A Community of Law and a Community of Judges

What is the role and responsibility of the community when it is involved in a restorative process? This Little Book aims to expand upon the roles and responsibilities of community stakeholders in healing and repairative approaches to justice. Whether family members, friends, neighbors, concerned citizens, or system actors,&nbsp;the range of needs, obligations, and opportunities to engage with restorative justice processes is vast and deserving of greater attention. In this Little Book, Sheryl Wilson and Caitlin Morneau draw on experience in restorative justice facilitation, education, community organizing, and leadership in movement building to illuminate pathways that invite, expand, and sustain restorative justice engagement. The authors offer reflection, analysis, and considerations for community member support and inclusion in restorative justice processes and movement building. This book is for the secondary victims of harm (witnesses or bystanders) who may not understand where they fit in the space of harm repair. This book is also for those in support of a person who caused harm and needs guidance on where they fit. Lastly, this book is for those in close proximity to harmful events and care about those who occupy the same space. As a community, there are ways people mobilize in organized groups when things go wrong, but what about when things are going right? How can we be good neighbors, co-workers, colleagues, and friends, so that when we do face challenges, we have a good starting place?

Little Book of Restorative Justice & Community

This open access book critically analyses a wide range of consumer law issues generated or exacerbated by the Internet of Things. The Internet of Things challenges many of the dichotomies which have shaped current laws: goods-services, hardware-software, tangible-intangible, online-offline. The book focuses on 4 specific challenges: things-as-service, liability, bricking of physical devices through software control, and the potential for enhanced personalisation, especially for digital assistants. The chapters analyse specific applications such as smart homes, connected cars, and consumer wearables with a view to providing innovative solutions to the new challenges posed by the Internet of Things, and to steer the development of the Internet of Things in a fairer direction. As well as offering an important analysis of the potential for smart consumer laws in the Internet of Things, the book also provides important insights into the growing divergence between Germany's and the UK's consumer laws since Brexit. From Smart Technologies to Smart Consumer Law

Does parole have a future? If it does, can we begin to imagine a different path? Is progressive penal reform possible, or has the time come to consider more radical alternatives in a context where there is little, if any, consensus on the underlying aims and techniques of contemporary prison release? What does this all mean for the prisoners, families, victims and publics upon whose confidence the parole system ultimately depends? This book brings together a world-leading panel of 27 experts who draw upon insights from law, sociology, criminology and political science to explore these pressing questions. At a time when many parole systems are experiencing considerable strain, the aims of this collection are twofold: first, to encourage systematic and critical reflection on the rationalities, institutions and practices of parole. Second, to think big, and pose ambitious 'what if' questions about the possible futures of parole and prison release. Offering novel insights from Asia, Australia, Europe, North America and South America, this collection builds the case for, and then showcases, a 'way of doing' parole research that is global in outlook, interdisciplinary in approach and unapologetically normative in character.

The dramatic story of how a small neighborhood in Connecticut became the site and symbol of a political conflict over the use of eminent domain, mobilizing a national property rights movement. In 2000, Susette Kelo and other residents of the Fort Trumbull neighborhood sued the city of New London, Connecticut. Two years earlier, the pharmaceutical giant Pfizer had built a facility adjacent to this area. Shortly thereafter, the city empowered the privately owned New London Development Corporation to use the power of eminent domain to implement a “comprehensive redevelopment plan” for the neighborhood. While the plaintiffs argued that economic development did not qualify as a valid “public use” under the Takings Clause of the Fifth Amendment, the Supreme Court decided in a controversial 2005 decision that the potential economic benefits of the plan justified the condemnation of private property as long as appropriate compensation was paid. The Kelo decision implied that any town could transfer property to private developers on the grounds of possible future tax revenue and job creation, so long as that action was included in an economic development plan. The outrage over the decision unleashed a near-unanimous backlash, even resulting in an executive order from President George W. Bush instructing the federal government to limit the use of eminent domain. Numerous states passed ballot initiatives and legislation restricting eminent domain in the wake of the Kelo case. Despite this outcry, urban planners and others defended it as a necessary application of existing precedent that allowed cities flexibility to combat economic downturns. Lead plaintiff Susette Kelo and her pink house became a symbol of a growing national property rights movement and a deepening conflict between public officials and property owners, between large corporations and local communities. Perhaps most disastrously, after bulldozing the neighborhood the developer was unable to secure the necessary financing and abandoned the project, leaving empty lots where the plaintiffs’ properties once stood. It would be many years before a feasible plan led to actual new construction and improvements. Not for Sale recounts this iconic episode in recent legal history, giving full attention to both the human and legal elements of the story and offering a balanced consideration of each. The story remains as relevant as ever, especially since the Supreme Court has repeatedly refused to reconsider its decision, most recently in Bowers Development, LLC v. Oneida County Industrial Development Agency (2025).
