Repairing American Government Amid Debilitating Partisan Strife

This book brings together leading experts on the United Kingdom's constitutional arrangements to show how the constitution works, the role played by actors, and the scope for reform. The experts are practitioners from the fields of law and politics, and include former judges, ministers and law officers, parliamentarians, a law commissioner, barristers, a former clerk of the House of Commons, Lord Speaker, First Minister of Wales, and the Prime Minster of New Zealand. Each contributor has been, or is, a constitutional actor and their chapter draws upon this unique first-hand experience. In addition to contributions on the UK Constitution, there are three comparative chapters that explore constitutional reform in Jamaica, and the constitutions of Denmark and New Zealand. The chapters explore issues and themes such as devolution, protecting standards in public life, breaches of political trust and the role of the law, House of Lords reform, the role of the law officers, the role of the Law Commission, the Supreme Court as a Constitutional Court, and the experiences of those working in Parliament. Constitutional Actors in the UK Constitution

This book provides a detailed account of each law officer's functions and draws on that account as the basis for a conceptual analysis of their constitutional legitimacy. In recent years, the constitutional legitimacy of law officers has been questioned repeatedly because of recurring controversies surrounding the discharge of their varied functions. Indeed, it has become increasingly clear that those functions enable law officers to play a highly influential part in the regulation and exercise of public power throughout the United Kingdom. McCormick argues that the most persuasive framework for analysing the offices which make up this diverse regime involves concentrating on the constitutional values of independence, accountability and trust which underpin it. Both aspects of the book - namely the explanation of individual functions and the conceptual analysis of collective legitimacy - are written in a holistic way which encompasses critical analyses about the Attorney General and Solicitor General for England and Wales; the Counsel General for Wales; the Lord Advocate, Solicitor General and Advocate General for Scotland, as well as the Attorney General and Advocate General for Northern Ireland.

Modern constitutionalism as an idea and practice is facing great uncertainty in current times. Scholarly debates focus predominantly on constitutions beyond the state, while the predicament of domestic constitutionalism is much less considered. This volume contributes to a theoretically informed analysis of the key challenges and changes affecting domestic constitutionalism in Europe and beyond, departing from the idea of 'constitutional acceleration' or the increased propensity of different actors to engage in (formal) reform of the constitutional order. The volume points to a fundamental change in the function of constitutions in that constitutions themselves are increasingly subjects of political contestation rather than framing political debates.


The collection of essays addresses a range of critical challenges - including societal acceleration, depoliticization, civic engagement, multi-faceted constituent power, modernization, populism and nationalism, and transnationalization. The volume includes a variety of disciplinary, and in some cases interdisciplinary, approaches, including (political) sociology, political science, constitutional law, and constitutional and legal theory, and will be of interest to researchers and students in any of these areas. Case studies focus on the EU and the wider European context, and include highly relevant but little known or ill-understood cases, such as the recent constitutional events in Iceland, Italy, or Romania, and cases of democratic reversal, such as Hungary, while also engaging with traditional but rapidly changing cases of constitutional interest, such as the UK.

This volume originates from the fourth Public Law Conference, held in Dublin in 2022.
