Seit vielen Jahrzehnten zählt Ingeborg Puppe zu den bekanntesten Persönlichkeiten der deutschen und internationalen Strafrechtswissenschaft. Ihr methodenkritischer, an der analytischen Philosophie geschulter Denkstil hat Generationen von wissenschaftlich interessierten Strafrechtswissenschaftlerinnen und Strafrechtswissenschaftlern inspiriert, belehrt und herausgefordert. Im vorliegenden Band werden einige der Kernthemen von Puppe kritisch beleuchtet: wissenschaftstheoretische Grundfragen, Probleme des Allgemeinen Teils und auch des Besonderen Teils des Strafrechts. Immer wieder zeigt sich, dass Puppes Analysen oft ihrer Zeit voraus waren und ihr nüchtern-rationaler Problemzugriff, ungetrübt von strafrechtswissenschaftlichen Moden, dem Wandel der Zeit standgehalten hat. Ihr Werk bildet deshalb ein hervorragendes Beispiel für eine Strafrechtswissenschaft, die nicht den jeweils tagesaktuellen Fragestellungen hinterherläuft, sondern Grundlagenprobleme in einer Weise thematisiert, die auch nachfolgenden Wissenschaftlergenerationen Orientierung geben können.

In its current form, Section 52(1) of the German Code of Criminal Procedure does not grant many relatives in modern family forms the right to refuse testimony. Annina Eckrich examines whether this exclusion remains appropriate and how the provision should be adapted to reflect contemporary family realities.
 

 An analysis of the applicable legal framework and the protective purposes of Section 52(1) StPO shows that relatives in modern family forms are insufficiently protected. In conjunction with the fundamental rights that give rise to the state's protective obligations, existing protection gaps become apparent. The level of protection required by Article 6(1) of the Basic Law cannot be achieved through traditional methods of interpretation or through incremental judicial development of the law. To ensure comprehensive constitutional protection of the family, Section 52(1) StPO must therefore be interpreted in conformity with the constitution. The author conducts a thorough examination of whether the testimonial obligation of relatives is compatible with the Basic Law, the European Convention on Human Rights, and EU law. She concludes that the current version of Section 52(1) StPO, in conjunction with Section 48(1) sentence 2 StPO, partially violates Article 6(1) of the Basic Law-in its function both as a defensive right and as a specific equality guarantee. The functionality of the criminal justice system may be considered a potential justification. However, a more detailed engagement with this concept shows that it does not suffice to justify the resulting interferences in all cases.

This book is the first study to consider findings from sociology, legal anthropology, ethnology, legal pluralism, comparative law and theology in order to gain a better understanding of the diverse cultures of global Catholicism and the cross-cultural challenges arising from Roman Catholic canon law within the local churches. The author, renowned for her work at the intersection of socio-legal studies and canon law, examines the latter as a distinctive example of a European religious legal system that cuts across the myriad legal cultures of the local churches. In light of findings on legal transfer and legal colonialism, and by examining canon law within the emerging field of social and cultural studies approaches to law, her book sheds light on how canon law is imposed upon and received by the local churches around the world. It analyses the challenges and problems arising from the law’s transcultural claims within these churches. Based on these observations, the study discusses the critical stance of canon law within contemporary Catholicism and the current debates on a synodal reform of the church and its law.&nbsp; The book adopts different perspectives: As a sociological study, it describes the contemporary Eurocentrism of global canon law and the conflicts arising from it. As a theological study, it presents ecclesiological reasons for challenging the hegemony of global legislation. As a study of canon law, it suggests ways in which legislation could permit greater diversity while maintaining the unity of the universal church. By analysing canon law as a specific example of a religious legal order with cross-cultural ambitions and global claims, the book also contributes to the study of transnational law in general by illustrating the typical problems that accompany transnational legal regimes in both secular legal systems and religious groups.

Dieser Tagungsband befasst sich mit den Herausforderungen des Gesundheitssektors, einerseits dem Gebot nachhaltigen Handelns und des Klimaschutzes gerecht zu werden, ohne dabei andererseits seine ursprüngliche Aufgabe, Gesundheitsschutz zu gewährleisten, zu vernachlässigen. Aus juristischer Perspektive widmen sich die Beiträge daher den verfassungsrechtlichen und einfachgesetzlichen Rahmenbedingungen einer nachhaltigen Gesundheitsversorgung, auch aus rechtsvergleichender Perspektive. Zudem wird der Einfluss von Nachhaltigkeit auf das individuelle Arzt-Patienten-Verhältnis sowie auf das Medizinprodukterecht beleuchtet. Schließlich werden aus ökonomischer Perspektive mögliche Transformationsprozesse mit dem Ziel der Klimaneutralität aufgezeigt, ergänzt durch aktuelle Ergebnisse aus der Forschung des Deutschen Krankenhausinstituts.

Nachhaltigkeit im Gesundheitswesen

Der Larenz ist seit Jahren ein Klassiker unter den Lehrbüchern zur juristischen Methodenlehre. Um das Buch auch Studenten zugänglich zu machen, haben sich Autor und Verlag zur Publikation dieser gekürzten Studienausgabe des Buches aus der Enzyklopädie der Rechts- und Staatswissenschaften entschlossen. Neben der Aneignung von Kenntnissen in den einzelnen Rechtsgebieten und der praktischen Übung im Lösen von Fällen ist der Erwerb des methodischen Rüstzeugs für ein erfolgreiches Studium von besonderer Wichtigkeit. In the opening chapter, Finnis takes up the challenge of reading Petrażycki not simply as a historical curiosity of Eastern European jurisprudence but as a thinker whose wide-ranging and ambitious ideas continue to spark debate today. He critiques not only Petrażycki’s non-standard “economic analysis of law,” which differs markedly from the Chicago School model (not to mention from Guido Calabresi’s and Pietro Trimarchi’s versions), but also many other aspects of Petrażycki’s various contributions to jurisprudence.
