The new novel by the author of A Winter's Promise

This landmark collection provides new insights, concepts and techniques to understand and respond to tort claims based on illegal conduct. It is the first comparative study of this difficult field, which has remained contested despite numerous decisions of the highest courts in the common law world. The collection draws on scholars from common law and civilian jurisdictions spanning Argentina, Australia, Brazil, England and Wales, France, Germany, Italy, the Netherlands, Scotland, Singapore, Spain, South Africa and Sweden. Together they set out fact patterns, and justifications for tort liability to illustrate the coherence and unity that exists when courts address such claims. While common law legal systems have developed a specific defence of illegality for some of those fact patterns, civilian jurisdictions tend to see illegality operating, if at all, through the existing components of tort liability. The book explains how these different approaches have been reached, how they work, and what they reveal about reasoning in tort.

Understanding Tort Claims and Illegality

The book examines the practice of judicial reasoning in Tort law, understood as a process of justification, consisting of both deductive and non-deductive elements, and therefore involving a significant element of choice or discretion. The book divides the elements of judicial reasoning into four conceptual categories: factual assessments, application of legislative and judge-made rules, reliance on reasonableness, and policy considerations. To discuss these elements in a comparative perspective the book uses the English and French judicial traditions of Tort law as case studies. This enables the author to present a range of methods of establishing facts, drawing inferences, using legal sources and relying on policy arguments. By closely examining selected Tort judgments from both jurisdictions, the book elucidates the phenomenon of law-making through adjudication in both a non-codified and a codified system of liability. It offers a reflection on different approaches legal systems may adopt to the importance in the process of judicial justification of such issues as certainty and truth, common sense, consistency with previous judicial decisions and policy.

European Administrative Governance

This book investigates the extent to which regions participate in and influence EU policy-making through the lens of Multi-Level Governance (MLG). Focusing on the 2021-2027 Cohesion Policy programme, it examines whether regions – traditionally central actors in EU governance – are progressively experiencing a diminishing role. By comparing the current programming cycle with previous ones, the book analyses the degree of regional participation in shaping the Cohesion Policy agenda setting. Adopting a comparative and empirically grounded approach, the study explores two Member States – Italy and France – and four regional case studies – Tuscany, Veneto, Brittany, and Provence-Alpes-Côte d’Azur. By assessing whether regional actors still effectively influence Cohesion Policy content, the book demonstrates that recent crises, including the financial crisis, rising Euroscepticism, and the COVID-19 pandemic, have accelerated centralisation trends within the EU. Instruments such as Next Generation EU and National Recovery and Resilience Plans have further strengthened national governments, often limiting meaningful regional involvement.
