Die vorliegende Dissertation befasst sich mit der Frage, ob und in welchen Fällen Verletzungen des Rechts auf Gesundheit die Flüchtlingseigenschaft begründen können.
Dazu untersucht sie ausgewählte theoretische Aspekte des Rechts auf Gesundheit, die im flüchtlingsrechtlichen Kontext relevant sein können. Die Dissertation basiert auf einem menschenrechtlichen Verständnis des Verfolgungsbegriffs, wonach eine Verfolgung in einer schwerwiegenden Verletzung von Menschenrechten gesehen wird. Dazu werden entsprechende praktische Fälle - vorwiegend aus der angelsächsischen Rechtsprechung, da diese Auslegung des Flüchtlingsbegriffs dort weit verbreitet ist - aufgezeigt, in denen das Recht auf Gesundheit verletzt und eine Verfolgung bejaht wurde.

This book is the first investigation of the relationship between EU digital sovereignty and sustainability strategies. It maps the ambitions and limitations of EU digital strategic autonomy and explores the structural challenges underlying its relationship with its green transition objectives in the context of the ongoing wars in neighbouring European countries and the consequent tensions in the EU energy sector. The EU is racing to achieve technological independence from third countries and foreign multinational companies to protect its digital sovereignty and preserve its fundamental rights. In the EU, digitalisation and the green transformation are seen as twin transitions. Yet, EU digital sovereignty strategies have a significant environmental cost. Reaching a status of strategic autonomy of the EU at the level of digital infrastructures, products, services and data implies higher energy consumption and exploitation of natural resources. Moreover, the geopolitical tensions following the Russian invasion of Ukraine have provoked an unprecedented energy crisis, which is affecting EU economies and impacting objectives of the twin transitions. The book offers an interdisciplinary analysis of the major EU regulatory and policy instruments in this field, providing an invaluable guide for academics, practitioners, and policymakers navigating the complex issues of preserving digital sovereignty and addressing climate change in times of war and energy crisis.

This book provides an in-depth legal examination of limited partnership in the context of China's venture capital and private equity market. It aims to provide an authoritative and timely evaluation of the Chinese partnership law and limited partnership regime and will be a valuable tool for practitioners who need a readily available source of information on Chinese partnership law and those who wish to understand how the Chinese partnership regime operates and functions. The book explains the essential characteristics of Chinese partnership law and Chinese limited partnership, highlighting difficult and developing areas by examining relevant legislation and recent cases. In addition to Chinese authorities, it also covers legislation and cases from overseas jurisdictions, such as the UK and the US. New developments such as the amendments to the PRC Partnership Enterprise Law 2007, new legislation and regulations on foreign partnerships and private equity funds are also covered. The book explains the essential areas of Chinese limited partnership such as management and control, duties and liabilities of partners, remedies for limited partners, dissolution, liquidation and taxation. Based on thorough comparative and empirical studies, the book examines existing and potential legal problems under the current law and offers key proposals for practitioners and lawmakers. This book retraces the emergence of conceptions of authorship in late-eighteenth-century Germany by studying the material form of Immanuel Kant's 1785 essay, 'On the Wrongfulness of Reprinting'. Drawing upon book history, media theory, and literary studies, Benjamin Goh analyses the essay's paratexts as indices of literary production in the German Enlightenment. Far from being an idealist proponent of intellectual property, Kant is shown to be a media theorist and practitioner, whose critical negotiation with the evolving print machinery in his time helps illuminate our present struggle with digital technology and the mounting pressures borne by copyright as a proprietary institution. Through its novel perspective on established debates surrounding authorship, this book critiques the proprietary conception of authorship in copyright law, and proposes an ethical alternative that responds to the production, circulation, and reading of literature. Diese angestrebte neue Disziplin lenkt den Blick auf das Kollektiv als Kulturträger und dient damit zum einen der praktischen Kulturforschung und gewährt zum anderen neuartige Einblicke in das Wesen des Sozialen. Der weit gefasste Begriff des Kollektivs tritt an die Stelle der traditionellen Gruppen- und Gesellschaftskonzepte und macht bisher verborgene Schichten menschlicher Gemeinschaftlichkeit zugänglich. Heft 11/2 widmet sich der Rolle von Kollektivität in einem von individueller Genialität geprägten Feld: der Kunst. Anhand von Chören, Jazz-Bands, Musikfestivals, dem Kollektiv ruangrupa, Designmoden, Filmen und Architekturkonzepten gehen die Beiträger*innen der Frage nach, welche besonderen Herausforderungen die kollektive künstlerische Kooperation birgt, wie diese Kooperation künstlerisch adressiert wird und was sich bei ihrer Reflexion über Kollektivität im Allgemeinen erfahren lässt.
