Warum gibt es keine verpflichtenden Regelungen, die für ein ausgeglichenes Verhältnis von Frauen und Männern in deutschen Parlamenten sorgen? Thüringen und Brandenburg hatten sie eingeführt. Die Landesverfassungsgerichte kippten die Beschlüsse 2020 wieder. Dabei öffnet das Grundgesetz der Bundesrepublik Deutschland einer verpflichtenden Parität in allen Parlamenten eigentlich Tür und Tor. Es regelt in Art. 3 Abs. 2, dass der Staat zur Verwirklichung der tatsächlichen Gleichstellung von Frauen und Männern in allen Rechts- und Lebensbereichen verpflichtet ist und bestehende Nachteile beseitigen muss. Für viele Juristinnen und Juristen sowie Politikerinnen und Politiker ergibt sich hieraus die Verpflichtung des Gesetzgebers, für eine Erhöhung des Frauenanteils in den Parlamenten zu sorgen. Seit einigen Jahren erreichen erste Klagen die Verfassungsgerichte - bislang noch ohne Erfolg. 
Die erfahrene Gutachterin und Klägerin im juristischen Ringen um ein Paritätsgesetz, Prof. Dr. Silke R. Laskowski, erklärt in dieser Studie, warum ein paritätisches Wahlgesetz auf der Grundlage von Art. 3 Abs. 2 S. 1 und S. 2 GG in Verbindung mit dem Demokratiegebot in Art. 20 GG nicht nur verfassungsrechtlich zulässig, sondern zur Stabilisierung und Weiterentwicklung der Demokratie auch 'geboten' und 'zwingend erforderlich' ist. Rechtsvergleichend richtet sie den Blick auch auf Europa. Sie ermutigt den Gesetzgeber, im Rahmen der aktuellen Wahlrechtsreform auch die Parität zu verankern.

Equality is a long-standing issue in law. Algorithmic systems increasingly use machine learning and thus function statistically. If they cause unequal treatment, these algorithmic discriminations pose a particular challenge for anti-discrimination law, which is often based on normative thinking. Hannes Beyerbach provides a comprehensive overview of the manifestations and complex causes of algorithmic discrimination. He shows that, even after the entry into force of key EU digital legislation, the current legal situation in European and national law does not explicitly address fundamental questions of algorithmic fairness. This innovative deeply researched book, critically examines the failures of international law in addressing severe human rights violations, particularly enforced disappearances and arbitrary detentions. This book argues that international law in a variety of areas, is ineffective and in need of reform. Through the lens of enforced disappearances and arbitrary detentions in international law, the book explores the weaknesses of the state-centric human rights system, emphasizing that states-often the primary violators-are responsible for ensuring compliance and enforcement. The book first examines the recent scourge of enforced disappearances and arbitrary detentions in a number of states, particularly those that have occurred transnationally. Through a detailed analysis of comparative state practice, including rising rates of transnational repression, the book highlights systemic deficiencies and later proposes various reforms to strengthen global human rights protection. The book advocates for an integrated approach, merging international humanitarian law, human rights law, and international criminal law to enhance enforcement and accountability. The book reviews why using an integrated approach to tackling violations will result in far better protections, arguing that abandoning a silo approach to international law and applying international human rights law and international humanitarian law together, especially in the context of international criminal law, will yield far better results. How greater integration can be achieved in theory, is examined. Also reviewed, are how international bodies that work on arbitrary detentions and enforced disappearances, do so in practice. The key challenge that is taken up is how international law can be improved to ensure that the worst violators can be made to comply with international law. For that reason, a series of recommendations are made in the conclusion about what can be done to remedy the deficiencies noted throughout the book. This book takes an interdisciplinary approach to the relationship between law, time, and new technologies to explain the emergence and transformation of global law, with a special focus on platform economy. It describes the 'metamorphoses of global law' on the basis of an experimental understanding of legal theory that looks beyond the systematisation of dogmatic categories, the reproduction of prefabricated theories.
