Palgrave Socio-Legal Studies

This book examines the relationship between LGBTIQ communities and law in Australia from colonial times to the present day, with a particular concentration on the last 40 years. Using a socio-legal analysis that combines legislation, case law, media reports, policy materials and government data, it traces the historical shift from criminalisation and erasure to conditional legal recognition. The book develops a critical queer perspective, analysing how sexual and gender minorities moved from being classified through the figure of the criminal ‘homosexual’ to being recognised as members of LGBTIQ communities with a status of almost legal equality. Structured historically, its chapters examine distinct phases of legal reform, governance and LGBTIQ activism. The book covers key issues in sexuality, gender, family, embodiment and sex classification, while offering an extended account of the legal questions affecting lesbian, gay, bisexual, transgender, intersex and queer people. Although focused on Australia, it speaks to wider debates across post-colonial jurisdictions, Commonwealth countries and the United States.  is Lecturer in Socio-Legal Studies at the University of Sydney, Australia, where he has lectured since 2009. His research focuses on law, sexuality, gender and LGBTIQ communities. He has also taught sociology and criminology at the University of Newcastle.

This book offers a comprehensive and forward looking assessment of the European Union's integration of the Western Balkan countries, analysing the process through three interlinked perspectives: EU frameworks, domestic reforms, and intra-regional cooperation. It first examines the legal architecture that structures accession, including the long standing Stabilisation and Association Agreements, the EU's revised enlargement methodology, and the emerging Growth Plan for the Western Balkans, which strengthens conditionality by linking financial support to reform performance. Together, these instruments reveal both the possibilities and the persistent limitations of the EU's approach to preparing candidate states for membership. The second part turns to the Western Balkan states themselves, assessing the extent and effectiveness of reforms - most notably in the rule of law, now central to the "Fundamentals" cluster of the new methodology. The book analyses how far EU driven, top down reforms align with domestic constitutional and legal contexts and identifies the structural and political obstacles that may hinder the impact of EU conditionality. It also explores the scope for more locally grounded, bottom up reform initiatives. A third angle considers intra-regional integration efforts, such as CEFTA, the regional common market, the Berlin Process, the Open Balkan Initiative and cooperation through the Regional Cooperation Council. By evaluating their institutional design, legal commitments and enforcement mechanisms, the book compares these initiatives with the EU integration pathway and assesses their potential role as stepping stones to accession. It explores how the Court has developed a flexible, context-dependent approach to international law, which seeks to balance the autonomy of the EU legal order with the necessity of recognising and integrating international legal principles. Rather than focusing on landmark cases, the book analyses the CJEU's jurisprudence thematically, exploring the various ways the Court encounters and engages with international law. These include the use of international law as a source and inspiration of EU law, as a method of challenging the validity of EU law, and as method of interpretation. The book goes beyond analysis of the judgments and explores the broader context in which the Court navigates its relationship with international law. It examines the circumstances under which the Court establishes barriers around the EU legal order, such as when it develops the principle of autonomy, and when it builds bridges with the international legal order, such as when it seeks to engage with and develop international law principles. Through the lens of enforced disappearances and arbitrary detentions in international law, the book explores the weaknesses of the state-centric human rights system, emphasizing that states-often the primary violators-are responsible for ensuring compliance and enforcement. The book first examines the recent scourge of enforced disappearances and arbitrary detentions in a number of states, particularly those that have occurred transnationally. Through a detailed analysis of comparative state practice, including rising rates of transnational repression, the book highlights systemic deficiencies and later proposes various reforms to strengthen global human rights protection. The book advocates for an integrated approach, merging international humanitarian law, human rights law, and international criminal law to enhance enforcement and accountability. The book reviews why using an integrated approach to tackling violations will result in far better protections, arguing that abandoning a silo approach to international law and applying international human rights law and international humanitarian law together, especially in the context of international criminal law, will yield far better results. How greater integration can be achieved in theory, is examined. Also reviewed, are how international bodies that work on arbitrary detentions and enforced disappearances, do so in practice. The key challenge that is taken up is how international law can be improved to ensure that the worst violators can be made to comply with international law. Remedying International Law and Institutions

Enforced Disappearance and Arbitrary Detention

Drawing on broader legal-political discourses within the party-state and institutionalised academia, this book shines a light on one of the most controversial legal principles in Chinese criminal justice: the presumption of innocence. It argues the reasons why there is no presumption of innocence in China, tracing the curve, or evolution, of academic discourse about presumption of innocence against the backdrop of changing politics, or varying emphases on national conditions, from Mao Zedong to Xi Jinping. The book deepens our understanding of the trajectory of criminal justice reforms in the party-state and shows how the more open and liberal phases of the reform era opened up some space for pluralist views and constructive criticism. In comparison, the second wave of autocratisation of the system influenced the conception of the criminal and paved the way for an illiberal turn.

Building on cultural norms in creative communities to reuse, recreate and share, the book proposes a more holistic approach to reconcile conflicting copyright interests. Drawing upon Niklas Luhmann's system theory, John Dewey's theory of art and feminist data theory, it advocates access to, and care within, creative communicative spaces, such as social media platforms or artificial intelligence (AI) data infrastructures, to safeguard creativity and cultural production online. Following a comprehensive assessment of current EU copyright law and related regulation, it proposes a rebuttable presumption of artistic communication to account for the nature of communication between authors, users and the public that safeguards creative reuse. The book isolates the question of remuneration, particularly in AI context, as one of collective socio-cultural value to address wider harms through a cultural commons existing on the border of the EU copyright system. This book offers the first comprehensive study of unjust enrichment as a principle of international law. While domestic legal systems have long recognised unjust enrichment as a basis for restitution, its role in international law remains underexplored. This book addresses this gap by examining the roles of the international norm against unjust enrichment both as an independent basis for a claim and in the development and interpretation of other international norms. It explores the far-reaching implications of this norm for inter-state relations and investment arbitration. The book advances three key arguments: that unjust enrichment claims in international law may extend to indirect recipients; that states enriched through conduct harming another state can incur liability in unjust enrichment even without a transfer of value from the harmed state to the enriched state; and that the principle of unjust enrichment is not merely subsidiary to the law of state responsibility for internationally wrongful conduct. Through rigorous analysis, the book explores the rationales underlying unjust enrichment - proprietary, fairness, and wrongfulness - and evaluates their applicability in the international arena. It also considers practical challenges such as indeterminacy, multiple-claimant situations, and the risk of proliferating disputes. The balance of authorship ensures that the collection as a whole reflects both the internal operation and culture of the ADF, and provides an independent, critical perspective on it. The issue of military discipline in both domestic and international settings has received extensive and ongoing media and public attention in the last decade. The public interest in the topic was apparent between 2013 and 2017, when investigations of the ‘Skype’ and ‘Jedi Council’ scandals revealed that male ADF members had been producing and sharing online footage of sexual encounters with women without the consent of the women involved, and accompanied by sexist and disrespectful commentary.
