A Comparative Analysis of Agreed Remedies as a Means of the Enforcement of Rights in English and German Contract Law': This thesis analyses agreed remedies in English and German contract law. Particularly, it focusses on the scope of freedom of contract and the functions of agreed remedies. It argues that agreed remedies should be considered an independent research topic. This allows to identify specific insights for certain clauses, such as liquidated damages and penalties, as well as general rules and principles.
