What does it take for someone-or something-to count as a legal person? Is it a matter of biology, ideology, or both? This book explores how societies determine who or what qualifies as a legal person, from individual humans to corporations, from nation-states to environmental entities. The author argues that legal personhood is not grounded in fixed, mind-independent properties or logical entailments. Instead, it develops from how humans experience their physical and cultural worlds through embodied cognition. Mapping these experiences onto seemingly discrete (legal) concepts yields a categorisation process that is creative yet patterned by culturally entrenched models and institutional aims. The book introduces the "radial conception," which posits that legal personhood is a flexible, context-dependent category centred around a core case. The core case - often, in many legal systems, the adult citizen of sound mind - is a mental model that helps define the category and influences how we think about it. This makes the most typical features of a category the default ones we think of when encountering it. As new situations arise or social needs evolve, legal personhood expands outward from the core case to include a diverse range of entities. However, this expansion does not follow rigid rules; rather, it relies on conceptual mappings that derive much of their persuasive power from cognitive tools like metaphors, metonymies, and image schemas. This book champions the work of women in legal history, and their contributions to both the discipline and feminist activism over nearly two centuries. It considers women in academia, which was, in theory, open to women before they could become lawyers in most European countries. And it considers women working beyond the academy: many studied legal history in other ways; in local history societies, through archival work, and via activism. Women legal historians have been under-recognised or forgotten altogether, even where they made substantial scholarly contributions. In focusing on the work of women in legal history, this book lays the foundations for a transformational reassessment of the discipline. It asks searching questions about what counts as legal history. It demonstrates that work by and about women should appear in our legal history courses, be discussed in our seminars, and be cited in our academic work. If the field of legal history is lively, innovative, and wide-ranging, everyone working in it benefits. By shining a light on undervalued scholarship, and areas which have received insufficient attention, we challenge assumptions in our discipline and advance its methods. This open-access volume examines the evidentiary use of AI in criminal proceedings, questioning whether existing criminal procedure rules are sufficient to address its unique challenges. The widespread use of devices that collect, store, and process data about citizens' behaviour has created new opportunities for criminal justice systems to detect, investigate, and prosecute crime. Law enforcement authorities are no longer limited to searching for information or clues related to reported offences; they increasingly rely on digital investigative techniques to identify individuals, patterns, or data points that may indicate an offence. The shift from retrospective investigations toward more predictive and preventive approaches has been amplified by AI technologies using machine learning and deep neural networks. Within AI's wide presence in the criminal justice system, this volume investigates only the evidentiary use of AI: when law enforcement authorities rely on AI for investigating and prosecuting offences and offer AI's output as evidence to tie the accused to a crime. The focus is on six countries - Germany, France, Luxembourg, the Netherlands, the UK, and the US - offering a comparative look at how each legal system handles AI evidence in criminal proceedings. This book argues that patient autonomy and medical negligence make for strange bedfellows. The emphasis on autonomy has distorted orthodox negligence principles, contributing to uncertainty and angst amongst healthcare professionals while eroding trust in the doctor-patient relationship. This work takes the current discourse beyond autonomy - which focuses on the rights of the patient, to agency and shared decision-making - which focus on the relationship between doctor and patient. The core argument is built on a review of the theoretical foundations of negligence and the philosophical conceptions of autonomy. Provocatively, this work argues against a rights-based approach to negligence - which can be confrontational - in favour of a human obligations approach, which is collaborative and thus well suited to the doctor-patient relationship. Drawing on the theoretical analysis, the book identifies doctrinal anomalies in the duty of care, standard of care, causation, and damage. It critically analyses landmark UK Supreme Court cases, including Chester v Afshar, Montgomery v Lanarkshire Health Board, and McCulloch v Forth Valley Health Board, arguing that the law is increasingly detached from the realities of medical practice and reasonable expectations of patients.
