‘Reasonable expectations of privacy’ have become a cornerstone concept in privacy and data protection legislation worldwide, extending today from US constitutional law to the GDPR, Article 8 ECHR, and various Asian and African data protection frameworks. This book offers a comprehensive analysis of this complex and ambiguous legal concept, addressing the many questions regarding its proper function, interpretation and application. Tracing the notion's evolution from the 1967 Supreme Court ruling in ‘Katz v United States’ to its status as a widespread paradigm of global privacy discourse, the work illuminates the many fallacies that pervade both academic and judicial interpretations. At its core, the book explores and evaluates four distinct models of ‘reasonable expectations,’ analysing their normative foundations and practical implications in depth. In doing so, the book also contributes to broader discussions within privacy and data protection theory, as it identifies and evaluates different strategies for regulating privacy conflicts, such as interest balancing or social norms-based regulation. Finally, the book also makes significant contributions to the scholarship on the EU General Data Protection Regulation (GDPR) and Article 8 ECHR, evaluating how 'reasonable expectations' operate within these contexts from empiric and normative perspectives.

Further, these innovations might have negative effects on the privacy and autonomy of natural persons, raising both legal and ethical concerns. Thus, their legal and ethical acceptability, as well as their societal acceptance, might be challenged by several legal provisions in the EU, such as the GDPR; regulations on communications, social platforms, and marketing; and the draft AI Act. Yet, the current legal landscape for emotional AI in Europe is anything but clear – an aspect that becomes even more apparent when we consider the global picture of the regulatory framework for emotional AI.&nbsp;

This book provides a comprehensive contemporary and timely account of the protection of indigenous knowledge in Africa by examining issues such as the nature of indigenous knowledge as part of indigenous property and as the fulcrum of indigenous communities in Africa. Acknowledging the centrality of the members of communities of origin in the production and reproduction of indigenous knowledge, this book discusses options to manage the tension between members of the community, communities of origin and their political community.Furthermore, the book abandons the conceptual distinction between ‘negative’ and ‘positive’ protection and turns towards a subject consideration of indigenous Scientific and Technical Indigenous Knowledge (STIK); indigenous heritage; indigenous designs; indigenous music; indigenous audio-visual, indigenous signs expressions and terms as well as the indigenous literary works that are examined within the context of case studies of the indigenous knowledge human and peoples’ rights. The book concludes that Africa’s modest record of the protection of indigenous knowledge must factor in its extensive use as the foundation of Africa’s entertainment industry and recommends a tripod of ‘community’ ‘participation’ and ‘reward as principles of effective protection.Building on the 2017 title of ‘The Protection of Traditional Cultural Expressions in Africa” this book adopts a mixed method of a legal pluralistic account of indigenous knowledge; using intellectual property as a lens to view indigenous knowledge and a cultural production account of indigenous knowledge and will be useful to intellectual property lawyers; sociologists; economists; Africanists; innovation law and policy specialists and legal practitioners.

The Protection of Indigenous Knowledge in Africa

Hybrid threats have been defined in various ways by different security actors, with their scope continuously expanding to encompass emerging insecurities within the evolving security environment. As an umbrella term encompassing a wide spectrum of threats with complex and multidimensional features, the notion of hybrid threats remains inherently vague and amorphous. This lack of clarity presents significant challenges for policymakers, who must constantly identify potential dangers, anticipate risks, and formulate effective responses to safeguard their polities and populations. Consequently, a persistent sense of insecurity has become a defining characteristic of the current European security landscape.
This ‘new normal’ of European security is characterised by a series of ‘(un)known unknowns’ that fall under the elusive concept of hybrid threats. However, rather than accepting this evolving security paradigm at face value, this study calls for a critical examination of its underlying assumptions, core concepts, and broader political implications. It argues that the hybrid threat narrative demands a re-evaluation of what security means in contemporary Europe and how it is operationalised.
Moreover, the study underscores the expansive nature of the hybrid threat framework, which has the potential to include virtually any domain – ranging from education and technology to research and public infrastructure – thereby contributing to the securitisation of all aspects of social and political life. This expansive and ambiguous framing raises important questions about the limits of security and allocation of resources, carrying considerable implications for democratic governance in Europe.
Dr Zeynep Arkan is an Associate Professor of International Relations at Hacettepe University (Ankara) and a Visiting Fellow at the Österreichisches Institut für Internationale Politik (Vienna). She holds a BSc from Middle East Technical University (Ankara), an MA from Exeter University (Exeter), and a PhD from the University of Kent (Canterbury).

As an umbrella term encompassing a wide spectrum of threats with complex and multidimensional features, the notion of hybrid threats remains inherently vague and amorphous. This lack of clarity presents significant challenges for policymakers, who must constantly identify potential dangers, anticipate risks, and formulate effective responses to safeguard their polities and populations. Consequently, a persistent sense of insecurity has become a defining characteristic of the current European security landscape.This ‘new normal’ of European security is characterised by a series of ‘(un)known unknowns’ that fall under the elusive concept of hybrid threats. However, rather than accepting this evolving security paradigm at face value, this study calls for a critical examination of its underlying assumptions, core concepts, and broader political implications. It argues that the hybrid threat narrative demands a re-evaluation of what security means in contemporary Europe and how it is operationalised.Moreover, the study underscores the expansive nature of the hybrid threat framework, which has the potential to include virtually any domain – ranging from education and technology to research and public infrastructure – thereby contributing to the securitisation of all aspects of social and political life. This open access book focuses on public governance’s increasing reliance on emerging digital technologies. ‘Disruptive’ or ‘emerging’ digital technologies, such as artificial intelligence and blockchain, are often portrayed as highly promising, with the potential to transform established societal, economic, or governmental practices. Unsurprisingly, public actors are therefore increasingly experimenting with the application of these emerging digital technologies in public governance.The first part of the book shows how automatization via algorithmic systems, the networked nature of distributed technologies such as blockchain, and data-driven use of AI in public governance can promote hyper-connectivity and hyper-complexity. This trend and the associated concerns have drawn societal, political, and scholarly attention to regulatory compliance considering the current and potential future uses of emerging technologies. Accordingly, the second part of the book focuses on regulatory compliance and regulatory solutions. It explores the compatibility of technology with existing regulations, existing legal tools that could be innovatively applied for the successful regulation of emerging technologies, and approaches to updating existing legislation or creating new legislation for the regulation of emerging technologies. While socio-ethical considerations on upholding public values in a digital world are at the heart of all chapters, the third part specifically focuses on public values and trust.
