases by considering the influence of psychology, philosophy, legal education, film, literature, political economy, political ecology, judicial appointments, history, and climate science on their decision-making and ultimately on the (inconsistent) outcomes in climate cases.
