Examining A New Era in Data Protection

This book provides a timely and much-needed critical legal review of children's participation in healthcare that goes beyond merely documenting the extent and scope of participation, and explores the importance, definition of, and barriers to their meaningful participation. Addressing a gap in the literature, the book uses a combination of empirical data, childhood and participatory theory, and legal analysis to study the participation of children and young people in the medical context from a child's rights perspective. Centring the unheard and underrepresented lived experiences of recent and past child patients, and doctors, the book uses Interpretative Phenomenological Analysis, a methodology traditionally used in psychology, to provide a refreshing and unique exploration of children's participation in their healthcare. The book explores to what extent national law and international non-binding conventions have created a 'right' to participation, studies the application of national law in clinical practice asking whether the law facilitates meaningful participation, and analyses the interaction between law and quasi-legal regulations. The book will be useful for academics, children's activists, and legal and clinical practitioners.

Property Law and Climate Change: Inextricably Linked

People with mental illnesses in the United States are 10 times more likely to be incarcerated than hospitalized. In fact, seventy percent of individuals in jail in the United States have a serious mental illness, a substance use disorder, or both. After confronting the failures of our criminal justice system first-hand, Miami-Dade County (Florida) Judge Steven Leifman realized that for the system to improve, a radical change was necessary. In 2000, he created Florida’s 11th Judicial Circuit Criminal Mental Health Project, later renamed to the Jail Diversion Project (JDP), which has since become the most impactful model for prison reform in the country and garnered international accolades. Complete Justice reveals Judge Leifman’s courageous and visionary efforts to successfully overhaul and restructure Miami-Dade’s mental health and criminal justice systems. The results were nothing short of miraculous. Arrests were cut in half, the jail audit was reduced by almost half, police shootings almost stopped, and the county was able to close one of its three main jails at a savings of millions of dollars. Best of all, his results are replicable and scalable. Leifman has created a state-of-the-art, transferable model, the “Miami Model,” that is starting to be applied around the country in communities large and small. This highly successful initiative, consisting of both pre-arrest and post-arrest diversion programs, brings together the resources and services of law enforcement, the justice system, and community stakeholders to divert individuals with mental illnesses who commit low-level offenses away from incarceration and into community-based care. This book investigates measures to increase diversity in the legal profession of England and Wales and the impact of equality law on what has been done, focussing on how law enables organisations lawfully to take positive or affirmative action. The book combines a qualitative interview study of lawyers, legal regulators, recruitment consultants and other civil society actors, with analysis of developments in the legal profession, in equality law and in understanding of the role of law in society. The evidence paints a puzzling picture of the law on positive action being both very little known and seen as limiting what employers do to advance equality, much as significant positive action has been taken anyway, at least in this section of the legal profession. The glimpse into legal practice revealed complex attitudes, persistent barriers to fundamental change, and, in hindsight, that the larger forces driving inequality mean that liberalizing positive action laws was never likely to make much difference. This case study therefore cautions against overestimating equality law's power to deliver change while putting forward strategies for enhancing its effectiveness. At the broadest level, the book argues for frank acknowledgment of law's limitations, a stronger focus on understanding how legal interventions function in practice before deploying them, and for the full implications of law's limits to be traced through in politics and society. The urgent need is for renewed effort to discover and build other mechanisms for addressing inequality and the many other major challenges we currently face.
