Ensayo del año 2025 en eltema Economía de las empresas - Política económica, Nota: 8,0 (B), , Materia: Investigación Independiente autoformativa sobre Temas de Cuba: Metrología y temas comerciales, Idioma: Español, Resumen: El presente ensayo aborda la problemática estructural que representa el uso cotidiano de "romanas" deterioradas y carentes de certificación metrológica en bodegas y agromercados cubanos, situando este fenómeno en el centro del debate sobre la protección al consumidor y la equidad en el comercio minorista. El análisis parte de una contextualización histórica que revela cómo la metrología legal ha evolucionado desde sus orígenes como garante de justicia en las transacciones hasta convertirse en un componente esencial de los sistemas modernos de protección al consumidor. A lo largo del texto, se examinan los factores materiales, institucionales y culturales que han perpetuado la utilización de instrumentos de pesaje obsoletos, destacando la insuficiencia de recursos para la modernización tecnológica, la debilidad de los mecanismos de control y fiscalización, y la prevalencia de una cultura administrativa orientada más a la simulación de legalidad que a su cumplimiento efectivo. El ensayo también explora los avances internacionales en materia de innovación tecnológica, señalando cómo la digitalización y la automatización de los sistemas de pesaje han transformado la experiencia del consumidor en otros contextos, y subraya la brecha existente entre estos desarrollos y la realidad cubana. Se argumenta que la modernización de los instrumentos de pesaje, aunque necesaria, resulta insuficiente si no se acompaña de reformas institucionales profundas y de la promoción de una cultura de fiscalización y reclamación activa por parte de la ciudadanía. Las conclusiones alcanzadas enfatizan que la superación de la vulnerabilidad estructural del consumidor en Cuba requiere una intervención integral que articule la actualización tecnológica, el fortalecimiento de los sistemas de control y la capacitación continua del personal, junto con la creación de condiciones que incentiven la participación ciudadana y la vigilancia social.

Vulnerabilidad estructural y protección al consumidor

Las Constituciones fundacionales de Cuba comprenden las siete primeras constituciones cubanas. La asm antigua de todas el Proyecto de Constitución para la Isla de Cuba. Se trata de un documento inédito en la historia de Cuba. Joaquín Infante, su autor, lo publicó en 1812, en la Caracas revolucionaria de Simón Bolívar, a quien conoció en persona.
Infante también diseñó una bandera para Cuba, hoy desconocida que hemos utilizado para la portada de la edición independiente que hicimos de dicho Proyecto.
En las tres siguientes constituciones cabe señalar que con ellas las fuerzas independentistas erigieron un código legal y un marco de actuación jurídico desde el que legitimar sus posiciones.
La Constitución de Guáimaro de 1869 fue votada en el pueblo cubano de Guáimaro el 10 de abril de 1869.

Firmantes de la Constitución de Guáimaro


En lineas generales esta y las siguientes constituciones aquí reunidas, se ocupan de preparar un espacio de poder y legalidad. Este permitiría establecer tratados y separar el poder judicial del resto de los poderes.
Es a partir de la Constitución de la Yaya que los escritos constitucionales de los movimientos independendistas cubanos empiezan a establecer auténticos principios de gobernabilidad. En ella se manifiesta una decisiva voluntad de abarcar aspectos políticos más cercanos a los de la vida cotidiana en la isla. También propone dialogar con las dos fuerzas extranjeras que más pesaban en la Cuba de entonces: España y los Estados Unidos.
Se incluye además la promulgada por España en 1897, otorgándole la autonomía a Cuba y Puerto Rico. Y por último aparece una Constitución hecha durante la ocupación de Cuba por Estados Unidos. A continuación las enumeramos:

Constituciones fundacionales de Cuba

La Constitución de Ecuador de 1869 fue la octava constitución ecuatoriana, vigente en el país durante el período comprendido desde 1869 hasta 1876, siendo después reemplazada por la Constitución de 1878. La Constitución de 1869 fue elaborada y propuesta por Gabriel García Moreno, a la cual sometió a un referéndum constitucional. La aprobó por el pueblo con un SÍ contundente.
La Constitución contiene trece títulos, además de disposiciones transitorias, que comprenden un total de 117 artículos.
Entre sus principales características constan


un período presidencial de seis años,
negación a la libertad de culto,
excesivos poderes por parte de la función ejecutiva,
cambio en los parámetros para ser ciudadano
y un mayor período de legisladores.
Permitió, además, que las fuerzas de seguridad pudieran entrar en cualquier domicilio. Estableció la pena de muerte por delitos de índole política y la limitación de los mandatos presidenciales a seis años, entre otros. Su carácter poco liberal provocó que fuera bautizada popularmente como Carta Negra.
De alguna manera, la Carta Negra fue una de las causas del descontento general que estalló el 6 de agosto de 1875. Terminando con la sangrienta ejecución de García Moreno.
García Moreno murió el 6 de agosto de 1875, a manos de uno de sus enemigos más acérrimos: Faustino Lemus Rayo. La desaparición de la figura de García Moreno marcó el inicio del debilitamiento de la hegemonía conservadora en el país.
Su sucesor fue Antonio Borrero, que pertenecía al Partido Progresista. En un primer momento mantuvo buenas relaciones con los liberales, pero su negativa a reformar la Carta Negra provocó que ambos bandos rompieran relaciones. Los liberales apoyaron entonces al general Ignacio de Veintimilla en su intento de golpe de Estado.
El triunfo de esta asonada llevó a Veintimilla al poder, primero como Jefe Supremo y después, tras aprobar una nueva Constitución, como Presidente constitucional.
