Presents a critical, in-depth analysis of the law-making process in the UK.

KC M: The Law-Making Process

The Law-Making Process

1. Legislation: The Whitehall Stage 2. Legislation: The Westminster Stage 3. Statutory Interpretation 4. Binding Precedent: The Doctrine of Stare Decisis 5. How Precedent Works 6. Law Reporting 7. The Nature of the Judicial Role in Law-Making 8. Foreign and Other Sources of Law 9. The Process of Law Reform

Why Big Labor moved to the right— and the fight ahead for the left to win back America’s working class Unions helped construct the American middle class, defeat Jim Crow, and advance progressive rights, but in Trump’s America, the labor movement is changing. In Big Labor's Big Shift, journalist Nathan Bomey explores how Big Labor and the working class are no longer an automatic ally of the American left. Fueled by decades of economic decline, political disillusionment, and cultural disenfranchisement, new politically nebulous and economically populist leaders in the movement are building a powerful new movement based on class warfare that prizes wage and benefit gains over traditional progressive priorities. Through original reporting and first-hand interviews, Bomey traces key events that have led to this political shift. Bomey reveals: -At the Teamsters, president Sean O’Brien is cozying up to Donald Trump and blasting Democrats as tools of big business, even showing up at the Republican National Convention to deliver his message. -At the United Auto Workers, president Shawn Fain is seizing an opportunity to break the free trade consensus in Washington. The devout Christian, who wields religious rhetoric from the stump, is aligning with the Trump White House on tariffs and blasting Democrats for aggressively pursuing electric vehicles to fight climate change. Bomey shows how the two interconnected phenomena represent a massive political realignment—not just along cultural and nationalism lines, but of the working class itself away from its historic roots in the Democratic party. Urgent and compelling, Big Labor's Big Shift encapsulates the fight for the soul of the union movement.

Big Labor's Big Shift

Studien zum europäischen und deutschen Öffentlichen Recht

Due to persistently high levels of cross-border organised crime within the European Union, a mismatch can currently be observed between the European area of criminal activity and the European area of security. Member States face difficulties in adequately responding to the European dimension of internal security, not only for political but also for legal reasons. This is because the provision of internal security is closely linked to the state's monopoly on the legitimate use of force, which in turn constitutes a central element of state sovereignty. What has received little attention so far is that the state's monopoly on the legitimate use of force is not an entirely untouchable domain.

Jul Krüger defines a scope within which the state's monopoly on the legitimate use of force can be modified-and thus Europeanised-in accordance with the concept of shared sovereignty in a union of states and constitutional orders. The four-level model of the monopoly on the use of force developed to capture this scope enables not only a differentiated analysis of the Europeanisation of the state's monopoly on the legitimate use of force (i.e. the status quo), but also an assessment of the extent to which modifications are compatible with the constitutional limits on the transfer of powers under Article 23(1), third sentence, in conjunction with Article 79(3) of the German Basic Law (i.e. an extension of the status quo).

Transfers and exercises of competences that are currently under discussion can be incorporated into the model developed in the study. On an abstract level, this allows for an initial assessment of whether modifications of the civilian monopoly on the legitimate use of force are compatible with constitutional and European legal requirements. The author illustrates this approach through a range of case studies.

International Studies in the Theory of Private Law

Constitutional Rights in Private Law

This book traces the legal creation of National Parks in England and Wales, considering how statute and case law shaped the different provisions within the National Park and Access to the Countryside Act 1949. National parks are often associated with hiking, holidaying, and nature but they are rarely perceived as legal spaces. Yet national parks in England and Wales only exist through the legal processes contained within the National Parks and Access to the Countryside Act 1949, a piece of legislation which is internationally unique in how it defines what a national park is. In celebrating the 75th Anniversary of the National Parks and Access to the Countryside Act 1949, the book examines the legally unique nature of national parks in England and Wales, exploring why these spaces were created in a legally distinct way. In doing so, the book takes the reader on a journey through the ever-evolving landscapes of planning law, administrative law, and property law in the 19th and 20th centuries, providing a new perspective on the enactment of national parks legislation. In presenting the National Parks and Access to the Countryside Act 1949 as part of a wider system of legal change, the book encourages the reader to think differently about national parks, emphasising the inherently legal nature of these spaces. This book is the perfect companion for any reader seeking to understand how national parks in England and Wales legally came to be.

Hart Studies in Constitutional Law

This open access book presents an all-encompassing way to understand lobbying: the 'Diversion Guide'. This shows that lobbying is problematic when institutions are diverted from acting in the public interest. It reveals why diversions happen, how they are linked together, and what can be done to prevent them. The reader can use the 'Diversion Guide' to identify any problem about lobbying, and test when an officeholder has been diverted from acting in the public interest. The book examines how lobbying can encourage citizen participation and lead to informed law and policy, but is not always fair. It considers the way in which wealthy and influential people can gain greater access to the United Kingdom's political system than most to shape the laws that govern everyone. Scandals are often reported in the media surrounding unequal access, corruption, the revolving door, and more. Unchecked, such lobbying corrodes trust in public institutions. It is vital that the problems surrounding lobbying are clearly understood to avoid a system of weak regulations and to ensure that better regulations are created to restore public trust in politics. The 'Diversion Guide' can be used to this end. The ebook editions of this book are available open access under a CC BY-NC-ND 4.0 licence on bloomsburycollections.com. Cornerstone on...

Inquests and inquiries form a distinct area of law in which the aim of the tribunal is to discover what happened, rather than who is right, wrong, or at fault. Cornerstone on Inquests and Inquiries provides an accessible, go-to guide to this area of practice, useful for both practitioners and parties involved. It looks at the field as a whole, acknowledging the commonalities between inquests and public inquiries, and providing a practical approach to each. The book also covers the field of parliamentary inquiries.
