A PRACTICAL MANUAL: Repair Duties and Consumer Rights under Directive (EU) 2024/1799

Studies of the Oxford Institute of European and Comparative Law

Drawing on the experience of recognised experts from across a range of different fields and jurisdictions, this landmark publication tackles default rules in private law in comparative perspective. Often underestimated, but highly influential, default rules are non-mandatory rules that kick in where nothing else has been agreed or provided. The contributions explore default rules from a variety of angles relevant to both scholarship and legal practice, including: · behavioural aspects and the role of platform terms in the digital age; · the remit and operation of defaults in different areas, ranging from contract and commercial law to succession, civil procedure and private international law; · a comparison between Common law and Civilian approaches as well as the EU level; · the perspectives of different 'players' engaged in the generation and application of default rules.

Default Rules in Private Law

Solutions to the climate crisis tend to fall into two categories: the hope that humanity will change how it operates in time to offset the worst of the damage, and the hope that technology will pull us back from the brink without the need for major structural or societal reform. This book argues that reliance on technology without such reform risks becoming as divisive as inaction. Those parts of society most responsible for carbon emissions will, largely, be able to take advantage of technological advances to make life bearable, while those least responsible will often be bypassed by them. Focusing on disparities in access, structural barriers, community-based action, intersectionality and policy and legislation, the book makes recommendations aimed at fostering a fairer and more just distribution of the benefits of green technology.

This volume of the Netherlands Yearbook of International Law (NYIL) examines general principles of law, which, alongside treaties and customary international law, traditionally form one of the three formal sources of international law, as enshrined in Article 38 of the Statute of the International Court of Justice (ICJ). The contributions in this volume are situated in the wider discussion on general principles reignited by the recent ILC reports and the reports of the Special Rapporteur on the matter. It aims to be part of a renewed wave of engagement with both the substance and methodology surrounding this mercurial formal source of international law.
Diverse functions are attributed to general principles by scholarship and case law: they are a source of various rules which merely form an expression of them; guidelines for a framework for interpretation/application of other rules; lacuna-filling norms; a source of interpretation of treaties and custom; a means for developing new treaties and custom; a supplemental source to treaties and custom; and even a modifier of treaties and custom. ‘General principles’ are here examined through various areas of international law, revealing their deep connections with other sources, overarching concepts such as time and change, and their diverse manifestations across the field.
As a double-blind peer-reviewed publication, NYIL offers a forum for the publication of scholarly articles of a conceptual nature in a varying thematic area of public international law. In addition, as of 2012 each volume includes a section entitled ‘Dutch Practice in International Law', which replaces the section previously dedicated to Documentation. The NYIL has been published under the auspices of the T.M.C. Asser Instituut since 1970.

This book traces the legal creation of National Parks in England and Wales, considering how statute and case law shaped the different provisions within the National Park and Access to the Countryside Act 1949. National parks are often associated with hiking, holidaying, and nature but they are rarely perceived as legal spaces. Yet national parks in England and Wales only exist through the legal processes contained within the National Parks and Access to the Countryside Act 1949, a piece of legislation which is internationally unique in how it defines what a national park is. In celebrating the 75th Anniversary of the National Parks and Access to the Countryside Act 1949, the book examines the legally unique nature of national parks in England and Wales, exploring why these spaces were created in a legally distinct way. In doing so, the book takes the reader on a journey through the ever-evolving landscapes of planning law, administrative law, and property law in the 19th and 20th centuries, providing a new perspective on the enactment of national parks legislation. In presenting the National Parks and Access to the Countryside Act 1949 as part of a wider system of legal change, the book encourages the reader to think differently about national parks, emphasising the inherently legal nature of these spaces. This book is the first investigation of the relationship between EU digital sovereignty and sustainability strategies. It maps the ambitions and limitations of EU digital strategic autonomy and explores the structural challenges underlying its relationship with its green transition objectives in the context of the ongoing wars in neighbouring European countries and the consequent tensions in the EU energy sector. The EU is racing to achieve technological independence from third countries and foreign multinational companies to protect its digital sovereignty and preserve its fundamental rights.
