This book offers the first ever in-depth analysis of the emerging constitutionalism in South Sudan and the challenges it faces. The book critically analyses the constitution-making processes that occurred in South Sudan between 2005 and 2011, finding, among other things, that there was a failure of constitutional discourse, particularly in relation to the 2011 drafting process of the Transitional Constitution. It goes on to analyse how the constitution is being implemented. It finds that, despite the clear division of powers and functions between the national government and the sub-national governments, what has emerged in South Sudan in the post-constitution-making period is a form of coercive centralism where the national government controls much of the political decision-making process. This has had serious implications for democracy, constitutionalism, and the rule of law. Finally, bearing in mind the failure in both how the transitional constitution was made and how it is being implemented, the book undertakes a critical analysis of the proposed process for drafting a new constitution for South Sudan. It identifies serious shortcomings and proposes how these could be addressed to enhance the process.

Basil Kerski schreibt eine kleine Geschichte und Gegenwartskunde der ost-westeuropäischen Beziehungen und zeigt auf, wie maßgeblich kulturelle Annäherungen sie beeinflussen. Hart Studies in Constitutional Theory

This book challenges the near-universal acceptance of a US-style, Western constitutional paradigm as the best basis for comparative constitutional studies. It does so on three main grounds: anachronism, 'othering' and cultural specificity. Main pillars of 'convergent constitutional theory' are rooted in the revolutionary, late-eighteenth century - a lost world; constitutional arrangements that deviate from the paradigm are often branded as 'outliers' or even as not constitutional at all; and the foundations of the paradigm in liberal democracy give no space for other forms of constitutionalism. Whatever the attractions of convergent theory as a normative ideal of good government, for the purposes of understanding, analysing and explaining constitutional systems it is far from ideal. This book discusses and questions: convergent theory's weddedness to writing as the technology of constitution-making; its image of a constitution as fundamental law; its idea that a constitution expresses the 'sovereignty of the people'; its use of tripartite separation of powers as the basic principle of institutional design; its relative neglect of administrative law; its association of 'rights' with judicially enforceable bills of rights; and its obsession with a vaguely specified concept of 'democracy'. It makes suggestions for alternative, preferable methods of understanding, analysing and explaining constitutions, and governmental and constitutional systems.

The Distorting Lens of Convergent Constitutional Theory

Das auf mehrere Bande angelegte Werk prasentiert nahezu das gesamte deutsche Verfassungsrecht des Zeitraumes zwischen 1806 und 1918. Hiermit wird der sich gleichsam schrittweise vollziehende Ubergang von einem traditionell standischen oder gar furstlich-absolutistischen zu einem zumeist monarchisch-konstitutionellen System aufgearbeitet, dessen jaher Untergang schlielich in die nationalstaatlich-republikanisch gepragte demokratisch-parlamentarische Staatsform Weimars mundet. Mit dem Gesamtwerk steht dem Fachpublikum eine leicht zugangliche, bislang nicht gekannte Fulle von Dokumenten zur Verfugung, die fur die verfassungsrechtliche Entwicklung Deutschlands und seiner einzelnen Staaten von zentraler Bedeutung waren. Dabei wird groer Wert auf die authentische, d. h. buchstaben- und zeichengetreue Ubernahme der Texte gelegt. Dem jeweiligen Dokumententeil sind in jedem Band "Historische Einfuhrungen" vorangestellt. In diesem Rahmen werden an den einschlagigen Dokumenten orientierte (verfassungs-) rechtliche, zeitlich wie territorial ubergreifende entwicklungsgeschichtliche Darstellungen vorgenommen. In dem hier vorliegenden 3. Band werden erstmals uber 450 Verfassungsdokumente prasentiert, welche fur die verfassungsstaatliche Entwicklung des Groherzogtums Berg und des Herzogtums Braunschweig pragend waren. Begleitet wird diese Textedition durch eine ausfuhrliche historische Einfuhrung.

Mit Blick auf die maßgebliche Regelung zur Unterbrechung der strafrechtlichen Hauptverhandlung, § 229 der Strafprozessordnung, lässt sich feststellen: Seit ihrer Einführung im Jahre 1877 wurde die Unterbrechungsmöglichkeit kontinuierlich ausgeweitet und der ursprüngliche gesetzgeberische Leitgedanke, das strafrechtliche Hauptverfahren konzentriert abzuhalten, trat immer weiter in den Hintergrund. Diese Entwicklung ist kritisch zu beurteilen, denn der historische Gesetzgeber verfolgte ein wichtiges Ziel: Die richterliche Urteilsfindung und der dort stattfindende Erinnerungsprozess sollten durch Unterbrechungen der Hauptverhandlung nicht über Gebühr belastet werden. Dieses ursprüngliche Ziel und die sukzessive gesetzgeberische Abkehr&nbsp;nimmt der Autor zum Anlass, den möglichen Einfluss der Hauptverhandlungsunterbrechung auf die richterliche Urteilsfindung aus psychologischer Sicht näher zu beleuchten. Dabei werden die Grundlagen der menschlichen Informationsverarbeitung erläutert und in der Folge Implikationen für ein daran anzupassendes strafrechtliches Hauptverhandlungsrecht gebildet. Die Untersuchung schließt mit der Diskussion möglicher Änderungen der Strafprozessordnung und der Ausformulierung dreier konkreter Änderungsvorschläge: Die Anpassung des § 229 der Strafprozessordnung, die Einführung einer audiovisuellen Dokumentation der Hauptverhandlung und einer Ausweitung der Möglichkeiten zum audiovisuellen Verhandeln in der strafrechtlichen Hauptverhandlung.

Hauptverhandlungsunterbrechung und Urteilsfindung

This volume is the first in-depth collection to explore the impact of language on the field of comparative constitutional law. It addresses the epistemological and conceptual implications of English as the lingua franca. In this regard, it considers the global influence of Anglophone jurisdictions in orienting the discourse through the identification of concepts, designs and ideas that warrant engagement and exploration outside of those origin jurisdictions. In doing so, the book underscores that language is not a neutral device but can produce hegemonic pressures and expectations. It further makes the role of language in conducting comparative constitutional law explicit, so that its users can be more deliberate in their selection of foreign materials and are made conscious of the limitations of their findings due to language barriers. The book calls for a reckoning with the rich constitutional vocabulary that non-Anglophone jurisdictions have to offer to ensure a more holistic approach to the creation of knowledge. It also emphasises the need for the contextualised study of constitutional phenomena to appreciate how these are shaped by linguistic choices. In addition to raising awareness about language's significance as an epistemological, conceptual and methodological device, the volume also puts forward constructive tools and techniques to harness language's potential, making it an indispensable resource for scholars, students, lawmakers and judges.
