This book studies how international law is evolving to meet the challenges of the digital age. This book tries to answer this question by presenting a detailed analysis of how international law is responding or failing to respond to the digital economy.

The author investigates how leading countries with advanced digital economic systems, including the regulation of cryptocurrencies or digital trade and E-commerce in the European Union, China, and USA, have approached these issues. Taking the WTO and the UN as examples, the book examines the efforts made by these international institutions to retrofit traditional legal structures for a world increasingly defined by the internet. Can global trade rules designed for physical goods be applied to digital products and services? How can global institutions facilitate cooperation between countries with drastically different levels of technological development? These questions shape the discussion.

Dieser Tagungsband befasst sich mit den Herausforderungen des Gesundheitssektors, einerseits dem Gebot nachhaltigen Handelns und des Klimaschutzes gerecht zu werden, ohne dabei andererseits seine ursprüngliche Aufgabe, Gesundheitsschutz zu gewährleisten, zu vernachlässigen. Aus juristischer Perspektive widmen sich die Beiträge daher den verfassungsrechtlichen und einfachgesetzlichen Rahmenbedingungen einer nachhaltigen Gesundheitsversorgung, auch aus rechtsvergleichender Perspektive. Each reflection follows a consistent structure: the Principle’s text, commentary, illustrative examples, and explanations, all grounded in official Unidroit&nbsp;documents. The book clarifies the rationale, aims, and drafting process behind each Principle, showing their relevance and alignment with international standards. This resource is invaluable for lawmakers, judges, lawyers, entrepreneurs, and students seeking clear guidance on interpreting and applying the DAPL Principles to digital assets law.
This work was financed within the framework of the Prometeo 2023 project of the Regional Ministry of Innovation, Universities, Science and Digital Society (CIPROM/2022/26) “Present and future of the regulation of cryptoassets in the EU [LegalCripto]”, whose principal investigator is María del Carmen Pastor Sempere. The basic ideas contained herein were presented in the author's paper with the same title, given on November 13, 2024 at the IV International Congress on “Unidroit Principles on Digital Assets and Private Law: Context, Content, Perspectives”, organized also by BAES Research Group of the University of Alicante on November 13 and 14, 2024.

Sustainability Law: Comparative, Interdisciplinary, and Intradisciplinary Perspectives

Carmen Freyler's study deals with the relationship between the law of commercial transactions based on the concept of a merchant and the law of contractual obligations, which is linked to the concept of an entrepreneur. The uniformity is not a finding, but the aim of the investigation. Neither the conditions of application nor the statutory system indicate a harmonisation of the two relevant regulatory complexes of entrepreneurial business transactions. Conflicts of norms and contradictions in judgement arise, particularly with regard to consumer protection law.

In the opening chapter, Finnis takes up the challenge of reading Petrażycki not simply as a historical curiosity of Eastern European jurisprudence but as a thinker whose wide-ranging and ambitious ideas continue to spark debate today. He critiques not only Petrażycki’s non-standard “economic analysis of law,” which differs markedly from the Chicago School model (not to mention from Guido Calabresi’s and Pietro Trimarchi’s versions), but also many other aspects of Petrażycki’s various contributions to jurisprudence. These include, above all, his legal-realistic but nonetheless appreciative treatment of the natural-law tradition(s), which makes Petrażycki both distinctive and difficult to classify in terms of standard schools of thought.Finnis’ essay is followed by nine further contributions. Written by scholars from different traditions and standpoints, they criticize, reassess, and elaborate upon Finnis’ arguments, creating a rich and multi-voiced dialogue. The volume concludes with Finnis’ own, extensive “concluding reflections,” in which he directly responds to his fellow contributors, clarifying his original questions and replying to the challenges raised in their chapters.This unique volume showcases Finnis’ insights, while enabling his interlocutors to highlight the depth and complexity of both Finnis’ and Petrażycki’s thought, as well as broader issues – more relevant now than ever – such as the differences between Catholic natural law, Orthodox natural law, and Petrażycki’s atheistic, humanistic, anti-speciesist ideal of substituting love for law and morality alike.
