Die europäische Bedeutung der Internationalen Kriminalistischen Vereinigung (IKV) 1889-1919

Das Lehrbuch richtet sich in erster Linie an Studierende, die sich im Rahmen ihrer universitären Ausbildung mit dem Bereich des Wirtschaftsstrafrechts befassen möchten. Deshalb wird verstärkt mit didaktischen Elementen wie Fällen aus der Praxis und Schlagwörtern gearbeitet, die einen Ausblick auf weiterführende Fragestellungen geben sollen. Um ein besseres Verständnis zu ermöglichen, werden nicht nur die für das Studium relevanten Normen dargestellt. Vielmehr werden auch die Ursprünge des Wirtschaftsstrafrechts und dessen Besonderheiten im Bereich des Allgemeinen Teils dargestellt. Einen Schwerpunkt setzt das Lehrbuch bei den mit dem Wirtschaftsstrafrecht verknüpften unternehmensinternen Präventionsmaßnahmen, die unter dem Begriff Compliance zusammengefasst werden können.

This book offers the first detailed study of women's legal status in early modern Liège, an otherwise largely overlooked case in European legal history. It follows women across the course of their lives, from birth to widowhood, to show how their legal position and control over property shifted over time, depending on their social status and place within the family. Drawing on a substantial body of wills and marriage contracts from notarial practice, it moves beyond traditional sources to show how the law actually worked in everyday practice, and who took part in its creation. By bringing all these elements together, this book offers a nuanced picture of how law and gender interacted in early modern Europe.

This book provides the first in-depth scholarly analysis of fraud, the highest volume crime in England and Wales, addressing the challenges faced in building a principled criminal law response by presenting an innovative normative analysis. The UK is now in a pandemic of fraud. There were 4.6 million fraud offences recorded in the year ending March 2021, accounting for 42% of all crime committed against individuals. Fraud is now the highest volume crime in England and Wales; its incidence in the first half of 2021 was described by UK Finance as a 'national security threat'. Company law is now understood to be a creature of statute law. The Companies Act of 2006 is a monumental piece of legislative work. Cases, however, played a central role in creating, establishing, and influencing legal ideas that were later enshrined within pieces of legislation. To identify the landmark cases in company law, the book develops an original, democratic, and objective method. It undertakes a citation analysis of cases used by 5 leading English company law textbooks. Highly cited cases are widely understood to be central to the company law curriculum. Once these cases have been identified, they are examined by leading scholars in company law. The analysis that follows sheds some much needed light on how, why, and when historic rules came into being. This contextual analysis is missing from the original law reports as well as the legislation that we see in operation today. It follows that these novel accounts of the roots of company law push beyond a simplistic narration of the case and proffer a new explanation for why legal rules took the shape that they did. Other archaeological studies also provide a fresh account of the case. Such an excavation informs the reader about legal advisors or the parties in the suit to explain why the litigation arose in this particular way, manner, or form.
