        &lt;p&gt;Es ist nach wie vor ungeklärt, welche zivilrechtlichen Folgen bei einem Verstoß gegen die §§ 63 ff. WpHG eintreten sollen. Das Werk diskutiert umfassend eine „Ausstrahlung“ des Finanzaufsichtsrechts, die Einordnung der §§ 63 ff. WpHG als Privatrecht und eine Schutzgesetzeigenschaft der Verhaltenspflichten. Der Autor entwickelt die Haftung von Finanzdienstleistern aus einem Beratungsvertrag weiter und zeigt konkret auf, welche zivilrechtlichen Folgen bei Verstößen gegen bestimmte Pflichten aus dem WpHG eintreten - etwa in Bezug auf Schadensersatz oder Beweislast. Das Werk enthält weiter einen Überblick zu wesentlichen Regeln und Durchsetzung des US-amerikanischen Wertpapierrechts, und zieht einen Vergleich zur deutschen Rechtslage.&lt;/p&gt;

        &lt;p&gt;Das Werk erörtert eine Grundsatzproblematik, die wegen der Auslegung des Art. 263 Abs. 4 AEUV besteht. So können Privatpersonen nicht direkt gegen sekundärrechtlichen EU-Normen vor den EU-Gerichten vorgehen. Die Bundesrepublik Deutschland muss wegen der Verpflichtung aus Art. 19 Abs. 1 UAbs. 2 EUV diese Rechtsschutzlücke schließen. Die allgemeine Feststellungsklage nach § 43 Abs. 1 VwGO ist hierzu heranzuziehen. Mit einer auch verfassungsrechtlich durchsetzbaren Vorlage nach Art. 267 Abs. 1 AEUV kommt der EuGH schlussendlich zur Gültigkeitskontrolle. Der Autor war zum Zeitpunkt der Schaffung des Werks wissenschaftlicher Mitarbeiter bei Prof. Dr. Matthias Pechstein am Jean-Monnet-Lehrstuhl für Öffentliches Recht, insbesondere Europarecht.&lt;/p&gt;

&lt;p&gt;This is the first socio-legal multi-jurisdictional study on hazing (ragging). This book considers four countries: the USA, India, Sri Lanka, and Australia. It states the legal position, identifies lacunas in law, and proposes possible legal solutions. Unfortunately, laws, regulations, and policies have failed to stamp out hazing from university campuses and residential colleges.&lt;/p&gt;&lt;p&gt;Hazing has spiralled out of control in a number of countries. It has descended into a cruel, barbaric, and inhuman practice. The number of students subjected to hazing and sexual abuse is alarming. According to a 2022 survey, more than half (53%) of American students who were part of a fraternity or sorority experienced hazing. Students are murdered, harmed, abused, and suffer long-term trauma. The prevention of hazing is one of the most important responsibilities of 21st century universities.&lt;/p&gt;&lt;p&gt;The theme of the book is that universities are in the best position to protect students from hazing and must play a vital role. As a sociological study, the book also considers why hazing occurs and what can be done to prevent it. Without engaging with the underlying causes, legal punitive measures continue to address the symptom rather than the cause. The book, therefore, explores how a more innovative approach to regulation can help tackle the cause.&lt;/p&gt;&lt;p&gt;The book will be of interest to policy makers, regulators at universities, education and legal academics, and personal injury lawyers.&lt;/p&gt;&lt;p&gt;&lt;/p&gt;

The UN adopted the 2030 Agenda that embodied sustainable consumption and production patterns as one of the 17 Sustainable Development Goals (SDG). SDG 16 is directly related to law and includes peace, inclusive societies, access to justice and effective and accountable institutions. Dafür werden Kommissionsberichte, parlamentarische Gesetzgebungsdebatten, Pressestimmen sowie in Pamphleten geführte Diskussionen dargestellt. Weiterhin werden biographische und prosopographische Hintergründe miteinbezogen. Zudem erfolgt der Versuch einer Einordnung der Justizgesetze der 1870er Jahre in Modernisierungs- und Rationalisierungskontexte. - Die Forschungsinteressen des Autors umfassen Neuere Geschichte, Kultur- und Wissenschaftsgeschichte sowie Neuere Rechts- und Verfassungsgeschichte.

&lt;p&gt;Der Autor behandelt in zwölf Aufsätzen das europäische Mächte-System im 19. und 20. Jahrhundert einschließlich der deutschen Wiedervereinigung. Damit skizziert er mit großen, aber konturenscharfen Linien aus verfassungshistorischer Sicht das deutsche Schicksal nach der Niederlegung der Kaiserkrone durch Franz II. auf Geheiß Napoleons im Jahre 1806. Im Hintergrund der meisten Aufsätze zeigt sich die Gewaltentrennungslehre Montesquieus, der den autokratischen Absolutismus im Frankreich zu jener Zeit literarisch bekämpfte. Prof. Dr. Dr. Merten ist emeritierter Professor für Öffentliches Recht an der Deutschen Hochschule für Verwaltungswissenschaften Speyer, war über zwei Jahrzehnte Landesverfassungsrichter in Rheinland-Pfalz und wirkt als Autor am BGB-Großkommentar von Staudinger mit. &lt;/p&gt;

        &lt;p&gt;Mit virtuellen Währungen wie dem Bitcoin können erhebliche Veräußerungsgewinne erzielt werden, doch stellt sich die Frage, ob deren Besteuerung in Deutschland überhaupt verfassungsgemäß ist. Die Belastung darf nicht allein auf der Erklärungsbereitschaft des Steuerpflichtigen beruhen. Vielmehr muss eine Verifikation dessen (Nicht-)Deklaration möglich sein. Andernfalls könnte ein Verstoß gegen den allgemeinen Gleichheitssatz gem. Art. 3 Abs. 1 GG vorliegen. Die Dissertation widmet sich der Frage, ob im Lichte der Rechtsprechung des BVerfG insoweit ein strukturelles Vollzugsdefizit und damit möglicherweise eine Verfassungswidrigkeit vorherrschen. Hierbei geht die Dissertation auch auf die Bestrebungen der OECD (CARF) und der Europäischen Union (DAC8) zur Bekämpfung der Vollzugsschwierigkeiten ein.&lt;/p&gt;
