This book analyzes the legal tensions that exist in the economy that purports to "reanimate" the dead using postmortem digital technologies. Technological reanimation has proven to be big business, with many notable commercial entities investing in this "afterlife economy". Postmortem technologies convincingly replicate the appearance, physiognomy, conversation styles, and thought patterns of a deceased individual by generating digital copies that act in their stead. In the entertainment industry, new works can be created with dead celebrities through a postmortem copy that is managed by their representatives. The result is an economy in which the dead are offered as a product or service to consumers, with some having their artistic legacies extended past death through an "afterlife career". Many stakeholders stand to benefit from such a lucrative afterlife economy, but the law is simply not prepared for the issues that will arise with this exploitation of the dead. Reanimation requires the exploitation of one's reputation, persona, artistic works, and personal data. However, the corresponding legal protections are either nonexistent, inapplicable, or inconsistent across borders - depending on which posthumous interest is analyzed. In response, and by studying the contours of the existing legal protections in the afterlife economy, this book proposes a system rooted in the "shared ownership" of one's postmortem copy and the responsible "stewardship" of legacies through fiduciary duties.Law and the Digital Reanimation of the Dead will be of considerable interest to scholars working in the areas of entertainment law, intellectual property, and law and technology, as well as others with professional interests in the area.

Why do some international courts wield broad authority while others face pushback or fade into irrelevance? This book provides novel theoretical and empirical insights into this question. It offers a fresh, interdisciplinary perspective on the authority of international courts, drawing from law, political science and behavioural research. It develops, in Part I, a theoretical model and analytical framework for assessing these questions. The model explains how authority relationships between courts and their audiences - such as states, NGOs, individual applicants, and domestic courts - are formed, maintained, or contested. In Part II, the book applies this analytical framework to in-depth case studies of two selected international courts: the European Court of Human Rights and the Court of Justice of the Economic Community of West African States. These studies not only provide deeper insights into the authority of these courts but also demonstrate how the analytical framework can be applied to other international courts to generate an enhanced understanding of international court authority. Originally published in 1962, this is an important work in the history of Trade Unionism. The period covered by this volume saw momentous changes in the structure of trade unionism in the mining industry in England. In 1914 every coalfield had its own District Union. These district unions were bound together into a loose Federation. During the war years the locus of power shifted from the district associations to the national Federation. Internal arguments in the Federation based on economic and ideological grounds took place during the 1920s.A grass-roots study, this book shows why non-political trade unionism took hold in the Nottinghamshire coalfield but failed elsewhere. The importance of the Nottinghamshire pits was their economic position, which was favourable in comparison to other mines. The book examines the character and decision-making of the people who shaped the destiny of the miners in the 1920s and 30s and discusses the difficult period from 1926-1937 when the old Nottinghamshire Miners' Association was ignored by the coal-owners. The merits of district settlements which would enable the Nottinghamshire miners to maintain their relatively high wages, compared with national settlements which would tend to depress wages in the more highly paid counties are also analysed.The book will be of interest to economic and industrial historians, and students of industrial relations.

Why socially responsible investment promises to make investors richer and the world better—but fails at both. Wall Street thrives by telling investors that clever financial strategies can reverse the trade-off between corporate profits and social progress. But the link between greater corporate social responsibility and improved financial performance is an illusion. Profit vs. Progress dissects the massive $30 trillion “socially responsible” or “sustainable” finance industry—and finds the emperor has no clothes. At best, sustainable investing typically delivers average rates of financial and social returns. But it makes social and environmental crises harder to overcome, by using financial gimmickry to distract our attention from real solutions. Author Brad Swanson argues that corporations in competitive markets act without moral values, and ethical investment can’t prod them to take greater social responsibility. The only way to change the outcome of the game is to change the rules. The solutions will have to come from legislatures, not corporate boardrooms. Swanson calls for public policies to make businesses better serve all of society, not just their shareholders—without blunting their edge. His recommendations include breaking up the cartel of large asset managers, rebuilding the influence of organized labor, curbing the rapacious behavior of the private equity industry, and eliminating the conflict of interest that pits corporate directors against the greater good of the community. A Sociology of International Investment Law applies methods associated with the sociologist Max Weber to illuminate aspects of international investment law - a regime made up of thousands of treaties that protect foreign investors from state action diminishing the value of their investments. By applying many of Weber's key themes associated with legal modernity - legitimacy, rationality, domination, bureaucracy, and charisma - the book conscripts tools of analysis that enable the testing of many of investment law's operating assumptions. A Sociology of International Investment Law Law is premised on the belief that theory informs practice and that enlisting aspects of Weber's work illuminates the contemporary practice of, and debates over, international investment law. Utilizing Weber's themes and methods, results in a deeper appreciation of the connections of international investment law has with classical social theory.
