The Radical Imagination

Since its initial 2011 publication, Theory from the South has stimulated a new field of inquiry from leading scholars, while world developments have escalated and supported its original thesis of how "Euroamerica has evolved toward Africa." Not least of these is the many resemblances of the Trump presidency to that of Jacob Zuma, transformations in the nature of many of the world's Northern democracies, the rise of populist politics, the intensifying hold of private capital over functions of the state, sharpening inequalities, and the transformation of labor. In a new chapter for this expanded edition, the Comaroffs extend their theorizing around and beyond these new developments. Critique and discussion by several prominent commentators round out this new edition: Achille Mbembe, James Ferguson, Ato Quayson, Srinivas Aravamudan, and Juan Obarrio.

Following the events of 9\11 individual countries and the international community became increasingly concerned about how best to prevent the funding of terrorist groups. Alternative remittance systems such as Hawala, where money is moved informally between a network of brokers in the Middle East, north Africa and south Asia have been identified as a potential source of terrorist financing leading to calls for greater regulation of such alternative remittance systems.This book analyses the risk such alternative remittance systems pose in terms of terrorist financing, offering a detailed overview of the historical origins and methods of operation of alternative remittance systems or informal value transfer systems. The factors that have come to ensure that these systems have remained operationally viable in modern times are identified along with the risks they present balanced against an overview of their actual misuse for illicit purposes to date. The book presents a detailed critique of the UK framework for the regulation of these systems drawing where possible on existing data to assess the use and effectiveness of these measures in practice. A range of options for mitigating risks associated with specific remittance corridors is considered ranging from initiatives that promote remittances through the banking sector, to efforts to mitigate risk and the impact on the delivery of UK overseas development aid. The book concludes with key recommendations as to the effectiveness of the current regulatory framework within the UK viewed from the perspective of international efforts to secure the regulation of these systems, and in stemming terrorist finance as part of national and international counter-terrorism policy.

The Regulation of Hawala and Alternative Remittance Systems

Stemming Terrorist Finance

This book provides an in-depth analysis of the reintroduction and recovery of the Mexican wolf in the American Southwest, with a particular focus on the role of the Federal judiciary. Edward A. Fitzgerald contends that federal courts have played a critical role in facilitating the species' return, primarily through their interpretation of statutory law - most notably, the Endangered Species Act (ESA). The courts rejected challenges from the livestock industry, reaffirmed Federal authority over the recovery process, and struck down certain Federal regulations that hindered effective wolf management. However, Fitzgerald argues that the judiciary also made significant missteps. Federal courts upheld revised Mexican wolf management regulations and recovery plans that failed to meet the ESA's requirement to rely on the "best available science." Additionally, the courts issued inconsistent rulings concerning the construction of border barriers. While they blocked the Trump administration's unauthorized transfer of funds for wall construction, they repeatedly and erroneously upheld the Secretary of Homeland Security's waiver authority. This authority permitted border wall construction to proceed in violation of Federal, state, and local laws - actions Fitzgerald claims exceeded statutory limits and violated the nondelegation doctrine. Providing a comprehensive and detailed examination of the legal challenges surrounding the Endangered Species Act and the recovery of the Mexican gray wolf, this book will be of interest to legal scholars, policymakers, and conservation advocates.

Forests are central to international security, peace, and justice, as they provide livelihoods for millions of impoverished people in developing countries. Threat's to the world's forests may result in a reduction in basic livelihood resources and will have significant consequences on a global scale. There is no existing international treaty on the protection of forests, with the result that their international protection is governed by disparate areas of international law and smaller-scale local initiatives. In this context, this book reviews the history of international law on forests, evaluating the effectiveness of the existing international legal framework to protect them. The book investigates the impact of the initiatives which have emerged in the absence of a dedicated international agreement, including Reducing Emissions from Deforestation and Forest Degradation (REDD+) and forest certification, which are assessed in the wider context of the development of international environmental law. It also considers the role of regional forest agreements in the international protection of forests. It assesses the challenges to the effectiveness of international law governing forests, in particular the disparate nature of the law as it stands, and posits that the solution can be found in existing regional agreements. It argues that a more specific international treaty, consistent with the recent decisions of international courts on environmental protection and building on the experience of regional legal instruments, may offer an effective path forward.

International Law and the Protection of Forests

This open access collection of 17 original essays is the first volume to provide an in-depth exploration of the potential of a rights-based approach to criminal law. The book presents a comprehensive treatment of the role of rights in criminal law, ranging from a conceptual analysis and questions of justified criminalisation, to specific legal implications for substantive criminal law and criminal procedure. This book offers practical and systematic tools for understanding the controversial dynamics of de-radicalization and extremism in the context of global terrorism. Since 2010 there has been a sharp increase in the number of extreme jihadist groups around the world. A surge in right-wing radicalization marked by hate speech and anti-immigrant anxieties has also been noted. States have subsequently sought to develop approaches to counter these groups, with variable success. While some countries have been relatively successful in countering radicalization, others have seen an increase in the number of terrorist attacks. Using comparative analysis, this book examines the controversial subject of de-radicalization as a tool of the state in modifying political behaviour. Drawing on multiple country case studies, it assesses how governments around the world use counter-terrorism policies and measures, be it through policing, the judicial process, state-sponsored programs or community approaches, to address extremist radicalization. It also considers how effective these policies have been in modifying extremist forms of behaviour, and why some countries have been more successful than others. It will appeal to scholars and students of public policy, international human rights, international relations and counter-terrorism studies.
