Considering the unique character of taxation, such as the necessary discretionary power of tax administration, the complexity of tax issues, and nascent development of tax systems in many developing countries, this book provides a comprehensive analysis of tax disputes from the viewpoint of protecting the legitimate fiscal conduct of host State in investment arbitration that are of both theoretical and practical importance.

Considering the unique character of taxation, such as the necessary discretionary power of tax administration, the complexity of tax issues, and nascent development of tax systems in many developing countries, this book provides a comprehensive analysis of tax disputes from the viewpoint of protecting the legitimate fiscal conduct of host State in investment arbitration that are of both theoretical and practical importance. The book tries to rectify and fulfill the lacunae of scholarship on tax disputes that has been hitherto overwhelmingly investor-centered. The most distinguished characteristic of the book lies in the manner in which it deals with the arbitration of taxation in a comprehensive and coherent manner, including the discussion of tax stabilization clause in investment contracts that is paramount to the tax sovereignty of State. It also combines the analyses of the taxation problems from the perspective of comparative tax law of the most relevant legal systems as well as rich tax jurisprudence of WTO and European Court of Human Rights (ECtHR).

This book attempts to understand the operation and properties of 'market economies'. We do this by carefully examining, refining and in some cases extending the major theorems that Microeconomics has established in response to the Walrasian conjecture. We critically evaluate theorems and results, that assert the existence, uniqueness, stability, optimality and empirical relevance of Walrasian equilibrium states. As a result of our work, we attempt to comment on the wisdom of recommending that socio-economic systems operate as a collection of deregulated competitive markets.

The law codes in the Middle East North Africa (MENA) region are a well-crafted blend of civil and Islamic law in which civil law principles do not violate Islamic provisions. Yet, common law principles derived either from English common law or Islamic customary usages remain unidentified and thus ignored. Here, this complex scenario is rectified through a comparative analysis of the primary data (e.g. cases, statutes and arbitral award decisions), adding common law and uncodified Islamic custom to MENA law codes. The purpose of this comparative analysis is to allow common legal principles found in civil, common and Islamic law to be distilled in order to create a new, harmonised international commercial arbitration law code (HICALC) or uniform Arab arbitration law (UAAL) for adoption in the MENA region, where these principles already greatly influence the legal systems and can be readily assimilated into a harmonised or uniform code. The work demonstrates that this new code would lead to improved arbitral award enforcement in the MENA.

First published in 1983, French Planning in Theory and Practice (now with a new preface by the authors) provides the first detailed account since the late 1960's of the French system of economic planning, and its relevance for other market economies. It offers an original and non-technical rationale for planning in a market system and examines the decline in French planning, at a time when the new government was attempting to extend the traditional planning system.The initial theoretical part of the book is primarily addressed to economists. It reviews the literature on indicative planning and argues that it is severely deficient, above all in failing to take account of the implications of uncertainty on private decision-making. These problems have empirical relevance for the French experience, and lead to the proposal for a different form of planning, supplying co-ordination that would not be spontaneously forthcoming in the public or private sectors. The analysis goes beyond the scope of French planning and has policy relevance for all market economies.Although written with the main analytic issues in mind, the remainder of the book stands independently as a comprehensive study of planning in France. It traces the gradual loosening of the links between policy making and planning in France and tries to draw the lessons from this experience for the practice of planning. The authors conclude that the type of planning that had seemed so successful in the 1960's was simply no longer possible in the economic and political climate of the 1970's, yet no real attempt was made to define an alternative role for the plan. The political and administrative authorities were happy to see planning fade. The arrival of the Socialist government offered great scope for the revival of the process, but the authors caution against supposing that political will was the only vital ingredient. The book is based on extensive interviews with planners, analysts, and decision-makers as well as on published and unpublished written and statistical sources.

The primary objective of this book is to address a formal representation of household economy in welfare economics in spatial terms. Although it has been argued since the nineteenth century that in exploring a reasonable indicator to measure the real welfare level of households, several difficulties remain to be faced in economic theory. The most relevant method in this specific topic is social welfare function. While various types of indicators were historically developed and improved as a replacement of existing economic growth indicators such as GDP and GRP using social welfare function, there still is a problem with evaluating the individual's utility as an aggregate term. As an alternative method of measuring the real welfare level of households, location theory may be a possibility for solving some potentially problematic issues. To be precise, location theory requires the inclusion of notions of transportation costs, spatially constrained internal and external economies, and other distance-related variables. From the standpoint of equality, this specific approach enables an analysis to investigate spatial differentiation. In other words, spatial differentiation of households can be interpreted as spatial consumer exclusion. Hence, the real welfare level of households can be measured by means of the accessibility of goods and services, of which there are several types, such as essential and luxury ones. As a result, spatial distribution of goods and services depending on their types can be considered a component of social welfare function. The topics addressed in the book include social welfare function in spatial terms, location theory related to firms and households, attractiveness of regions, economic and social infrastructure elements, and sustainable growth and development of regions.

Whiting advances institutional economic theory with original survey and fieldwork data, addressing two puzzles in Chinese political economy: how economic development has occurred despite insecure property rights and weak rule of law; and how the Chinese state has maintained political control amid unrest. Whiting answers these questions by focusing on the role of illiberal law in reassigning property rights and redirecting grievances. The book reveals that, in the context of technological change, a legal system that facilitates reassignment of land rights to higher-value uses plays an important and under-theorized role in promoting economic development.
