This book is a continuation of the prestigious series investigating current tax policy debates in an historical context. The authors are a mix of senior tax professionals from academia, the judiciary, and practice, with representatives from 9 countries. The chapters fall within 3 basic categories: 1. UK tax, looking at a variety of topics ranging from income tax (introduction and deduction at source), tax administration (Scotland), cases and judges (Lord Wilberforce), to the Peasants' Revolt, indirect taxation (tonnage tax and excise), and tax concepts (beneficial ownership). 2. International taxation, with chapters on the origins of the international income tax order, the UN (1950s and 60s), and VAT (origins and procedure). 3. Non-UK tax systems, including chapters on income tax in Singapore and early developments in Japan, South Africa (GAAR), an influential Canadian report (Carter Commission), taxation in classical Athens, and in the medieval Italian city-states. This interdisciplinary collection illuminates the religious roots of marriage and divorce in Europe and their divergent history from the 18th century to the present day. The 18th century was a pivotal period in terms of how the rules governing marriage and divorce were determined, with authority to set and adjudicate on rules shifting from religious authorities to the state. This book evaluates these historical developments, paying particular attention to the waxing or waning influence of religious institutions, values, or norms and whether further suggestions for reform have been made. Volume 1 of A History of Family Law in Europe examines how, and the extent to which, marriage formation and dissolution are regulated in the written texts of the Catholic, Protestant, and Orthodox traditions. The contributors analyse the respective traditions' teachings on marriage formation, marital impediments, and dissolubility, including these traditions' views as to the socially binding character of these teachings. Jurisdiction-specific chapters focusing on countries across Northern, Central, Southern, and Eastern Europe examine the regulation of marriage formation and dissolution in the context of religious and other cultural influences. This book brings together the insights of an international team of leading marriage-law scholars across Europe, and will be a significant resource for scholars of family law, legal history, and the history of religion.

A History of Family Law in Europe, Volume 1

The book examines the practice of judicial reasoning in Tort law, understood as a process of justification, consisting of both deductive and non-deductive elements, and therefore involving a significant element of choice or discretion. The book divides the elements of judicial reasoning into four conceptual categories: factual assessments, application of legislative and judge-made rules, reliance on reasonableness, and policy considerations. To discuss these elements in a comparative perspective the book uses the English and French judicial traditions of Tort law as case studies. This enables the author to present a range of methods of establishing facts, drawing inferences, using legal sources and relying on policy arguments. By closely examining selected Tort judgments from both jurisdictions, the book elucidates the phenomenon of law-making through adjudication in both a non-codified and a codified system of liability. It offers a reflection on different approaches legal systems may adopt to the importance in the process of judicial justification of such issues as certainty and truth, common sense, consistency with previous judicial decisions and policy.
The book connects the choice of approaches in judicial reasoning in Tort law with its procedural and institutional context.

Judicial Reasoning in Tort Law

This book explores the foundations of the principle of altruism and its relationship to the criminal law, examining the contrasting justifications for the duty of easy rescue and the duty of tolerance, both of which are based on altruism. Since the days of Lord Macaulay and James FitzJames Stephen, it has been said that English law does not usually punish omissions, and that altruistic duties are incompatible with the spirit of the common law. This book aims to show that this is not an accurate description of English criminal law, and that there is a strong case to be made for the opposite understanding, based on principles advanced by authors such as Adam Smith, Jeremy Bentham, John Stuart Mill and others. By analysing the duty of easy rescue - which imposes on individuals a duty to take steps to rescue a person in danger if this can be done without risk to the rescuer, or at least a duty to call the emergency services - and by comparing it with the well-known duties arising in cases of extreme necessity, it can be shown that altruism has plenty to say in different parts of the criminal law. Having established the case for criminalising the failure to provide a simple rescue, a detailed analysis is made of the form that this criminalisation should take, bearing in mind the basic principles of English law and considering the strengths and weaknesses of the duty of easy rescue as it is formulated in various continental systems, including the German, French, Spanish and Italian criminal codes.

This open access book is a cultural history of lawsuits that explains the development of French performance rights from la Belle Époque, via the roaring Twenties, and into Post-War France. It does so by analysing the ways in which performers, composers, and playwrights used French court rooms, newspaper scandals, and international conferences to claim their rights to create and control musical and theatrical performance. In 19th-century France, composers and playwrights organised in member-run societies that successfully used authors' rights legislation to curb the power of theatre managers. Towards the turn of the 20th century, these so-called collective management organisations had transformed French cultural industries by building out structures of royalty collection and improving litigation practices. From the café-concert culture in 19th-century Montmartre, the rise of modern celebrity culture and mass media, to the French governments' management of radio entertainment in the interwar period, the book traces precedent-setting litigation that defined who creates and controls performance. The book challenges previous narratives that centre the individualisation of authors in the expansion of the international copyright regime, while neglecting performers. Instead, it reveals the ways in which the personality and individuality of performers have played a constitutive role in discourses about genius, technology, and legal categories. This book explores how COVID-19 represents an inflection point for re-thinking and re-making democracy across the English-speaking world in an age where states are facing a future of overlapping crises. Years after the unprecedented COVID-19 pandemic started to unfold, have we yet learned the deep lessons essential to maintaining and improving democracy to meet crisis challenges? Produced with the benefit of distance from the most acute period of the pandemic, the book contextualises the COVID-19 crisis as revealing pre-existing vulnerabilities and intensifying challenges of governance, inclusion, and distrust, while also spurring democratic innovation and shifting the parameters for reform. Six national case studies - Australia, Ireland, Canada, Aotearoa New Zealand, UK and USA - reveal the heterogeneity of the Anglosphere as an imagined democratic space. Viewed in the round, pandemic responses ranged from the chaotic to the internationally lauded, although even the latter have featured acute deficiencies in democratic practice, which underscores the need to gather the lessons learned. Yet, in all states, the public and political temptation to simply move on, in an act of communal forgetting and collective return to "normalcy," presents a real risk of failing to prepare for more democratic future crisis responses. This collection takes the long view, approaching its subject from multiple perspectives that examine the heterogeneity of the Anglosphere as an imagined democratic space. Taking a cross-disciplinary approach and bringing together both leading and emerging experts on democracy, constitutionalism, and the rule of law, this book powerfully combines the insights of retrospective analysis with future-focused contemplation of where our democracies are heading.

This book uncovers and reconstructs the growing body of legal principles and rules governing mortgages that have been developed by different transnational institutions and actors. It shows how mortgages have evolved from a type of real security commonly used to facilitate lending by mitigating credit risk, to a transferable commodity with the potential to affect international financial stability and consumer welfare. In doing so, the book reveals the emergence of new policy objectives and rationales for regulation that have led to changes in the structure and functions of mortgage laws.
