Political authority is more than brute power insofar as it is rooted within the institution of a legal order. As social constructs, however, institutions may lack legitimacy. This book suggests a normatively individualistic and functional conception of legitimacy. On this account, political authority can be legitimate because its function, administering peaceful coexistence in a state, allows for all individuals to benefit. For a regime to be legitimate, however, individuals must also be protected against governmental overreach by means of liberal fundamental rights and the rule of law. Although the functional approach does not envision any ideal state, it provides guidelines for designing and reforming constitutions.

Das Buch führt die äußerst lebendige Friedenspolitik in Bremen vor Augen. Als einer der bedeutenden deutschen "Friedenspfarrer" hat Hartmut Drewes (1939-2025), der zu der "großen Familie radikaler Pazifisten" (Kurt Tucholsky) gehört, über ein halbes Jahrhundert hinweg für Frieden, Abrüstung und Völkerverständigung gewirkt. Die historische Lehre "Nie wieder Krieg! Nie wieder Faschismus!" war für ihn und das hanseatische Friedensengagement wegweisend. In seinen Schriften, Ansprachen und Predigten wendet er sich gegen die weiter zunehmende Militarisierung Deutschlands und schreibt: "Wir werden in der kommenden Zeit unbeirrt weiterarbeiten und viel Aufklärungsarbeit leisten müssen. Die Politiker sollen sich nicht auf die Vergesslichkeit der Menschen verlassen dürfen!"

A capacious history of decolonization from the decline of empires to the era of globalization

Empires, until recently, were everywhere. They shaped borders, stirred conflicts, and set the terms of international politics. With the collapse of empire came a fundamental reorganization of our world. Decolonization unfolded across territories as well as within them. Its struggles became internationalized and transnational, as much global campaigns of moral disarmament against colonial injustice as local contests of arms. In this expansive history, Martin Thomas tells the story of decolonization and its intrinsic link to globalization. He traces the connections between these two transformative processes: the end of formal empire and the acceleration of global integration, market reorganization, cultural exchange, and migration.

The End of Empires and a World Remade shows how profoundly decolonization shaped the process of globalization in the wake of empire collapse. In the second half of the twentieth century, decolonization catalyzed new international coalitions; it triggered partitions and wars; and it reshaped North-South dynamics. Globalization promised the decolonized greater access to essential resources, to wider networks of influence, and to worldwide audiences, but its neoliberal variant has reinforced economic inequalities and imperial forms of political and cultural influences. In surveying these two codependent histories across the world, from Latin America to Asia, Thomas explains why the deck was so heavily stacked against newly independent nations.

This book argues that international law in a variety of areas, is ineffective and in need of reform. Through the lens of enforced disappearances and arbitrary detentions in international law, the book explores the weaknesses of the state-centric human rights system, emphasizing that states-often the primary violators-are responsible for ensuring compliance and enforcement. The book first examines the recent scourge of enforced disappearances and arbitrary detentions in a number of states, particularly those that have occurred transnationally. Through a detailed analysis of comparative state practice, including rising rates of transnational repression, the book highlights systemic deficiencies and later proposes various reforms to strengthen global human rights protection. The book advocates for an integrated approach, merging international humanitarian law, human rights law, and international criminal law to enhance enforcement and accountability. The book reviews why using an integrated approach to tackling violations will result in far better protections, arguing that abandoning a silo approach to international law and applying international human rights law and international humanitarian law together, especially in the context of international criminal law, will yield far better results. How greater integration can be achieved in theory, is examined. Also reviewed, are how international bodies that work on arbitrary detentions and enforced disappearances, do so in practice. The key challenge that is taken up is how international law can be improved to ensure that the worst violators can be made to comply with international law. In 2019, the ICJ issued its Chagos Advisory Opinion, finding that the Chagos Archipelago belongs to Mauritius and that the United Kingdom's administration of the archipelago is contrary to international law. In the proceedings, the United Kingdom and Judge Donoghue invoked the Eastern Karelia doctrine. The 1923 doctrine states: The Court does not issue an advisory opinion if, by doing so, it would undermine the basic rule that states may submit disputes to judicial settlement only with their consent.
