Hart Monographs in Transnational and International Law

This book connects European private international law with decolonial theory. Decolonial theory calls for alternative modes of producing legal knowledge - ones that give greater weight to the worldviews of formerly colonised peoples across the globe, including in Europe. At the same time, private international law has been described as a particularly suitable field for welcoming more otherness (altérité) in European law. This book therefore develops a decolonial theory of European private international law. To do so, it begins with Western court cases involving what the author terms a 'conflict of worldviews': a clash between the legal frameworks governing the dispute and the worldviews of the formerly colonised parties involved, referred to here as 'postcolonised worldviews'. Through three case studies - respectively addressing religious arbitration, Indigenous sacred land, and faith-based politics - the book demonstrates that courts routinely overlook these conflicts. As a result, the claims of formerly colonised parties are inadequately addressed. To remedy this structural discrimination within European private international law, the book proposes a pluralised theory of choice of court, foreign law, and international jurisdiction, more inclusive of the postcolonised worldviews present in the case studies. This is an important work, thought-provoking and challenging, which should be read by private international law and comparative law scholars, and more generally by legal and non-legal scholars interested in legal theory and decoloniality.

Conflicts of Worldviews and Private International Law

This is the second part of a 2-volume set which presents an in-depth investigation into the canon of constitutionally conforming interpretation. This second volume builds upon the insights of the first volume, which includes national reports on the use of constitutional interpretation. In Volume 2, the analysis is extended beyond the national context, discussing its application in the supranational and international contexts, including in EU law and the domestic use of international law. It presents several critical perspectives, challenging the legitimacy of constitutionally conforming interpretation, and looks at the invisible constitution, constitutional amendments, and the impact of legalism. The volume is rounded off by three comparative analyses, which formulate universally applicable insights. Together with Volume 1, this book fills an important gap in legal scholarship and sets the stage for cross-national discourse on this critical legal method.

Jurisprudence has up until recently largely neglected international law as a subject of philosophizing. The Nature of International Law tries to offset against this deficiency by providing a comprehensive explanatory account of international law. It does so within an analytical tradition, albeit within the one which departs from the nowadays dominant method of the metaphysically-driven conceptual analysis. Instead, it adopts the prototype theory of concepts, which is directed towards determining typical features constitutive of the nature of international law. The book's central finding is that those features are: normativity, institutionalization, coercive guaranteeing, and justice-aptness. Since typical features are context sensitive, their specificities at the international level are further elucidated. The book, finally, challenges the often raised claim that fragmentation is international law's unique feature by demonstrating that international institutional actors, particularly adjudicative ones, largely perceive themselves as officials of a unified legal order.

The Nature of International Law

Although International Humanitarian Law regulates various aspects of warfare, it remains silent on suicide attacks. Suicide Attacks and International Humanitarian Law interrogates this omission, arguing that it reflects underlying biases and rigid binaries within International Humanitarian Law that struggle to accommodate complex narratives of agency surrounding the deaths of suicide attackers. In this comparative study, Vishakha V. Wijenayake juxtaposes International Humanitarian Law principles with cultural narratives surrounding three distinct cases: the Kamikaze pilots of World War II, Liberation Tigers of Tamil Eelam's female suicide attackers in the Sri Lankan non-International Armed Conflict, and martyrdom operations conducted by jihadist non-State armed groups. Integrating insights from anthropology, philosophy, and religious studies, this book analyzes the nuanced embodiments of agency in these contexts, revealing how cultural depictions of suicide attackers challenge International Humanitarian Law's traditional victim-perpetrator binary. These narratives present suicide attackers not as passive instruments of violence, but as individuals whose actions are laden with cultural and collective meanings that unsettle International Humanitarian Law's reductive approach to combatant agency. Through its analysis, Suicide Attacks and International Humanitarian Law forwards a critical framework for engaging with diverse conceptions of intentionality and agency, advocating for more culturally inclusive approaches within International Humanitarian Law.

The 'New' International Law

Anna Irene Baka challenges dominant liberal and legalist paradigms in international law by reinterpreting the right of peoples to self-determination through the lenses of Aristotelian philosophy, phenomenology, social psychology, and corrective justice.
Focusing on high-profile postcolonial conflicts in Kosovo, Cyprus, and Palestine, Baka argues that abstract international and constitutional legal doctrines on self-determination fail to account for the lived realities of collective deprivation and historical trauma. Baka offers a compelling critique not only of mainstream theories of self-determination, but also of the shortcomings of critical movements such as Critical Legal Studies. In their place, she advances a renewed ethical and conceptual framework for international law-one grounded in responsibility, rational judgment, and moral engagement. This book retraces the emergence of conceptions of authorship in late-eighteenth-century Germany by studying the material form of Immanuel Kant's 1785 essay, 'On the Wrongfulness of Reprinting'. Drawing upon book history, media theory, and literary studies, Benjamin Goh analyses the essay's paratexts as indices of literary production in the German Enlightenment. Far from being an idealist proponent of intellectual property, Kant is shown to be a media theorist and practitioner, whose critical negotiation with the evolving print machinery in his time helps illuminate our present struggle with digital technology and the mounting pressures borne by copyright as a proprietary institution. Through its novel perspective on established debates surrounding authorship, this book critiques the proprietary conception of authorship in copyright law, and proposes an ethical alternative that responds to the production, circulation, and reading of literature.
