Los capítulos que integran la obra son el resultado del estudio y análisis de diferentes instrumentos normativos que se han creado desde la propiedad intelectual con la finalidad de reconocer y proteger la creatividad de las personas como entes individuales, pero que identifican vacíos, ambigüedades y falta de protección respecto a otros sujetos creadores y sus obras, como los pueblos y comunidades originarios, que como entes colectivos requieren una protección de naturaleza distinta, desde una perspectiva de derechos humanos.
Frente a la globalización se hace mayormente evidente la construcción de instrumentos que protejan el patrimonio biocultural que tiene su origen en estos pueblos y comunidades. Las artesanías que crean y recrean y los saberes que se encuentran implícitos en las formas de hacer son ejemplo de ello, y que son aspectos que no se han considerado en la creación de instrumentos internacionales como el T-MEC, ya que al ser una naturaleza eminentemente económica se ha dejado de lado la perspectiva interseccional con la que se debe crear cualquier mecanismo con el que se pretenda proteger a quienes crean, y a las creaciones per se.

El desarrollo investigativo, enfocado bajo el paradigma de investigación cualitativa, utiliza el modelo fenomenológico hermenéutico buscando interpretar las experiencias vividas por los sujetos de estudio. La herramienta de recolección de datos es la entrevista no estructurada, la cual permite recabar información conducente al logro de la meta propuesta. Como resultado de este estudio se determina que la valoración de los Derechos Humanos de las personas que se encuentran bajo resguardo y custodia del citado cuerpo policial es precaria, ya que no están dadas las condiciones para que el privado de libertad pueda llevar una vida con dignidad.
