The thirtieth anniversary of the fall of the Berlin Wall is chosen as a natural moment of stocktaking; assessing the progress made since the beginning of the democratic reforms in Central and Eastern Europe (CEE), but also critically analysing recent tendencies of rule of law backsliding and open revolt against liberal-democratic values in individual EU Member States. The volume is partly retrospective in that it reflects on the challenges of the post-communist transition and the process of Eastward Enlargement of the Union. Yet it is also prospective, in so far as it reviews the variety of novel mechanisms for strengthening rule of law enforcement in the EU and gauges their potential for bringing sustainable, positive change in this regard. All chapters are written by experienced scholars and practitioners in the field of EU law and policy.

This open access book presents a variety of perspectives on the concept of freedom of religion in different European countries against the background of the European Convention on Human Rights, the EU Charter of Fundamental Rights and other international treaties. In most European societies today, religion and questions about religion are increasing in relevance and importance. This development can be explained in several ways, for example by continuous demographic changes and new societal standards and values. As a consequence, the debate on the interpretation and scope of the right to freedom of religion has intensified in politics, media and, of course, law. The right to freedom of religion is complex and varies within different legal contexts at the international, European and national levels. This has resulted in a right that is ambiguous and sometimes difficult for individuals to claim and for states to assert. An Ambiguous Right in the Contemporary European Legal Order

Freedom of Religion

All EU Member States have now transposed Directive 2014/104/EU on damages actions for breaches of competition law into national law. The Directive (and the soft-law instruments accompanying it) not only marks a new phase for private enforcement of competition law but also, more generally, provides a novel and thought provoking instance of EU harmonisation of aspects of private law and civil litigation. Following up on a previous volume in the Swedish Studies in European Law series, published in 2016, this open access book offers contributions from top practitioners and scholars from all over Europe, who present and discuss first experiences from the implementation of the new damages regime in various jurisdictions. Topics covered include theoretical and practical reflections on the state of private enforcement in Europe, the balancing of conflicting interests pertaining to public and private enforcement of competition law respectively, and specific legal issues such as causation and the estimation of harm. In communist Eastern Europe the churches were often a focus for opposition to communism, and in the immediate post-communist period churches played a key role in fostering national cohesion, promoting a conservative political agenda, and in rewriting national narratives to eliminate or revise communist narratives. These activities, which are implicitly conservative and nationalistic, are not naturally in step with European integration. This book explores the relationship between religion and politics in post-communist Europe, focusing especially on the degree to which religion, and religious involvement in politics, encourage Euroscepticism.

In communist Eastern Europe the churches were often a focus for opposition to communism, and in the immediate post-communist period the churches often played a key role in fostering national cohesion, in promoting a conservative political agenda, sometimes in formal alliances with political parties, and in rewriting national narratives to eliminate or revise communist versions of such narratives. These activities, which are implicitly conservative and nationalistic, are not naturally in step with European integration. This book explores the relationship between religion and politics in post-communist Europe, focusing especially on the degree to which religion, and religious involvement in politics, encourage Euroscepticism. The book, which covers a range of East European countries, shows how religion is very important as a political force, how religion’s contribution to Euroscepticism varies between countries, and how in some circumstances, especially when a religious-based party is in power and has to deal with Brussels, religion can favour European integration. The book includes coverage of Catholic, Orthodox and Muslim countries, and includes discussion of how religious organisations, which often engage in lobbying in Brussels, relate to the European Union itself.
